The Measures for the Administration of the Bidding for Highway Construction Projects, as adopted at the 23rd executive meeting on December 2, 2015, are hereby issued and shall come into force on February 1, 2016. 《公路工程建设项目招标投标管理办法》已于2015年12月2日经第23次部务会议通过,现予公布,自2016年2月1日起施行。

Measures for the Administration of the Bidding for Highway Construction Projects 公路工程建设项目招标投标管理办法
Chapter I General Provisions 

第一章 总 则

Article 1 In order to regulate the bidding activities for highway construction projects and improve the management system for the construction market of highway projects, these Measures are developed in accordance with the Highway Law of the People's Republic of China, the Bidding Law of the People's Republic of China, the Regulation on the Implementation of the Bidding Law of the People's Republic of China, and other laws and administrative regulations.   第一条 为规范公路工程建设项目招标投标活动,完善公路工程建设市场管理体系,根据《中华人民共和国公路法》《中华人民共和国招标投标法》《中华人民共和国招标投标法实施条例》等法律、行政法规,制定本办法。
Article 2 These Measures shall apply to the bidding activities for the survey, design, construction, construction supervision, and other work of highway construction projects within the territory of People's Republic of China.   第二条 在中华人民共和国境内从事公路工程建设项目勘察设计、施工、施工监理等的招标投标活动,适用本办法。
Article 3 The Ministry of Transport shall be responsible for the supervision and administration of the bidding activities for highway construction projects nationwide.   第三条 交通运输部负责全国公路工程建设项目招标投标活动的监督管理工作。
The competent transport departments of the provincial people's governments shall be responsible for the supervision and administration of the bidding activities for highway construction projects within their respective administrative regions. 省级人民政府交通运输主管部门负责本行政区域内公路工程建设项目招标投标活动的监督管理工作。
Article 4 The competent transport departments at all levels shall, in accordance with relevant provisions of the state, promote the bidding activities for highway construction projects into the uniform public resources trading platform.   第四条 各级交通运输主管部门应当按照国家有关规定,推进公路工程建设项目招标投标活动进入统一的公共资源交易平台进行。
Article 5 The competent transport departments at all levels shall, in accordance with relevant provisions of the state, promote the electronic bidding for highway construction projects. The information about bidding activities shall be disclosed and subject to public supervision.   第五条 各级交通运输主管部门应当按照国家有关规定,推进公路工程建设项目电子招标投标工作。招标投标活动信息应当公开,接受社会公众监督。
Article 6 The bid inviting party of a highway construction project or its designated agency shall make audio-video recordings of the qualification examination, bid opening, bid evaluation and other processes and archive them for future reference.   第六条 公路工程建设项目的招标人或者其指定机构应当对资格审查、开标、评标等过程录音录像并存档备查。
Chapter II Invitation for Bids 

第二章 招 标

Article 7 The bid inviting party of a highway construction project means a legal person or any other organization that proposes a bidding project for which bids are invited.   第七条 公路工程建设项目招标人是提出招标项目、进行招标的项目法人或者其他组织。
Article 8 For a project legally requiring the invitation of bids for which the project approval or confirmation formalities need to be undergone in accordance with the relevant provisions of the state, the bid inviting party shall invite bids based on the scope of bids, bidding method and form of organization of bid invitation determined by the project approval or confirmation authority.   第八条 对于按照国家有关规定需要履行项目审批、核准手续的依法必须进行招标的公路工程建设项目,招标人应当按照项目审批、核准部门确定的招标范围、招标方式、招标组织形式开展招标。
For a highway construction project, bids may not be invited for the survey and design thereof until the project has undergone the project approval or confirmation formalities; bids may not be invited for the construction supervision thereof or general contracting in the design and construction thereof until the preliminary design documents thereof are approved; bids may not be invited for construction until the working drawing design documents thereof are approved. 公路工程建设项目履行项目审批或者核准手续后,方可开展勘察设计招标;初步设计文件批准后,方可开展施工监理、设计施工总承包招标;施工图设计文件批准后,方可开展施工招标。
Where the invitation of bids for construction is subject to pre-qualification, pre-qualification may be conducted after the preliminary design documents are approved. 施工招标采用资格预审方式的,在初步设计文件批准后,可以进行资格预审。
Article 9 Where a highway construction project falls under any of the following circumstances, bid invitation is not required:   第九条 有下列情形之一的公路工程建设项目,可以不进行招标:
(1) The project involves national security, national secrets, emergency rescue, or disaster relief, or involves other special circumstances such as the use of poverty alleviation funds to implement working in exchange for aid or requiring migrant workers to be employed. (一)涉及国家安全、国家秘密、抢险救灾或者属于利用扶贫资金实行以工代赈、需要使用农民工等特殊情况;
(2) An irreplaceable patent or know-how needs to be adopted. (二)需要采用不可替代的专利或者专有技术;
(3) The procuring party has the qualification and capability to carry out the engineering construction or provide services by itself, and complies with the statutory requirements. (三)采购人自身具有工程施工或者提供服务的资格和能力,且符合法定要求;
(4) The franchise project investor that has been chosen through bidding is able to carry out the construction or provide services by itself in accordance with the law. (四)已通过招标方式选定的特许经营项目投资人依法能够自行施工或者提供服务;
(5) It is necessary to purchase projects or services from the original bid winner; otherwise, the construction or the ancillary facility requirements would be affected. (五)需要向原中标人采购工程或者服务,否则将影响施工或者功能配套要求;
(6) Other special circumstances as prescribed by the state. (六)国家规定的其他特殊情形。
A bid inviting party may not engage in falsification to apply the previous paragraph in order to avoid bid invitation. 招标人不得为适用前款规定弄虚作假,规避招标。
Article 10 Where the open bidding method is adopted in a highway construction project, the qualification of bidders shall be generally examined by post-qualification.   第十条 公路工程建设项目采用公开招标方式的,原则上采用资格后审办法对投标人进行资格审查。
Article 11 The open bidding for a highway construction project in the manner of pre-qualification shall be conducted under the following procedures:   第十一条 公路工程建设项目采用资格预审方式公开招标的,应当按照下列程序进行:
(1) Preparing pre-qualification documents. (一)编制资格预审文件;
(2) Issuing a pre-qualification announcement, offering pre-qualification documents, and disclosing the key contents of pre-qualification documents. (二)发布资格预审公告,发售资格预审文件,公开资格预审文件关键内容;
(3) Receiving pre-qualification application documents. (三)接收资格预审申请文件;
(4) Forming a pre-qualification committee to conduct a pre-qualification examination on pre-qualification applicants and prepare a pre-qualification report. (四)组建资格审查委员会对资格预审申请人进行资格审查,资格审查委员会编写资格审查报告;
(5) According to the pre-qualification results, issuing an invitation for bids to the applicants who have passed the pre-qualification; and issuing a notice on pre-qualification results to the applicants who fail to pass the pre-qualification, and informing them of the basis and reasons for failure. (五)根据资格审查结果,向通过资格预审的申请人发出投标邀请书;向未通过资格预审的申请人发出资格预审结果通知书,告知未通过的依据和原因;
(6) Preparing bidding documents. (六)编制招标文件;
(7) Offering bidding documents, and disclosing the key contents of bidding documents. (七)发售招标文件,公开招标文件的关键内容;
(8) Organizing the prospective bidders to make an on-site investigation of the project site if necessary, and holding a preliminary bidding meeting. (八)需要时,组织潜在投标人踏勘项目现场,召开投标预备会;
(9) Receiving the bidding documents and opening bids in a public manner. (九)接收投标文件,公开开标;
(10) Forming a bid evaluation committee to evaluate bids, prepare bid evaluation reports and recommend bid-winning candidates. (十)组建评标委员会评标,评标委员会编写评标报告、推荐中标候选人;
(11) Publishing relevant information on bid-winning candidates. (十一)公示中标候选人相关信息;
(12) Determining the bid winner. (十二)确定中标人;
(13) Preparing a written report on bidding activities. (十三)编制招标投标情况的书面报告;
(14) Issuing a bid winning notice to the bid winner, and notifying all the unsuccessful bidders of the bid winning result. (十四)向中标人发出中标通知书,同时将中标结果通知所有未中标的投标人;
(15) Entering into a contract with the bid winner. (十五)与中标人订立合同。
The open bidding in the manner of post-qualification shall, after the preparation of the bidding documents is completed and a bid invitation announcement is issued, be conducted under the procedures as set forth in items (7) through (15) the preceding paragraph. 采用资格后审方式公开招标的,在完成招标文件编制并发布招标公告后,按照前款程序第(七)项至第(十五)项进行。
If the selected bidding method is adopted, after the bidding documents is completely prepared and an invitation for bids is issued, the selected bidding shall be conducted under the procedures as set forth in items (7) through (15) of the preceding paragraph. 采用邀请招标的,在完成招标文件编制并发出投标邀请书后,按照前款程序第(七)项至第(十五)项进行。
Article 12 For a project in which state-owned funds hold a controlling or dominant stake and for which the invitation of bids must be conducted according to law, if it is subject to pre-qualification, the bid inviting party shall establish a pre-qualification committee to examine pre-qualification application documents in accordance with the relevant provisions. The provisions of these Measures on bid evaluation committees shall apply to the selection of experts of the pre-qualification committee and the work requirements for the pre-qualification examination.   第十二条 国有资金占控股或者主导地位的依法必须进行招标的公路工程建设项目,采用资格预审的,招标人应当按照有关规定组建资格审查委员会审查资格预审申请文件。资格审查委员会的专家抽取以及资格审查工作要求,应当适用本办法关于评标委员会的规定。
Article 13 The qualifying system shall be generally adopted in the pre-qualification method.   第十三条 资格预审审查办法原则上采用合格制。
Where the qualifying system is adopted in the pre-qualification method, an applicant who complies with the examination standards prescribed in the pre-qualification documents shall pass the pre-qualification. 资格预审审查办法采用合格制的,符合资格预审文件规定审查标准的申请人均应当通过资格预审。
Article 14 Upon completion of a pre-qualification examination, the pre-qualification committee shall prepare a pre-qualification report. A pre-qualification report shall include:   第十四条 资格预审审查工作结束后,资格审查委员会应当编制资格审查报告。资格审查报告应当载明下列内容:
(1) The basic information on the project for which bids are invited. (一)招标项目基本情况;
(2) The list of the members of the pre-qualification committee. (二)资格审查委员会成员名单;
(3) The list of supervisors. (三)监督人员名单;
(4) The submission of pre-qualification application documents. (四)资格预审申请文件递交情况;
(5) The list of applicants who have passed the pre-qualification examination. (五)通过资格审查的申请人名单;
(6) The list of applicants who fail to pass the pre-qualification examination and the reasons for failure. (六)未通过资格审查的申请人名单以及未通过审查的理由;
(7) Information on scoring. (七)评分情况;
(8) Minutes on matters to be clarified or explained. (八)澄清、说明事项纪要;
(9) Other matters to be explained. (九)需要说明的其他事项;
(10) Appendixes on pre-qualification examination. (十)资格审查附表。
Except for the contents of items (1), (3), and (4) as set out in the preceding paragraph, all members of the pre-qualification committee shall sign the pre-qualification report page by page. 除前款规定的第(一)、(三)、(四)项内容外,资格审查委员会所有成员应当在资格审查报告上逐页签字。
Article 15 If a pre-qualification applicant has any objection to the pre-qualification examination result, it shall raise an objection within three days after receiving the notice of the pre-qualification examination result. The bid inviting party shall give a reply within three days upon receipt of the objection; before a reply is given, bidding activities shall be suspended.   第十五条 资格预审申请人对资格预审审查结果有异议的,应当自收到资格预审结果通知书后3日内提出。招标人应当自收到异议之日起3日内作出答复;作出答复前,应当暂停招标投标活动。
If the bid inviting party has not received any objection or has given a reply upon receipt of an objection, it shall issue letters of invitations for bids to pre-qualified applicants in a timely manner. An applicant who fails to pass the pre-qualification examination shall not be qualified as a bidder. 招标人未收到异议或者收到异议并已作出答复的,应当及时向通过资格预审的申请人发出投标邀请书。未通过资格预审的申请人不具有投标资格。
Article 16 For a highway construction project for which the invitation of bids must be conducted according to law, the bid inviting party shall prepare pre-qualification documents and bidding documents based on the standard documents developed by the Ministry of Transport and in light of the specific characteristics and actual needs of the project for which bids are invited.   第十六条 对依法必须进行招标的公路工程建设项目,招标人应当根据交通运输部制定的标准文本,结合招标项目具体特点和实际需要,编制资格预审文件和招标文件。
The pre-qualification documents and bidding documents shall specify detailed evaluation procedures, standards and methods, and a bid inviting party shall not separately develop detailed evaluation rules. 资格预审文件和招标文件应当载明详细的评审程序、标准和方法,招标人不得另行制定评审细则。
Article 17 A bid inviting party shall, in accordance with the provisions of the competent transport department of the provincial people's government, submit the pre-qualification documents and the clarifications and modifications thereof as well as the bidding documents and the clarifications and modifications thereof to the corresponding competent transport department for recordation.   第十七条 招标人应当按照省级人民政府交通运输主管部门的规定,将资格预审文件及其澄清、修改,招标文件及其澄清、修改报相应的交通运输主管部门备案。
Article 18 A bid inviting party shall, from the date when it starts selling the pre-qualification documents or bidding documents, upload the key contents of the documents to the government website of the competent transport department responsible for supervision over the invitation for bids or any other website designated by the competent transport department for disclosure. The disclosed contents shall include the brief information about the project, qualification requirements for applicants or bidders, pre-qualification measures, bid evaluation measures and the contact information of the bid inviting party, and the period of disclosure shall expire two days before the deadline for submission of pre-qualification application documents or ten days before the deadline for submission of bids.   第十八条 招标人应当自资格预审文件或者招标文件开始发售之日起,将其关键内容上传至具有招标监督职责的交通运输主管部门政府网站或者其指定的其他网站上进行公开,公开内容包括项目概况、对申请人或者投标人的资格条件要求、资格审查办法、评标办法、招标人联系方式等,公开时间至提交资格预审申请文件截止时间2日前或者投标截止时间10日前结束。
Where a clarification or modification of the pre-qualification documents or the bidding documents as made by the bid inviting party involves any of the disclosed contents as set out in the preceding paragraph, the bid inviting party shall, when undergoing the recordation formalities with the competent transport department, upload the clarification or modification to the website mentioned in the preceding paragraph. 招标人发出的资格预审文件或者招标文件的澄清或者修改涉及到前款规定的公开内容的,招标人应当在向交通运输主管部门备案的同时,将澄清或者修改的内容上传至前款规定的网站。
Article 19 A prospective bidder or any other interested party can raise an objection to the pre-qualification documents or bidding documents in accordance with the relevant provisions of the state. The bid inviting party shall give a written reply to such an objection. Where the bid inviting party fails to give a written reply within a prescribed time limit, it shall postpone the deadline for submission of the pre-qualification application documents or bids accordingly.   第十九条 潜在投标人或者其他利害关系人可以按照国家有关规定对资格预审文件或者招标文件提出异议。招标人应当对异议作出书面答复。未在规定时间内作出书面答复的,应当顺延提交资格预审申请文件截止时间或者投标截止时间。
Where the content of the bid inviting party's written reply affects the preparation of the pre-qualification application documents or bidding documents, the bid inviting party shall adjust the deadline for submission of the pre-qualification application documents or bids in accordance with the provisions on clarification or modification, and notify all prospective bidders that have obtained the pre-qualification documents or bidding documents in writing 招标人书面答复内容涉及影响资格预审申请文件或者投标文件编制的,应当按照有关澄清或者修改的规定,调整提交资格预审申请文件截止时间或者投标截止时间,并以书面形式通知所有获取资格预审文件或者招标文件的潜在投标人。
Article 20 A bid inviting party shall reasonably divide a project for which bids are invited into different stages, determine the construction period, and raise the objectives and requirements of quality and safety and specify them in the bidding documents. The division of bidding stages shall be conductive to the organization of the project and construction management and the connection and cooperation of all specialties, and may not be utilized to avoid the invitation of bids or restrict or preclude prospective bidders.   第二十条 招标人应当合理划分标段、确定工期,提出质量、安全目标要求,并在招标文件中载明。标段的划分应当有利于项目组织和施工管理、各专业的衔接与配合,不得利用划分标段规避招标、限制或者排斥潜在投标人。
A bid inviting party may invite bids for the general contracting in design and construction, the general contracting in construction of different specialties. 招标人可以实行设计施工总承包招标、施工总承包招标或者分专业招标。
Article 21 A bid inviting party shall, in light of the specific characteristics and actual needs of the project for which bids are invited, set eligibility requirements on prospective bidders or bidders in terms of qualification, performance, key personnel, financial capability and credit for performance of contract, and may not restrict or preclude prospective bidders or bidders with unreasonable conditions.   第二十一条 招标人结合招标项目的具体特点和实际需要,设定潜在投标人或者投标人的资质、业绩、主要人员、财务能力、履约信誉等资格条件,不得以不合理的条件限制、排斥潜在投标人或者投标人。
In addition to the circumstances prescribed in Article 32 of the Regulation on the Implementation of the Bidding Law of the People's Republic of China, a bid inviting party who has any of the following acts shall be deemed as restricting or precluding prospective bidders or bidders with unreasonable conditions: 除《中华人民共和国招标投标法实施条例》第三十二条规定的情形外,招标人有下列行为之一的,属于以不合理的条件限制、排斥潜在投标人或者投标人:
(1) Setting eligibility, technical or business conditions in terms of qualification, performance, key personnel, financial capability and credit for performance of contract not commensurate with the specific characteristics or actual needs of the project for which bids are invited or irrelevant to the performance of contract. (一)设定的资质、业绩、主要人员、财务能力、履约信誉等资格、技术、商务条件与招标项目的具体特点和实际需要不相适应或者与合同履行无关;
(2) Compulsively requiring the legal representatives, persons in charge, technology directors and other specific persons of prospective bidders or bidders to personally purchase pre-qualification documents or bidding documents or participate in the open bidding activities. (二)强制要求潜在投标人或者投标人的法定代表人、企业负责人、技术负责人等特定人员亲自购买资格预审文件、招标文件或者参与开标活动;
(3) Restricting prospective bidders or bidders from submitting bids in the place where the project is located, by setting conditions for recordation, registration, and formation of branches or other unreasonable conditions that have no basis in laws and administrative regulations. (三)通过设置备案、登记、注册、设立分支机构等无法律、行政法规依据的不合理条件,限制潜在投标人或者投标人进入项目所在地进行投标。
Article 22 A bid inviting party shall, in accordance with relevant provisions of the state and in light of the specific characteristics and actual needs of the project for which bids are invited, reasonably determine the requirements for the number and eligibility of a bidder's key personnel and other management and technical personnel. A bidder's key personnel to be selected shall be filled out in the bidding documents, the specific persons selected as other management and technical personnel shall be determined by the bid inviting party and the bid winner in the contract negotiation process. For the principal part of a mega-large bridge project or a mega-long tunnel project that is particularly complex or any other project having special requirements, the bid inviting party may require bidders to fill other management and technical personnel in the bidding documents.   第二十二条 招标人应当根据国家有关规定,结合招标项目的具体特点和实际需要,合理确定对投标人主要人员以及其他管理和技术人员的数量和资格要求。投标人拟投入的主要人员应当在投标文件中进行填报,其他管理和技术人员的具体人选由招标人和中标人在合同谈判阶段确定。对于特别复杂的特大桥梁和特长隧道项目主体工程和其他有特殊要求的工程,招标人可以要求投标人在投标文件中填报其他管理和技术人员。
For the purpose of these Measures, “key personnel” means technology directors, chief supervisory engineers, project managers, chief project engineers, and other persons in charge of project management and technology. 本办法所称主要人员是指设计负责人、总监理工程师、项目经理和项目总工程师等项目管理和技术负责人。
Article 23 A bid inviting party can decide whether to prepare a base bid price or a maximum bid price. A bid inviting party may not set a minimum bid price.   第二十三条 招标人可以自行决定是否编制标底或者设置最高投标限价。招标人不得规定最低投标限价。
An intermediary institution that accepts entrustment to prepare the base bid price or the maximum bid price for a project shall not participate in the bidding of the project, nor shall it prepare bidding documents or provide consulting for the bidders of such a project. 接受委托编制标底或者最高投标限价的中介机构不得参加该项目的投标,也不得为该项目的投标人编制投标文件或者提供咨询。
Article 24 A bid inviting party shall strictly comply with the provisions of relevant laws and administrative regulations on the collection of various security deposits, and specify the way, amount or time for return of the security deposits.   第二十四条 招标人应当严格遵守有关法律、行政法规关于各类保证金收取的规定,在招标文件中载明保证金收取的形式、金额以及返还时间。
A bid inviting party shall neither increase, in any name or disguised form, the bid security, nor arbitrarily change the way, amount or time for return of the same stated in bidding documents. A bid inviting party may not collect any form of security deposit during the pre-qualification examination. 招标人不得以任何名义增设或者变相增设保证金或者随意更改招标文件载明的保证金收取形式、金额以及返还时间。招标人不得在资格预审期间收取任何形式的保证金。
Article 25 Where a bid inviting party requires, in the bidding documents, bidders to pay a bid security, the amount of the bid security may not exceed 2% of the estimated value of the project for which bids are invited. The validity period of bid security shall be identical with that of bids.   第二十五条 招标人在招标文件中要求投标人提交投标保证金的,投标保证金不得超过招标标段估算价的2%。投标保证金有效期应当与投标有效期一致。
For a highway construction project for which the invitation of bids must be conducted, the bid security paid by a bidder in the form of cash or check shall be transferred from its basic account. Where the bid security paid by a bidder fails to meet the requirements of the bidding documents, the bid shall be rejected. 依法必须进行招标的公路工程建设项目的投标人,以现金或者支票形式提交投标保证金的,应当从其基本账户转出。投标人提交的投标保证金不符合招标文件要求的,应当否决其投标。
A bid inviting party shall not misappropriate the bid security. 招标人不得挪用投标保证金。
Article 26 A bid inviting party shall, in accordance with the provisions of relevant laws and regulations of the state, specify the engineering works and services that are allowed to be subcontracted or may not be subcontracted in the bidding documents, the eligibility requirements that subcontractors should meet, and the management requirements for subcontracting.   第二十六条 招标人应当按照国家有关法律法规规定,在招标文件中明确允许分包的或者不得分包的工程和服务,分包人应当满足的资格条件以及对分包实施的管理要求。
A bid inviting party may not set discriminatory terms on subcontracting in the bidding documents. 招标人不得在招标文件中设置对分包的歧视性条款。
Where a bid inviting party has any of the following acts, such an act falls within the discriminatory terms mentioned in the preceding paragraph: 招标人有下列行为之一的,属于前款所称的歧视性条款:
(1) Taking the scale of the workload subcontracted as the conditions of bid rejection. (一)以分包的工作量规模作为否决投标的条件;
(2) Setting deduction provisions for the subcontracting plan of a bidder which conforms to the provisions of laws, regulations, and bidding documents. (二)对投标人符合法律法规以及招标文件规定的分包计划设定扣分条款;
(3) Having differences in the scoring of bidders in accordance with the workload subcontracted. (三)按照分包的工作量规模对投标人进行区别评分;
(4) Restricting bidders from subcontracting by setting other unreasonable conditions. (四)以其他不合理条件限制投标人进行分包的行为。
Article 27 A bid inviting party shall reasonably allocate risks of both parties in bidding documents, and may not set unreasonable terms transferring the risk the bid inviting party should bear to a bidder of survey, design, construction, or supervision. The bidding documents shall have reasonable clauses on price adjustment, and clearly specify the time limit for payment of contract value, the rate of accrued interest and the payment date, so as to ensure equality in the status of both parties.   第二十七条 招标人应当在招标文件中合理划分双方风险,不得设置将应由招标人承担的风险转嫁给勘察设计、施工、监理等投标人的不合理条款。招标文件应当设置合理的价格调整条款,明确约定合同价款支付期限、利息计付标准和日期,确保双方主体地位平等。
Article 28 A bid inviting party shall, based on the specific characteristics of the project for which bids are invited and in accordance with the relevant provisions of these Measures, reasonably establish the standards and methods for bid evaluation in bidding documents. The standards and methods for bid evaluation may not contain any preference for or preclusion of any specific bidder, and may not impede or restrict the competition among bidders. It is prohibited to directly determine the bid-winning candidates by drawing lots or numbers or by any other lottery means.   第二十八条 招标人应当根据招标项目的具体特点以及本办法的相关规定,在招标文件中合理设定评标标准和方法。评标标准和方法中不得含有倾向或者排斥潜在投标人的内容,不得妨碍或者限制投标人之间的竞争。禁止采用抽签、摇号等博彩性方式直接确定中标候选人。
Article 29 Where the projects, goods or services at temporarily evaluated prices within the scope of a project for which bids are invited fall under the scope of a project for which the invitation of bids must be conducted and which reaches the scale standards as prescribed by the state, the bid inviting party shall invite bids in accordance with the law.
