Article 1 For purposes of ensuring the implementation of the Party's policies on cadres, avoiding the neglect of supervision over the appointment of cadres and the appointment of wrong persons, and seriously dealing with violations of laws, regulations and disciplines arising during the selection and appointment of cadres, these Measures are formulated in accordance with the Regulation on the Selection and Appointment of the Party and Government Leaders, Regulation of the CPC on Dealing with the Violations of Party Disciplines, Interim Provisions on Adopting the Accountability System to the Party and Government Leaders and other regulations of the Party, and the Civil Servant Law of the People's Republic of China and other laws and regulations of the state.   第一条 为保证党的干部路线方针政策的贯彻执行,防止用人失察失误,严肃处理干部选拔任用工作中的违规违纪行为,根据《党政领导干部选拔任用工作条例》、《中国共产党纪律处分条例》、《关于实行党政领导干部问责的暂行规定》等党内法规和《中华人民共和国公务员法》等国家法律法规,制定本办法。

 
Article 2 The accountability system shall be adopted for the selection and appointment of the Party and government leaders and the principles of the Party committees' leadership, classified responsibility, seeking truth from facts, objectiveness and impartiality, powers matching responsibilities, combining punishment with education, strict requirements and violators subject to punishments shall be adhered to.   第二条 对党政领导干部选拔任用工作实行责任追究,坚持党委领导、分级负责,实事求是、客观公正,权责一致、惩教结合,严格要求、违规必究的原则。

 
Article 3 The Party committees (Party groups), the disciplinary inspection and supervision organs, and the organization and personnel departments shall, under their respective powers, be responsible for adopting the accountability system for the selection and appointment of the Party and government leaders.   第三条 党委(党组)及纪检监察机关、组织人事部门按照职责权限负责对党政领导干部选拔任用工作实行责任追究。

 
Article 4 In the selection and appointment of the Party and government leaders, the major leaders or the relevant leaders of the Party committee (Party group) shall be held accountable under any of the following circumstances:   第四条 在党政领导干部选拔任用工作中,有下列情形之一的,追究党委(党组)主要领导干部或者有关领导干部的责任:

 
1. An individual designates the candidates to be promoted or adjusted and thus violates the procedures for and provisions on the appointment and dismissal of cadres; (一)违反干部任免程序和规定,个人指定提拔、调整人选的;

 
2. A decision of appointment or dismissal of any cadre is made upon random motion; (二)临时动议决定干部任免的;

 
3. A decision of appointment or dismissal of any cadre is made without holding a meeting of the Party Committee (Party group) for discussion under relevant provisions; (三)不按照规定召开党委(党组)会议讨论决定干部任免的;

 
4. An individual makes a decision of appointment or dismissal of any cadre or an individual changes the collective decision of appointment or dismissal of any cadre made at the meeting of the Party Committee (Party group); (四)个人决定干部任免或者个人改变党委(党组)会议集体作出的干部任免决定的;

 
5. The case of crash promotion or adjustment of any cadre; (五)突击提拔、调整干部的;

 
6. In violation of the relevant provisions, the case of selecting or appointing leaders by exceeding the number of positions prescribed or giving more favorable treatments to cadres without regarding their positions; (六)违反规定超职数配备领导干部或者提高干部职级待遇的;

 
7. The case of inciting, instigating or forcing the personnel department to violate the relevant provisions in the selection and appointment of cadres, or hampering or stopping the disciplinary inspection and supervision organ and the organization and personnel departments from investigating and verifying the issues about the selection and appointment of cadres and dealing with the issues under relevant provisions; (七)授意、指使、强令组织人事部门违反规定选拔任用干部,或者阻挠、制止纪检监察机关和组织人事部门对选人用人问题进行调查核实以及按照有关规定作出处理的;

 
8. Any violation of the provisions on the selection and appointment of cadres which results in the lack of supervision over the appointment of cadres and the appointment of wrong persons and has bad consequences; (八)违反干部选拔任用工作规定,导致用人失察失误,造成恶劣影响的;

 
9. The appointment of cadres is seriously irregular in the present region or department. The issue has been strongly complained about by cadres and the general public, but it has not been effectively investigated and dealt with by organization and personnel disciplines; or (九)本地区本部门用人上不正之风严重,干部群众反映强烈以及对违反组织人事纪律的行为查处不力的;

 
10. Other violations of the provisions on the selection and appointment of cadres. (十)有其他违反干部选拔任用工作规定行为的。

In case of major natural disaster, mass incident or any other emergency, the appointment of any person upon approval of the Party organization at the next higher level is not covered by the accountability system, but afterwards, the procedures for the appointment and dismissal of cadres shall be made up and a notice shall be circulated within a certain range.
 
在发生突发重大自然灾害、群体性事件及其他紧急情况下,经上一级党组织批准的用人行为,不列入责任追究范围,但事后应当履行有关干部任免程序,并在一定范围内通报。

 
Article 5 The major leaders of the organization and personnel departments and the relevant persons shall be held liable where any of the following circumstances occurs in the selection and appointment of the Party and government leaders:   第五条 在党政领导干部选拔任用工作中,有下列情形之一的,追究组织人事部门主要领导干部和有关人员的责任:

 
1. Failing to make democratic recommendation or review under the prescribed basic conditions, appointment eligibilities, methods, procedures and scope; (一)不按照规定的基本条件、任职资格、方式、程序和范围进行民主推荐、民主测评的;

 
2. Failing to faithfully report to the Party committee (Party group) the information about the democratic recommendation, democratic review, check, etc.; (二)不如实向党委(党组)报告民主推荐、民主测评、考察等情况的;

 
3. Failing to consult the opinions of the disciplinary inspection and supervision organ about the candidates under the relevant provisions or failing to faithfully report to the Party committee (Party group) the opinions or suggestions of the disciplinary inspection and supervision organ; (三)不按照规定征求纪检监察机关对拟任人选的意见,或者不如实向党委(党组)报告纪检监察机关意见建议的;

 
4. Failing to report to the organization and personnel departments at the higher level the matters relevant to the selection and appointment of cadres under the relevant provisions; (四)不按照规定向上级组织人事部门报告干部选拔任用工作有关事项的;

 
5. Failing to investigate and verify the concrete violation in the selection and appointment of cadres for which the clues reported are clear, and failing to deal with the violation after verification according to the provisions;
