The Regulation on the Supervision of Public Security Organs, as amended and adopted at the 169th executive meeting of the State Council on August 24, 2011, is hereby issued, and shall come into force on October 1, 2011.
 
《公安机关督察条例》已经2011年8月24日国务院第169次常务会议修订通过,现将修订后的《公安机关督察条例》公布,自2011年10月1日起施行。

Article 1 For the purpose of improving the mechanism for supervising public security organs and ensuring that public security organs and police officers therein perform duties, exercise functions, and observe discipline in accordance with law, this Regulation is formulated in accordance with the People's Police Law of the People's Republic of China北大法宝

   第一条 为了完善公安机关监督机制,保障公安机关及其人民警察依法履行职责、行使职权和遵守纪律,根据《中华人民共和国人民警察法》的规定,制定本条例。

 
Article 2 The Supervision and Inspection Commission of the Ministry of Public Security (hereinafter referred to as the “Supervision and Inspection Commission”) shall direct the supervision of public security organs around the nation, be responsible for supervising whether the entities subordinate to the Ministry of Public Security, the public security organs at lower levels, and the police officers therein perform duties, exercise functions, and observe discipline in accordance with law. The Supervision and Inspection Commission is answerable to the Minister of Security. The supervisory body of the Ministry of Public Security is the office handling the routine work of the Supervision and Inspection Commission.   第二条 公安部督察委员会领导全国公安机关的督察工作,负责对公安部所属单位和下级公安机关及其人民警察依法履行职责、行使职权和遵守纪律的情况进行监督,对公安部部长负责。公安部督察机构承担公安部督察委员会办事机构职能。

The supervisory bodies of public security organs under the people's governments at or above the county level shall be responsible for supervising whether the entities subordinate to the public security organ at the same level, the public security organs at lower levels, and the police officers therein perform duties, exercise functions, and observe discipline in accordance with law. Such supervisory bodies are answerable to the supervisory body of the public security organ at the next higher level and the chief administrative officer of the public security organ at the same level.
 
县级以上地方各级人民政府公安机关督察机构,负责对本级公安机关所属单位和下级公安机关及其人民警察依法履行职责、行使职权和遵守纪律的情况进行监督,对上一级公安机关督察机构和本级公安机关行政首长负责。

The supervisory body of the public security organ under the people's government at or above the county level is a law enforcement service institution, which consists of full-time personnel in the unit of battalion.
 
县级以上地方各级人民政府公安机关的督察机构为执法勤务机构,由专职人员组成,实行队建制。

 
Article 3 The Ministry of Public Security shall have one Inspector General, and the post shall be assumed by one of the deputy ministers of the Ministry of Public Security.   第三条 公安部设督察长,由公安部一名副职领导成员担任。

Every public security organ under the people's government at or above the county level shall have one Inspector General, and the post shall be concurrently assumed by the chief administrative officer of the public security organ.
 
县级以上地方各级人民政府公安机关设督察长,由公安机关行政首长兼任。

 
Article 4 A supervisory body shall perform on-site inspections on the following matters to verify whether public security organs and the police officers therein perform duties, exercise functions, and observe discipline in accordance with law:   第四条 督察机构对公安机关及其人民警察依法履行职责、行使职权和遵守纪律的下列事项,进行现场督察:

 
(1) organization and implementation of major police deployments, measures, and activities ;; (一)重要的警务部署、措施、活动的组织实施情况;

 
(2) organization and implementation of maintenance of order during important social activities, and public security administration in key areas and locations; (二)重大社会活动的秩序维护和重点地区、场所治安管理的组织实施情况;

 
(3) handling of public security emergencies; (三)治安突发事件的处置情况;

 
(4) implementation of acceptance, filing, investigation, inquiry, punishment, and compulsory measures regarding criminal cases and public security cases; (四)刑事案件、治安案件的受理、立案、侦查、调查、处罚和强制措施的实施情况;

 
(5) implementation of laws and regulations on the administration of public security including public order, transportation, household administration, entry and exit, frontier inspection, fire control, and security guarding; (五)治安、交通、户政、出入境、边防、消防、警卫等公安行政管理法律、法规的执行情况;

 
(6) use of weapons, police equipment, police vehicles, and police symbols; (六)使用武器、警械以及警用车辆、警用标志的情况;

 
(7) handling of citizen reports to the police, requests for assistance, and complaints and appeals; (七)处置公民报警、请求救助和控告申诉的情况;

 
(8) polite performance of work and law enforcement duties, and observance of requirements for police appearance and discipline;
