According to the provisions of the Law of the People's Republic of China on the Organization of the People's Courts and the Civil Procedure Law of the People's Republic of China and other laws, the following provisions on several issues concerning the jurisdiction of military courts in civil cases are formulated in light of the actualities of the people's courts' work on civil trials: | |
根据《中华人民共和国人民法院组织法》、《中华人民共和国民事诉讼法》等法律规定，结合人民法院民事审判工作实际，对军事法院管辖民事案件有关问题作如下规定： |

| Article 1 The following civil cases shall be under the jurisdiction of military courts: | | 第一条 下列民事案件，由军事法院管辖： |
| |
|
| (1) a case in which both parties concerned are military personnel or military entities unless otherwise provided by law; | | （一）双方当事人均为军人或者军队单位的案件，但法律另有规定的除外； |
| |
|
| (2) a case involving military secrets above the secret level; | | （二）涉及机密级以上军事秘密的案件； |
| |
|
| (3) a case over eligibility of voters for the electoral commission established by the military; and | | （三）军队设立选举委员会的选民资格案件； |
| |
|
| (4) a case over the identification of unclaimed property within camps. | | （四）认定营区内无主财产案件。 |

| Article 2 If the civilian party concerned institutes a proceeding or files an application to a military court in the following civil cases, the military court shall accept it: | | 第二条 下列民事案件，地方当事人向军事法院提起诉讼或者提出申请的，军事法院应当受理： |
| |
|
| (1) a case of disputes over tort liability in which military personnel or military entities cause harm to others in the course of performing their duties; | | （一）军人或者军队单位执行职务过程中造成他人损害的侵权责任纠纷案件； |
| |
|
(2) a case of disputes over tort liability in which one party concerned is military personnel or a military entity and the tort takes place within a camp;
