| For the purpose of correctly handling the issues concerning the modification and addition of parties in civil enforcement and protecting the lawful rights and interests of parties and interested parties, these Provisions are developed, in accordance with the provisions of the Civil Procedure Law of the People's Republic of China and other laws, and in combination with the enforcement practice. | | 为正确处理民事执行中变更、追加当事人问题，维护当事人、利害关系人的合法权益，根据《中华人民共和国民事诉讼法》等法律规定，结合执行实践，制定本规定。 |
| Article 1 During the process of enforcement, the enforcement applicant or his or her heir or successor to its rights may apply to the people's court for modifying and adding parties. | Article 8 Where a legal person of an official organ as an enforcement applicant is cancelled, and a subject continuing to perform its obligations applies for modifying and adding it as an enforcement applicant, the people's court shall support such a claim, except when the rights as determined in a valid legal instrument shall be assumed by another subject according to the law; and where there is no subject continuing to perform its obligations, the subject assuming the rights as determined in a valid legal instrument is unspecific, and the subject making the decision of cancellation applies for modifying and adding it as an enforcement applicant, the people's court shall support such a claim. | | 第八条 作为申请执行人的机关法人被撤销，继续履行其职能的主体申请变更、追加其为申请执行人的，人民法院应予支持，但生效法律文书确定的权利依法应由其他主体承受的除外；没有继续履行其职能的主体，且生效法律文书确定权利的承受主体不明确，作出撤销决定的主体申请变更、追加其为申请执行人的，人民法院应予支持。 |
| Article 9 Where an enforcement applicant transfers the creditor's rights as determined in a valid legal instrument to a third party according to the law, the obtaining of the creditor's rights by the third party is recognized in writing, and the third party applies for modifying and adding him or her as an enforcement applicant, the people's court shall support such a claim. | | 第九条 申请执行人将生效法律文书确定的债权依法转让给第三人，且书面认可第三人取得该债权，该第三人申请变更、追加其为申请执行人的，人民法院应予支持。 |
| Article 10 Where a citizen as a person subject to enforcement dies or is declared dead, and an enforcement applicant applies for modifying the citizen's executor, heir, legatee, or another subject obtaining the legacy as the citizen dies or is declared dead and adding the aforesaid person as a person subject to enforcement and assumes responsibilities within the scope of the legacy, the people's court shall support such a claim. | Article 12 Where a legal person or another organization as a person subject to enforcement is divided, and an enforcement applicant applies for modifying and adding a legal person or another organization that is newly formed after division as a person subject to enforcement and assumes joint and several liability for the debts as determined in a valid legal instrument, the people's court shall support such a claim, except as otherwise agreed by the person subject to enforcement and the enforcement applicant before the division on the written agreement reached for the repayment of debts. | | 第十二条 作为被执行人的法人或其他组织分立，申请执行人申请变更、追加分立后新设的法人或其他组织为被执行人，对生效法律文书确定的债务承担连带责任的，人民法院应予支持。但被执行人在分立前与申请执行人就债务清偿达成的书面协议另有约定的除外。 |
Article 13 Where a sole proprietorship as a person subject to enforcement is unable to pay off the debts as determined in a valid legal instrument and an enforcement applicant applies for modifying and adding its contributor as a person subject to enforcement, the people's court shall support such a claim. Where an investor of a sole proprietorship enterprise is a person subject to enforcement, the people's court may directly enforce the property of the sole proprietorship.
