Labor (labor and personnel) departments (bureaus) in all provinces, autonomous regions and municipalities directly under the Central Government; labor and personnel departments of ministries and commissions under the State Council; and production management department of  PLA's General Logistics Department:
 
各省、自治区、直辖市劳动(劳动人事)厅(局),国务院各部委、直属机构劳动人事部门,解放军总后勤部生产管理部:

In order to carry out the Labor Law of the People's Republic of China, and make the regulations on economic compensation easy to operate, we worked out the Measures for Economic Compensations due to Violation or Rescission of Labor Contracts, which are hereby printed and distributed to you for your compliance. The measures for economic compensation due to the violation of a labour contract shall be implemented in accordance with the relevant provisions of the State.
 
为贯彻《劳动法》,使有关经济补偿的规定便于操作,我们制定了《违反和解除劳动合同的经济补偿办法》,现印发给你们,请按照执行。有关违反劳动合同的赔偿办法,按国家有关规定执行。

Measures for Economic Compensations due to Violation or Rescission of Labor Contracts
 
违反和解除劳动合同的经济补偿办法

 
Article 1 The present Measures are formulated in accordance with the “Labor Law of the People's Republic of China” for the purpose of regulating the rates of economic compensations to workers due to violation or rescission of labor contracts.   第一条 为了规范违反和解除劳动合同对劳动者的经济补偿标准,根据《中华人民共和国劳动法》的规定,制定本办法。

 
Article 2 The economic compensations to a worker shall be paid by the employer in a lump sum.   第二条 对劳动者的经济补偿金,由用人单位一次性发给。

 
Article 3 Where an employer deducts a worker's wages or delays the payment thereof, or refuses to pay the wage remunerations for additional working hours to the worker, it shall, in addition to paying a full amount of wage remunerations to the worker within the prescribed time limit, pay the additional economic compensations equal to 25% of the wage remunerations.

   第三条 用人单位克扣或者无故拖欠劳动者工资的,以及拒不支付劳动者延长工作时间工资报酬的,除在规定的时间内全额支付劳动者工资报酬外,还需加发相当于工资报酬百分之二十五的经济补偿金。
