Decision of the Standing Committee of the National People's Congress on the Methods for Selecting the Chief Executive and Forming the Legislative Council of the Hong Kong Special Administrative Region in 2012 and Issues on Universal Suffrage 

全国人民代表大会常务委员会关于香港特别行政区2012年行政长官和立法会产生办法及有关普选问题的决定

The 31st Session of the Standing Committee of the Tenth National People's Congress has considered the Report on the Public Consultation on Constitutional Development and on Whether There Is a Need to Amend the Methods for Selecting the Chief Executive of the Hong Kong Special Administrative Region and Forming the Legislative Council of the Hong Kong Special Administrative Region in 2012 submitted by Donald Tsang Yam-kuen, Chief Executive of the Hong Kong Special Administrative Region, on December 12, 2007. The Session is of the view that appropriate amendments may be made to the specific method for selecting the fourth-term Chief Executive and the specific method for forming the fifth-term Legislative Council of the Hong Kong Special Administrative Region in 2012; that the election of the fifth-term Chief Executive of the Hong Kong Special Administrative Region in 2017 may be implemented in the method of universal suffrage; that after the Chief Executive is selected by universal suffrage, the election of the Legislative Council of the Hong Kong Special Administrative Region may be implemented in the method of electing all the members by universal suffrage. Pursuant to the relevant provisions ofthe Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China and the Interpretation of the Standing Committee of the National People's Congress on Article 7 of Annex I and Article III of Annex II to the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China, the Standing Committee of the National People's Congress hereby makes the following decision:
 
第十届全国人民代表大会常务委员会第三十一次会议审议了香港特别行政区行政长官曾荫权2007年12月12日提交的《关于香港特别行政区政制发展咨询情况及2012年行政长官和立法会产生办法是否需要修改的报告》。会议认为,2012年香港特别行政区第四任行政长官的具体产生办法和第五届立法会的具体产生办法可以作出适当修改;2017年香港特别行政区第五任行政长官的选举可以实行由普选产生的办法;在行政长官由普选产生以后,香港特别行政区立法会的选举可以实行全部议员由普选产生的办法。全国人民代表大会常务委员会根据《中华人民共和国香港特别行政区基本法》的有关规定和《全国人民代表大会常务委员会关于〈中华人民共和国香港特别行政区基本法〉附件一第七条和附件二第三条的解释》决定如下:

 
1. The election of the fourth-term Chief Executive of the Hong Kong Special Administrative Region in 2012 shall not be implemented in the method of universal suffrage. The election of the fifth-term Legislative Council of the Hong Kong Special Administrative Region in 2012 shall not be implemented in the method of electing all the members by universal suffrage. The half-and-half ratio between the members returned by functional constituencies and the members returned by geographical constituencies through direct elections shall be unchanged. The procedures for voting on bills and motions in the Legislative Council shall be unchanged. Subject to the aforementioned, appropriate amendments in conformity with the principle of gradual and orderly progress may be made to the specific method for selecting the fourth-term Chief Executive of the Hong Kong Special Administrative Region in 2012 and the specific method for forming the fifth-term Legislative Council of the Hong Kong Special Administrative Region in 2012 in accordance with the provisions of Articles 45 and68 of the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China and provisions of Article 7 of Annex I and Article III of Annex II thereto.   一、2012年香港特别行政区第四任行政长官的选举,不实行由普选产生的办法。2012年香港特别行政区第五届立法会的选举,不实行全部议员由普选产生的办法,功能团体和分区直选产生的议员各占半数的比例维持不变,立法会对法案、议案的表决程序维持不变。在此前提下,2012年香港特别行政区第四任行政长官的具体产生办法和2012年香港特别行政区第五届立法会的具体产生办法,可按照《中华人民共和国香港特别行政区基本法》第四十五条、第六十八条的规定和附件一第七条、附件二第三条的规定作出符合循序渐进原则的适当修改。

 
2. At an appropriate time prior to the selection of the Chief Executive of the Hong Kong Special Administrative Region by universal suffrage, the Chief Executive shall submit a report to the Standing Committee of the National People's Congress regarding the issue of amending the method for selecting the Chief Executive in accordance with the relevant provisions of the Hong Kong Basic Law and the Interpretation of the Standing Committee of the National People's Congress on Article 7 of annex I and Article III of Annex II to the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China; the determination thereon shall be made by the Standing committee of the National People's Congress. The bills on amending the method for selecting the Chief Executive and the amendments to such bills shall be introduced by the Government of the Hong Kong Special Administrative Region to the Legislative Council, passed with the endorsement of a two-thirds majority of all the members of the Legislative Council and consent of the Chief Executive, and reported to the Standing Committee of the National People's Congress for approval.   二、在香港特别行政区行政长官实行普选前的适当时候,行政长官须按照香港基本法的有关规定和《全国人民代表大会常务委员会关于〈中华人民共和国香港特别行政区基本法〉附件一第七条和附件二第三条的解释》,就行政长官产生办法的修改问题向全国人民代表大会常务委员会提出报告,由全国人民代表大会常务委员会确定。修改行政长官产生办法的法案及其修正案,应由香港特别行政区政府向立法会提出,经立法会全体议员三分之二多数通过,行政长官同意,报全国人民代表大会常务委员会批准。

 
3. At an appropriate time prior to the election of all the members of the Legislative Council of the Hong Kong Special Administrative Region by universal suffrage, the Chief Executive shall submit a report to the Standing Committee of the National People's congress regarding the issue of amending the method for forming the Legislative Council and the issue of whether any corresponding amendment should be made to the procedures for voting on bills and motions in the Legislative Council; the determination thereon shall be made by the Standing Committee of the National People's Congress. The bills on amending the method for forming the Legislative Council and its procedures for voting on bills and motions and the amendments to such bills shall be introduced by the Government of the Hong Kong Special Administrative Region to the Legislative Council, passed with the endorsement of a two-thirds majority of all the members of the Legislative Council and consent of the Chief Executive and reported to the Standing Committee of the National People's Congress for the record.   三、在香港特别行政区立法会全部议员实行普选前的适当时候,行政长官须按照香港基本法的有关规定和《全国人民代表大会常务委员会关于〈中华人民共和国香港特别行政区基本法〉附件一第七条和附件二第三条的解释》,就立法会产生办法的修改问题以及立法会表决程序是否相应作出修改的问题向全国人民代表大会常务委员会提出报告,由全国人民代表大会常务委员会确定。修改立法会产生办法和立法会法案、议案表决程序的法案及其修正案,应由香港特别行政区政府向立法会提出,经立法会全体议员三分之二多数通过,行政长官同意,报全国人民代表大会常务委员会备案。

 
4. If no amendment is made in accordance with the legal procedures to the method for selecting the Chief Executive or the method for forming the Legislative Council or its procedures for voting on bills and motions, the method for selecting the Chief Executive used for the preceding term shall continue to apply, and the method for forming the Legislative Council and its procedures for voting on bills and motions used for the preceding term shall continue to apply.   四、香港特别行政区行政长官的产生办法、立法会的产生办法和法案、议案表决程序如果未能依照法定程序作出修改,行政长官的产生办法继续适用上一任行政长官的产生办法,立法会的产生办法和法案、议案表决程序继续适用上一届立法会的产生办法和法案、议案表决程序。

The Session is of the view that in accordance with the provisions of Article 45 of the Hong Kong Basic Law, in selecting the Chief Executive of the Hong Kong Special Administrative Region in the method of universal suffrage, a broadly representative nominating committee shall be formed. The nominating committee may be formed with reference to the current provisions regarding the Election Committee in Annex I to the Hong Kong Basic Law. In accordance with democratic procedures, the nominating committee shall nominate several candidates for the office of Chief Executive, and the Chief Executive shall be elected by universal suffrage by all registered electors of the Hong Kong Special Administrative Region and appointed by the Central People's Government.
 
会议认为,根据香港基本法第四十五条的规定,在香港特别行政区行政长官实行普选产生的办法时,须组成一个有广泛代表性的提名委员会。提名委员会可参照香港基本法附件一有关选举委员会的现行规定组成。提名委员会须按照民主程序提名产生若干名行政长官候选人,由香港特别行政区全体合资格选民普选产生行政长官人选,报中央人民政府任命。

The Session is of the view that with the joint efforts of the Government of the Hong Kong Special Administrative Region and the people of Hong Kong, the democratic system of the Hong Kong Special Administrative Region will definitely make progress continuously, and that the aim of electing the Chief Executive and all the members of the Legislative Council by universal suffrage will be attained in accordance with the Hong Kong Basic Law and this Decision.
 
会议认为,经过香港特别行政区政府和香港市民的共同努力,香港特别行政区的民主制度一定能够不断向前发展,并按照香港基本法和本决定的规定,实现行政长官和立法会全部议员由普选产生的目标。
