For the purpose of regulating the procurement for foreign aid projects and improving the efficacy of using foreign aid funds, under the relevant laws and regulations on government procurement and bidding, the Ministry of Commerce has developed the Provisions on the Administration of Procurement for Foreign Aid Projects (for Trial Implementation), which is hereby issued and shall come into force on January 8, 2016. For relevant specific issues during the implementation process, please directly contact the Ministry of Commerce (Department of Foreign Aid). 为规范对外援助项目采购行为,提高对外援助资金使用效益,商务部依据政府采购和招标投标有关法律法规,制定了《对外援助项目采购管理规定(试行)》,现予印发,自2016年1月8日起施行。施行过程中有关具体事宜,请径与商务部(对外援助司)联系。

Provisions on the Administration of Procurement for Foreign Aid Projects (for Trial Implementation) 对外援助项目采购管理规定(试行)
Chapter I General Provisions 

第一章 总 则

Article 1 For the purpose of regulating the procurement for foreign aid projects and improving the efficacy of using foreign aid funds, the Ministry of Commerce has developed the Provisions, under the relevant laws and regulations on government procurement and bidding.   第一条 为规范对外援助项目(以下简称援外项目)采购行为,提高对外援助资金使用效益,商务部依据政府采购和招标投标有关法律法规,制定本规定。
Article 2 For the purpose of these Provisions, “procurement for foreign aid projects” refers to the act whereby the Ministry of Commerce selects the best enterprises that carry out various foreign aid projects with the aid funds of the Chinese government and accordingly purchases the projects, materials or services they provide for organizing the implementation of the various foreign aid projects.   第二条 本规定所称援外项目采购,是指商务部为组织实施各类对外援助项目,在中国政府援助资金项下择优选定各类援外项目实施企业和相应采购其所提供的工程、物资或服务的行为。
Based on the different contents of the projects, materials, or services purchased, foreign aid projects shall be divided into specific foreign aid procurement projects based on the contracts signed by and between the Ministry of Commerce and the enterprises implementing the foreign aid projects. 援外项目依据所采购工程、物资或服务的不同内容,以商务部与援外项目实施企业签订合同为单位,划分为具体的援外采购项目。
Procurement for foreign aid projects shall be organized and implemented with foreign aid procurement projects as the subject. 援外项目采购以援外采购项目为标的组织实施。
Article 3 The principles of justice, fairness, openness, competition and integrity shall be followed in the procurement for foreign aid projects.   第三条 援外项目采购坚持公正、公平、公开、竞争和诚信的原则。
Article 4 For foreign aid procurement projects with a budget above the government procurement quota, government procurement shall be implemented under these Provisions.   第四条 预算金额在政府采购限额标准以上的援外采购项目,依据本规定实行政府采购。
Budget quota of government procurement shall be implemented for the specific procurement projects under foreign aid projects according to the relevant provisions of the State Council. 援外项目项下具体采购项目实行政府采购的预算限额标准按照国务院有关规定执行。
Chapter II Organization of Procurement 

第二章 采购组织

Article 5 The Ministry of Commerce shall be responsible for organizing the procurement for foreign aid projects, perform the duties of procurement persons, and be responsible for the procurement results.   第五条 商务部负责组织援外项目采购工作,履行采购人职责,并对采购结果负责。
Where the Ministry of Commerce assigns foreign aid projects to management institutions of foreign aid projects for organization and implementation, the management institutions of foreign aid projects shall perform the duties of procurement persons on their behalf. 商务部将援外项目交由援外项目管理机构组织实施的,由援外项目管理机构代行采购人职责。
The Ministry of Commerce and management institutions of foreign aid projects specifically in charge of procurement shall be collectively referred to as procurement executives hereafter. 具体负责采购的商务部和援外项目管理机构以下统称为采购执行人。
Article 6 For foreign aid procurement projects for which government procurement is implemented under these Provisions, procurement executives shall entrust procurement agencies with the qualifications granted by competent departments of the State Council to undertake the procurement business for foreign aid projects.   第六条 对于依据本规定实施政府采购的援外采购项目,采购执行人应当委托具备国务院有关主管部门资格的采购代理机构承办援外项目采购业务。
Procurement executives shall, by government purchase of services, select the best entrusted procurement agencies every three years, and enter into three-year agreements on entrusted procurement with procurement agencies so as to specify the rights and obligations of both parties. 采购执行人应当按照政府购买服务的方式每三年择优选定受托采购代理机构,并与采购代理机构签订有效期为三年的委托采购协议,约定双方的权利和义务。
For foreign aid procurement projects for which government procurement is not implemented under these Provisions, procurement executives may conduct procurement by themselves or entrust procurement agencies to conduct procurement. 对于依据本规定不实行政府采购的援外采购项目,采购执行人可以自行采购或委托采购代理机构采购。
Article 7 Procurement for foreign aid procurement projects shall be conducted from enterprises implementing such five categories of foreign aid projects as complete foreign aid projects, foreign materials aid projects, foreign technical aid projects, foreign human resources aid projects, and foreign consultancy aid projects which have the qualifications granted by the Ministry of Commerce.   第七条 援外采购项目应在经商务部认定资格的援外成套项目、援外物资项目、对外技术援助项目、对外人力资源项目、对外援助咨询服务项目等五类援外项目实施企业范围内采购。
For some foreign technical or business aid procurement projects for which the Ministry of Commerce has not assessed their qualifications or enterprises implementing the foreign aid projects with qualifications granted by the Ministry of Commerce are unable to meet the needs of project implementation, procurement shall be conducted from the public under these Provisions. 对于商务部暂时未组织资格认定的部分技术类别或业务类别的援外采购项目,或经商务部认定资格的援外项目实施企业不能满足项目实施需要的,应依据本规定在全社会范围内采购。
The Ministry of Commerce may, according to the regional development policies of the state, select the enterprises implementing foreign aid projects. 商务部可根据国家区域发展政策选定援外项目实施企业。
Article 8 A staff member of the Ministry of Commerce, a procurement executive, and a staff member of a procurement agency, an evaluation expert for foreign aid projects, or a staff member of a bidder or negotiation entity that may have a personal interest or economic interest in the procurement, which may affect the impartial performance of his or her duties, shall take the initiative to disqualify him- or herself.   第八条 商务部、采购执行人和采购代理机构工作人员,援外项目评审专家与投标或谈判单位,存在可能影响公正履行职责的个人利害关系或经济利益关系的,应主动提出回避。
A bidding enterprise which believes that the aforesaid person has an interest in any other bid tenderer or negotiation entity may apply for disqualifying such person. 投标企业认为上述人员与其他投标或谈判单位有利害关系的,可以申请该人员回避。
Article 9 Procurement executives shall review the foreign aid procurement projects at the fixed supervision places as designated by the Ministry of Commerce. Where the designated places are unable to meet the needs of review under special circumstances, with the approval of the Ministry of Commerce, procurement executives may review the foreign aid procurement projects at other qualified fixed supervision places.   第九条 采购执行人应当在商务部指定的固定监管场所进行援外采购项目的评审工作。特殊情况下,指定场所不能满足评审需要的,经商务部批准,采购执行人可在其他符合条件的固定监管场所进行援外采购项目的评审工作。
Article 10 Procurement executives shall, according to these Provisions and other relevant provisions of the Ministry of Commerce on the administration of foreign aid, develop procurement document templates for foreign aid procurement projects, model contracts on the implementation of foreign aid projects, and rules on procurement review, as the basis for directing and supervising procurement agencies' undertaking of the procurement business.   第十条 采购执行人依据本规定和商务部有关援外管理规定制定援外采购项目的采购文件范本、援外项目实施合同范本和采购评审工作规则,作为指导和监督采购代理机构承办采购业务的依据。
Chapter III Government Procurement Budget and Plan 

第三章 政府采购预算和计划

Article 11 For foreign aid procurement projects implemented within the scope of government procurement, procurement executives shall, in combination with the expense budgets for foreign aid projects developed annually by the Ministry of Commerce for the next fiscal year, accordingly develop their respective government procurement budgets for the foreign aid procurement projects. After receiving and reviewing the budgets, the Ministry of Commerce shall submit the expense budgets for foreign aid projects and the relevant government procurement budgets to the Ministry of Finance in accordance with procedures for approval.   第十一条 对于纳入政府采购实施的援外采购项目,由采购执行人结合商务部每年组织编制下一财政年度援外项目支出预算相应编报援外采购项目的政府采购预算。商务部汇总审核后,将援外项目支出预算和相关政府采购预算一并按程序报财政部审批。
Where any government procurement budget needs to be adjusted or added during the process of implementing the expense budgets for foreign aid projects, procurement executives shall, while applying for adjustment or supplement to expense budgets for foreign aid projects, apply for adjustment or supplement to the government procurement budgets for foreign aid procurement projects, and submit them to the Ministry of Finance for approval upon review by the Ministry of Commerce. 援外项目支出预算执行过程中,需要调整或新增政府采购预算的,采购执行人应当在申请援外项目支出预算调整或新增的同时,申请调整或新增援外采购项目的政府采购预算,经商务部审核后报财政部审批。
Article 12 For foreign aid procurement projects implemented within the scope of government procurement, procurement executives shall, before the end of each year, separately develop and submit government procurement plans for foreign aid procurement projects for the next fiscal year, and report them to Ministry of Finance for recordation after the Ministry of Commerce has received and reviewed all the plans.   第十二条 对于纳入政府采购实施的援外采购项目,采购执行人应当在每年年底前单独编报下一财政年度援外采购项目的政府采购计划,经商务部汇总审核后报财政部备案。
Government procurement plans are divided by foreign aid procurement projects, mainly including project name, procurement category, amount of procurement, procurement time, procurement method, etc. 政府采购计划以援外采购项目为单位,主要包括项目名称、采购类别、采购金额、采购时间、采购方式等内容。
Where any government procurement plan needs to be adjusted or supplemented during the process of implementing the government procurement plans, procurement executives shall, within 5 working days of the adjustment to the government procurement plan, report it to Ministry of Commerce for recordation in a timely manner. The Ministry of Commerce shall, before the end of May and the end of November each year, summarize and develop the government procurement adjustment plans and submit them to the Ministry of Finance for recordation. 政府采购计划执行过程中,需要调整或增补政府采购计划的,采购执行人应在确定调整政府采购计划后五个工作日内及时报商务部备案。商务部于每年五月底前和十一月底前分两次汇总编报政府采购调整计划报财政部备案。
Chapter IV Procurement Methods 

第四章 采购方式

Article 13 For foreign aid procurement projects, the procurement method of public bidding, competitive negotiation, competitive consultation, or single-source procurement shall be employed.   第十三条 援外采购项目采用公开招标、竞争性谈判、竞争性磋商或单一来源采购的采购方式。
Article 14 Public bidding is the major procurement method for foreign aid procurement projects. Budget quota of public bidding shall be implemented for foreign aid procurement projects under relevant provisions of the State Council.   第十四条 公开招标是援外采购项目的主要采购方式。援外采购项目采用公开招标的预算限额标准按照国务院有关规定执行。
Procurement executives shall not avoid public bidding by dismembering projects or other methods. 采购执行人不得以拆分项目等方式规避公开招标。
Article 15 Under any of the following circumstances, procurement by way of competitive negotiation or competitive consultation may be adopted for a foreign aid procurement project:   第十五条 援外采购项目符合下列情形之一的,可采用竞争性谈判或竞争性磋商方式采购:
(1) A project whose time required for public bidding is unable to meet the needs of implementation; (一)采用公开招标所需时间不能满足实施需要的项目;
(2) Consultation service tasks for a foreign human resources aid project, a foreign technical aid project, and a foreign aid project for which the competing technical requirements or the implementation plans are unable to be determined uniformly in advance due to the professional features. (二)因专业特点不能提前统一确定竞争性技术要求或实施方案的援外人力资源项目、对外技术援助项目和援外项目咨询服务任务;
(3) A project that only has 2 valid bid tenderers performing the procurement variation procedures upon public bidding. (三)经公开招标,有效投标单位只有两家且履行采购方式变更程序的项目。
A project falling under the provisions of item (1) and (2) of paragraph 1 herein shall have no less than 3 entities participating in competitive negotiation or competitive consultation; and a project falling under the circumstance as prescribed in item (3) of paragraph 1 herein shall have 2 entities participating in competitive negotiation or competitive consultation. 符合第一款第(一)项和第(二)项规定的,参与竞争性谈判或竞争性磋商的单位不得少于三家;符合第一款第(三)项情形规定的,参与竞争性谈判或竞争性磋商的单位可为两家。
Article 16 A foreign aid procurement project falling under any of the following circumstances may adopt the method of single-source procurement:   第十六条 援外采购项目符合下列情形之一的,可以采用单一来源采购方式:
(1) An irreplaceable patent or proprietary technology has been used and only one entity may undertake the project. (一)使用了不可替代的专利或专有技术,只有一家单位可以承担的项目;
(2) A project that is the continuity to an original project. The original enterprise implementing the project is required to continuously undertake the project, to ensure the consistency with the original procurement project or meet the requirements of the supporting services; otherwise, the implementation effect of the project or the requirements of the supporting functions may be affected. (二)属于原项目的延续性内容等情形,必须保证原有采购项目一致性或服务配套的要求,需要由原项目实施企业继续承担,否则将影响项目实施效果或功能配套要求的;
(3) A foreign aid procurement project has a budget under the government procurement budget quota. (三)政府采购预算限额标准以下的援外采购项目。
Where there is only one valid bid tenderer in the public bidding of a project, the method of single-source procurement may be adopted after changing the procurement procedures. 项目公开招标有效投标单位只有一家的,履行采购方式变更程序后可以采用单一来源采购方式。
Article 17 Where, for a foreign aid government procurement project above the limit set for public bidding, public bidding is not employed under these Provisions, the procurement executive shall specify the reasons for the procurement method planned to be used and the changes in the procurement method in the annual government procurement plan submitted and shall be submitted to the Ministry of Finance for approval the Ministry of Commerce has received and reviewed all of them.   第十七条 政府采购公开招标数额标准以上的援外采购项目依据本规定不采用公开招标方式的,采购执行人应在报送年度政府采购计划时具体列明拟申请采用的采购方式和变更采购方式的理由,经商务部汇总审核后报财政部审批。
During the process of implementing the government procurement plan, the procurement executive that changes the procurement method specified in the government procurement plan as required by these Provisions or adopts any other procurement method than public bidding for newly added foreign aid procurement projects shall, within 5 working days of determining and adjusting the procurement method, report to the Ministry of Commerce in a timely manner. The Ministry of Commerce shall specify the procurement method after change and the reasons for changing the procurement method, while summarizing and developing a government procurement adjustment plan before the end of May and the end of November, respectively, and report them to Ministry of Finance for approval. 政府采购计划执行过程中,采购执行人依据本规定需要变更政府采购计划列明的采购方式或对新增援外采购项目采用公开招标以外的其他采购方式的,采购执行人应在确定调整采购方式后五个工作日内及时报商务部。商务部每年五月底前和十一月底前分两次汇总编报政府采购调整计划时具体列明变更后的采购方式和变更采购方式的理由,报财政部审批。
Procurement executives shall be responsible for the compliance of the temporary change in the procurement method. 采购执行人应当对临时变更采购方式的合规性负责。
Article 18 Where the method of single-source procurement needs to be employed for a foreign aid government procurement project above the limit set for public bidding as required by these Provisions, the procurement executive shall publicize the information about the method of single-source procurement for 3 working days, or for 1 working day under an emergency circumstance. The information to be published mainly includes the name and profile of the foreign aid procurement project, the reasons for adopting single-source procurement and relevant explanation, and the name and address of the proposed entity for single-source procurement, among others.   第十八条 政府采购公开招标数额标准以上的援外采购项目依据本规定需要采用单一来源采购方式的,采购执行人应就采用单一来源采购方式的情况公示三个工作日,特殊紧急情况公示一个工作日。公示信息主要包括援外采购项目名称和概况、采用单一来源采购的原因及相关说明、拟定的单一来源采购单位名称和地址等。
Other enterprises implementing the foreign aid projects have any objection against the method of single-source procurement may, within the period of publicity, submit written opinions to the procurement executives. Upon receipt of an objection, a procurement executive shall, within 3 working days after the expiration of the publicity period, make supplementary review in a timely manner, and shall adopt a different procurement method if it believes that the objection is justified after review. 其他援外项目实施企业对采用单一来源采购方式有异议的,可在公示期内向采购执行人提交书面意见。采购执行人收到公示异议后,应当在公示期满后三个工作日内及时进行补充论证,论证后认为异议成立的,应采用其他采购方式。
Article 19 A procurement executive shall, after completing the internal preparation for foreign aid procurement projects and determining the procurement methods under the Provisions, send procurement notices of foreign aid procurement projects to procurement agencies.   第十九条 采购执行人在完成援外采购项目的内部准备并依据本规定确定采购方式后,向采购代理机构发送援外采购项目采购通知。
A procurement notice of a foreign aid procurement project shall at least include the following contents: 援外采购项目采购通知至少包括以下基本内容:
(1) the profile of the foreign aid procurement project; (一)援外采购项目概况;
(2) the procurement needs; (二)采购需求;
(3) the amount of the procurement budget; (三)采购预算金额;
(4) the procurement methods and qualification examination methods; (四)采购方式和资格审查方式;
(5) the procurement time limit; (五)采购时限;
(6) the review method; and (六)评审办法;
(7) other special requirements. (七)其他特殊要求。
Where the single-source procurement method is adopted, the name and contact information of the entity of single-source procurement shall be specified in the notice. 采用单一来源采购方式的,通知应列明单一来源采购单位的名称和联系方式。
Where any item in a procurement notice needs to be adjusted or supplemented during the procurement process, the procurement executive shall send a supplementary procurement notice on the foreign aid project to the procurement agency. 采购过程中需对采购通知事项作出调整或补充的,采购执行人应及时向采购代理机构发送援外项目补充采购通知。
Procurement executives shall be responsible for the integrity, compliance, and accuracy of the contents provided in the procurement notice. 采购执行人应当对采购通知规定内容的完整性、合规性和准确性负责。
Article 20 Where a foreign aid procurement project accepts consortium bid tenders, the procurement notice shall specify it, and provide the methods of forming a consortium and the qualification examination conditions to be satisfied for its membership qualification.   第二十条 援外采购项目接受以联合体参与投标的,应在采购通知中予以明确,并对联合体组成方式及其成员资格应当符合的资格审查条件作出规定。
Parties to a consortium shall sign a joint bidding agreement, designate the leading entity of the consortium, specifically reach an agreement on the work to be undertaken and the responsibilities to be assumed by all parties, and submit the joint bidding agreement to the procurement agency. After signing a joint bidding agreement, all parties to a consortium shall not separately bid for a same foreign aid procurement project in its own name or form a new consortium to bid for a same foreign aid procurement project. 联合体各方之间应签订共同投标协议,指定联合体牵头单位,明确约定联合体各方承担的工作和相应的责任,并将共同投标协议提交采购代理机构。联合体各方签订共同投标协议后,不得再以自己名义单独在同一援外采购项目中投标,也不得组成新的联合体参加同一援外采购项目投标。
Article 21 A procurement executive shall, according to the agreement on the initiation of a foreign aid project, the proposal on initiation approved by the Ministry of Commerce, and the requirements on the administration of subsequent implementation, study and determine the procurement needs of the foreign aid procurement project. The procurement needs shall accurately reflect and fully disclose the various achievements of the preliminary technical preparations, and comply with relevant laws and regulations, and foreign aid policies of the state.   第二十一条 采购执行人应依据援外项目立项协议、商务部批准的立项建议书和后续实施管理要求研究确定援外采购项目的采购需求。采购需求应准确反映和充分披露前期技术准备的各项成果,符合国家相关法律法规和援外政策。
Except for the qualification examination conditions provided for specific foreign aid procurement projects under these Provisions, the procurement executive shall not have differential treatment or discriminatory treatment for foreign aid projects implementing enterprises that participate in the procurement, in any other unreasonable manner. 除依据本规定设定具体援外采购项目的资格审查条件外,采购执行人不得以其他不合理方式对参与采购的援外项目实施企业实行差别待遇或歧视待遇。
Chapter V Procedures for Public Bidding 

第五章 公开招标程序

Article 22 For foreign aid procurement projects that requires public bidding, procurement executives shall, according to the features of foreign aid procurement projects, specifically determine the qualification examination methods.   第二十二条 对于公开招标的援外采购项目,采购执行人应当根据援外采购项目的特点具体确定资格审查方式。
Under any of the following conditions, pre-qualification may be adopted for public bidding of a foreign aid procurement project: 符合下列规定条件的,援外采购项目公开招标可以采用资格预审:
(1) significant complete set of foreign aid projects with an investment of 200 million yuan or more, with complex technical requirements, and particular political and diplomatic significance; (一)投资规模在两亿元人民币以上、技术要求复杂且具有特殊政治外交意义的重大援外成套项目;
(2) various foreign aid projects for which the Chinese party or the aid recipient has specific qualification restrictions for the implementers; (二)中方或受援方相关法律法规对实施主体有明确资质限定的各类援外项目;
(3) various foreign aid projects for which inter-government project initiation agreements or relevant agreements provide special qualification requirements for the implementers. (三)政府间立项协议或相关协议对实施主体有特殊资质要求的各类援外项目。
Article 23 Where the deferred eligibility review method is adopted, a procurement agency shall, according to the requirements of the procurement notice of the foreign aid procurement project, develop a bidding announcement, determine the conditions for qualification examination, and announce them after reporting them to the procurement executive for approval.   第二十三条 采用资格后审方式的,采购代理机构应当根据援外采购项目采购通知要求拟定招标公告,确定资格审查条件,报采购执行人批准后公布。
Article 24 Where the pre-qualification method is adopted, a procurement agency shall, according to the requirements of the procurement notice of the foreign aid procurement project, develop a pre-qualification announcement, determine the conditions for qualification examination, and announce them after reporting them to the procurement executive for approval. A pre-qualification announcement period is generally 5 working days.   第二十四条 采用资格预审方式的,采购代理机构应当根据援外采购项目采购通知要求拟定资格预审公告,确定资格审查条件,报采购执行人批准后公布。资格预审公告期一般为五个工作日。
For significant complete set of foreign aid projects for which pre-qualification is adopted, in the pre-qualification conditions, the requirements for a bidder's financial and technical competence, performance of foreign aid and overseas projects, comprehensive integrity performance, and fulfillment of social responsibilities shall be effectively enhanced. 其中,对于采用资格预审的重大援外成套项目,资格预审条件应当根据项目实际情况切实提高对投标企业资金技术能力、援外和境外项目业绩、综合诚信表现和履行社会责任的要求。
Article 25 Under the circumstance of deferred eligibility review, a candidate entity intending to bid may, as required by the bidding announcement, contact the procurement agency by itself, obtain the bidding documents, and submit the deferred eligibility review application materials together with the bidding documents; and under the circumstance of pre-qualification, a candidate entity intending to bid shall, within the period prescribed in the pre-qualification announcement, submit the pre-qualification application materials.   第二十五条 在资格后审情况下,有投标意向的候选单位可按招标公告要求自行与采购代理机构联系,领取招标文件,并连同投标文件一并提交资格后审申请材料;在资格预审情况下,有投标意向的候选单位应当在资格预审公告规定期限内提交资格预审申请材料。
Article 26 Under the circumstance of deferred eligibility review, a procurement agency shall, at the bidding review stage, review the qualification conformity and the association relationship for the deferred eligibility review application materials submitted by the candidate entity; and under the circumstance of pre-qualification, a procurement agency shall, according to the provisions of the pre-qualification announcement, separately review the qualification conformity and the association relationship for the pre-qualification application materials submitted by the candidate entity.   第二十六条 在资格后审情况下,采购代理机构在投标评审阶段一并对候选单位提交的资格后审申请材料进行资格符合性审查和关联关系审查;在资格预审情况下,采购代理机构按资格预审公告规定单独对候选单位提交的资格预审申请材料进行资格符合性审查和关联关系审查。
Under any of the following circumstances, a candidate entity shall be deemed to have association relationship: 候选单位存在下列情况之一的,视为存在关联关系:
(1) The ratio of the direct investment made by an entity in another entity exceeds 5%. (一)一家单位对另外一家单位的直接出资比例超过百分之五;
(2) Multiple entities share a common investor, and the ratio of investment made by the investor each entity exceeds 10%. (二)几家单位有一共同出资人,且该出资人对各家单位的出资比例均超过百分之十。
For a candidate entity that passes the review of qualification conformity, but has association relationship concerns, the entities passing the qualification examination may be determined by random selection. 对于通过资格符合性审查但存在关联关系的候选单位,可通过随机抽取方式确定通过资格审查的单位。
Article 27 Where deferred eligibility review is adopted for the qualification examination in the public bidding of a foreign aid procurement project, a procurement agency shall accept no less than 3 bids, without upper limit.   第二十七条 援外采购项目公开招标采用资格后审方式进行资格审查的,采购代理机构接受投标数量应为三家(含)以上,不设上限。
Where pre-qualification is adopted for the qualification examination in the public bidding of a foreign aid procurement project, a procurement agency shall accept 3 to 9 bids which are randomly selected from the candidate entities passing the qualification examination, and issue invitations for bid thereto. 援外采购项目公开招标采用资格预审方式进行资格审查的,采购代理机构接受投标数量应为三家(含)以上,九家(含)以下,从资格审查合格的候选单位中随机抽取产生,并向其发出投标邀请书。
Article 28 Where there are less than three candidate entities participating in the pre-qualification of foreign aid procurement projects or passing the qualification examination, the procurement agency shall report it to the procurement executive in a timely manner, and the procurement executive shall deal with it under the following principles:   第二十八条 参与援外采购项目资格预审或通过资格审查的候选单位不足三家的,采购代理机构应当及时报告采购执行人,由采购执行人按照以下原则处理:
(1) Where the conditions for pre-qualification are set reasonably and the time and procedures for the pre-qualification announcement comply with the provisions, the procurement agency may be notified of re-organizing procurement after the procurement method is changed as required. (一)资格预审条件设定合理,且资格预审公告时间及程序符合规定的,可按规定变更采购方式后,通知采购代理机构重新组织采购;
(2) Where the conditions for pre-qualification are set unreasonably and the time and procedures for the pre-qualification announcement comply with the provisions, the procurement agency shall be notified of re-organizing procurement after the procurement method is changed as required. (二)资格预审条件设定不合理,或资格预审公告时间及程序不符合规定的,应当通知采购代理机构重新组织资格预审。
Article 29 A procurement agency shall, according to various provisions of the procurement notice of a foreign aid procurement project, the model procurement document, the model contract on the implementation of a foreign aid project, and the working rules for procurement review, develop bidding documents on the foreign aid procurement project and submit them to the procurement executive for approval. The specific bid evaluation method for foreign aid procurement projects shall be developed by procurement executives, shall be prescribed in the procurement notice for foreign aid procurement projects, and shall be announced in the bidding documents of procurement agencies for foreign aid procurement projects.   第二十九条 采购代理机构根据援外采购项目采购通知以及采购文件范本、援外项目实施合同范本和采购评审工作规则的各项规定,编制援外采购项目招标文件并报采购执行人批准。其中,援外采购项目的具体评标办法由采购执行人制订并在援外采购项目采购通知中明确规定,由采购代理机构在援外采购项目招标文件中予以公布。
A bidding document for a foreign aid procurement project shall prescribe and indicate the substantive requirements and conditions, and shall at least include the following contents: 援外采购项目招标文件应当规定并标明实质性要求和条件,至少包括下列内容:
(1) an invitation to bid; (一)投标邀请;
(2) the instructions to bidders (including requirements for seal, signing, and stamping, etc.); (二)投标须知(包括密封、签署、盖章要求等);
(3) the requirements for the development of bidding documents; (三)投标文件编制要求;
(4) the technical requirements for a foreign aid procurement project, including the annexes, drawings, and other relevant technical materials; (四)援外采购项目的技术要求,包括附件、图纸等相关技术资料;
(5) the format of bank guarantees for deposits and performance bonds; (五)投标保证金和履约保证金银行保函格式;
(6) the model contract; (六)合同范本;
(7) the bid evaluation method; and (七)评标办法;
(8) the deadline, opening time and place for bidding. (八)投标截止时间、开标时间及地点。
Under the circumstance of deferred eligibility review, the bidding documents shall also provide the requirements for the development of deferred eligibility review application materials. 在资格后审情况下,招标文件还应当规定资格后审申请材料的编制要求。
Article 30 A procurement agency may, as needed, consult relevant experts during the process of developing the bidding documents for a foreign aid procurement project. Such experts shall no longer participate in bid evaluation as bid evaluation experts for any foreign aid procurement project.   第三十条 采购代理机构可根据需要,在编制援外采购项目招标文件过程中征询有关专家意见,该专家不得再作为援外采购项目评标专家参加评标。
Article 31 A candidate entity that intends to tender for a bid, meets the conditions for qualification examination, or passes the pre-qualification, may obtain bidding documents for the foreign aid procurement project for free from the procurement agency upon the strength of the bidding announcement or an invitation for bid.   第三十一条 有投标意向且符合资格审查条件或通过资格预审的候选单位凭招标公告或投标邀请书与采购代理机构联系免费领取援外采购项目招标文件。
A candidate entity that receives the bidding documents becomes a formal bidder for a foreign aid procurement project. 领取招标文件的候选单位正式成为援外采购项目的投标单位。
Article 32 The period from the date of issuing the bidding documents for a foreign aid procurement project to the deadline for a bidder to submit bidding documents for the foreign aid procurement project shall generally not be less than 20 days.   第三十二条 援外采购项目招标文件发出之日起至投标单位提交援外采购项目投标文件截止之日止,一般不少于二十日。
Article 33 A bidder for a foreign aid procurement project that requires on-site inspection at the place of the aid recipient before bidding shall, within a reasonable period before bid opening, file a formal application to the procurement executive through the procurement agency.   第三十三条 援外采购项目的投标单位标前要求赴受援方当地进行现场考察的,应当在开标前合理期限内提前经采购代理机构向采购执行人提出正式申请。
Where the procurement executive agrees to the bidder's conducting an on-site inspection, it shall, through the economic and commercial office of the Chinese embassy or consulate to the country of the project location, make uniform arrangements and coordination in advance, and provide the bidder with necessary convenience and assistance. If necessary, the procurement executive may send representatives to attend the on-site inspection of bidders and offer guidance. 采购执行人同意投标单位进行现场考察的,应当通过驻在国使领国经商机构提前作出统一安排和协调,并给予投标单位以必要的便利和协助。必要时,采购执行人可派员参加投标单位的现场考察并予指导。
The bidder shall conduct on-site inspection according to the route and schedule confirmed by the economic and commercial office of the Chinese embassy or consulate to the country of the project location, consciously accept the direction and supervision of the economic and commercial office of the Chinese embassy or consulate, and assume all the costs. Without the approval of the economic and commercial office of the Chinese embassy or consulate to the country of the project location, no one shall have negotiations or contact with the aid recipient about the bid. 投标单位应当按驻在国使领馆经商机构确认的行程和日程进行现场考察,自觉接受驻在国使领馆经商机构的指导和监督,并自行承担全部费用。未经驻在国使领馆经商机构批准,不得擅自与受援方进行涉及投标内容的商谈或接触。
Where a bidder has serious violation in the on-site inspection before bidding, the procurement executive shall be entitled to reject its bid. 投标单位在标前现场考察中存在严重违规行为的,采购执行人有权拒绝其投标。
Article 34 A bidder for a foreign aid procurement project that has doubt about the bidding documents may send a written request the procurement agency for explanation before the deadline of questions.   第三十四条 援外采购项目的投标单位对招标文件有疑问的,可在答疑截止时间之前以书面形式向采购代理机构提出答疑要求。
A procurement agency shall reply to all the questions in the bidder's written request one by one, and the procurement executive shall be cooperative. If necessary, the procurement agency may also organize all bidders to hold a meeting to answer their questions prior to bid opening, and the procurement executive shall send personnel to attend the meeting.
