| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 The present Measures are formulated in accordance with the Customs Law of the People's Republic of China (hereinafter referred to as the Customs Law) and other relevant laws and regulations for the purpose of strengthening administration on transportation enterprises undertaking the transportation of goods under customs supervision within the territory of China and the vehicles and drivers thereof. | | 第一条 为加强对承运海关监管货物的境内运输企业及其车辆、驾驶员的管理，根据《中华人民共和国海关法》（下称《海关法》）及其他相关法规，制定本办法。 |
| Article 2 The transportation enterprises, vehicles and drivers within the territory as mentioned in the present Measures shall refer to the enterprises, vehicles and drivers undertaking the transportation of goods under customs supervision within the territory after being registered by or put on the archives of the customs according to the present Measures. | | 第二条 本办法所指的境内运输企业、车辆、驾驶员，是指依据本办法经海关注册登记或者备案登记，在境内从事海关监管货物运输的企业、车辆、驾驶员。 |
| Article 3 A transportation enterprise or vehicle shall apply for going through registration formalities to the customs house directly under the General Administration of Customs at the locality of its own customs area, and a driver shall go through the formalities of archival filing and registration. | | 第三条 运输企业、车辆应当向企业所在关区的直属海关申请办理注册登记手续，驾驶员应当办理备案登记手续。 |
| Article 4 In case any customs house adopts online computer administration to the registration materials of transportation enterprises, vehicles archival filing registration materials of any driver, the data thereof shall be shared by other people, and no more formalities for archival filing at different places may are required. | | 第四条 海关对运输企业、车辆的注册登记资料以及驾驶员的备案登记资料实行计算机联网管理，数据资料共享的，不再办理异地备案手续。 |
| Chapter II Registration and Recording | | 第二章 注册登记 |
| Article 5 A transportation enterprise undertaking goods under customs supervision shall have the following qualification conditions: | | 第五条 承运海关监管货物的运输企业，应当具备以下资格条件： |
| 1. Engaging in the business of transportation of merchandises for one year or more; | | （一）从事货物运输业务1年以上； |
2. According to the provisions of Articles 67 and 68 | | （二）按照《海关法》第六十七、六十八条规定，有具有履行海关事务担保能力的法人、其他组织或者公民提供的担保； |
| 3. The financial system and the administration of account books of the enterprise complying with the relevant state provisions; and | | （三）企业财务制度和账册管理符合国家有关规定； |
| 4. Having good credit standing, and having no record or illegal operations in undertaking the transportation business. | | （四）企业资信良好，在从事运输业务中没有违法前科。 |
| Article 6 A transportation enterprise shall submit the following documents to the customs house when going through registration and recording: | | 第六条 运输企业办理注册登记时，应当向海关提交下列文件： |
| 1. An Application Form for Registration and Recording of Transportation Enterprises Undertaking the Transportation of Goods under Customs Supervision within the Territory of China (See Annex I); | | （一）《承运海关监管货物境内运输企业注册登记申请表》（见附件1）； |
| 2. A photocopy of the Business License issued by the administrative department for industry and commerce; | | （二）工商行政管理部门核发的《营业执照》复印件； |
| 3. A photocopy of the License for Operation of Road Transportation issued by the competent department of traffic and transportation; | | （三）交通运输管理部门核发的《道路运输经营许可证》复印件； |
| 4. A photocopy of the Organization Code Certificate of the People's Republic of China (hereinafter referred to as the Organization Code Certificate) issued by the technical supervision department. | | （四）技术监督部门核发的《中华人民共和国组织机构代码证》（下称《组织机构代码证》）复印件； |
| 5. Name lists and archival filing materials of drivers undertaking the transportation of goods under customs supervision. In case an enterprise changes its drivers, it shall go through the formalities for altering the archival filing of the drivers at the customs house in time. | | （五）承运海关监管货物车辆的驾驶员名单及备案登记资料；企业更换驾驶员的，应当及时向海关办理驾驶员的变更备案手续。 |
| When submitting the documents as described in items (2), (3) and (4), the originals shall also be presented for the checking against the reproductions by the customs house. | | 提交本条（二）、（三）、（四）项文件时，还应同时出示原件供海关审核。 |
| Article 7 A customs house shall examine the qualification conditions of a transportation enterprise and the relevant certificates submitted by it; if it is found to be qualified, it shall be issued a Certificate of Registration and Recording on Road Transportation Enterprises for Carrying Goods under Customs Supervision within the Territory of China (See Annex IV, hereinafter referred to as the Certificate of Registration and Recording). | | 第七条 海关对运输企业的资格条件及递交的有关证件进行审核，合格的，颁发《境内公路运输企业载运海关监管货物注册登记证书》（见附件4，以下简称《注册登记证书》）。 |
| Article 8 Vehicles undertaking the transportation of goods under customs supervision shall be vans or container tractors, or bulk truck upon the approval of the customs house. The aforesaid vehicles shall meet the following conditions: | | 第八条 承运海关监管货物的车辆应为厢式货车或集装箱拖头车，经海关批准也可以为散装货车。上述车辆应当具备以下条件： |
| 1. The vehicle undertaking the transportation of goods under customs supervision shall be the vehicle owned by the transportation enterprise itself, and the name of the owner of the Motor Vehicle Driving License shall be identical with the name of the transportation enterprise it subordinates; | | （一）用于承运海关监管货物的车辆，必须为运输企业的自有车辆，其《机动车辆行驶证》的车主列名必须与所属运输企业名称一致。 |
| 2. The body of a van truck shall be fixed up with the vehicle frame and become an organic whole, the body of the van truck shall be of metal structure, and have no hidden cases or separation, and shall have the conditions for sealing up. | | （二）厢式货车的厢体必须与车架固定一体，厢体必须为金属结构，无暗格，无隔断，具有施封条件，车厢连接的镙丝均须焊死，车厢两车门之间须以钢板相卡，保证施封后无法开启。 |
| When necessary, the side door needs to be open. It shall be under the approval by the Customs and it shall comply with the control requirements of the Customs. | | 有特殊需要，需加开侧门的，须经海关批准，并符合海关监管要求。 |
| 3. The container tractor shall undertake the transportation of containers complying with international standards; | | （三）集装箱拖头车必须承运符合国际标准的集装箱。 |
| 4. A bulk truck may only undertake the transportation of large amount of goods in bulk that do not have the condition of sealing up, for example, ore, grain and super machinery, etc; and | | （四）散装货车只能承运不具备加封条件的大宗散装货物，如矿砂、粮食及超大型机械设备等。 |
| 5. The certificate of approval of the competent department in-charge shall be submitted for a vehicle that undertakes the transportation of special goods. | | （五）从事特种货物运输的车辆须递交主管部门的批准证件。 |
| Article 9 The following documents shall be submitted to the customs house when going through the procedures for the registration and recording of vehicles: | | 第九条 办理车辆注册登记时，应当向海关提交下列文件： |
| 1. An Application Form for Registration and Recording of Vehicles Undertaking the Transportation of Goods under Customs Supervision within the Territory of China (See Annex II); | | （一）《承运海关监管货物境内运输车辆注册登记申请表》（见附件2）； |
| 2. An photocopy of the Vehicle Driving License issued by the public security organ in charge of traffic control; | | （二）公安交通管理部门核发的《机动车行驶证》复印件； |
| 3. An photocopy of the Navicert for Flammable and Explosive Chemicals issued by the department of public security fire control shall be submitted for vehicles that carry dangerous goods; and | | （三）运载危险品的车辆需提交公安消防部门核发的《易燃易爆化学物品准运证》复印件； |
| 4. Two color photos of the vehicles concerned (Note: left profile 45° in the front，4×3 inch; being able to show clearly the number of vehicle license plate; the name of the enterprise shall be sprayed to the head of the vehicle and the side of the van body). | | （四）车辆彩色照片2张（要求：前方左侧面45°，4×3寸；能清楚显示车牌号码；车头及车厢侧面喷写企业名称）。 |
| When submitting the documents as listed in item (2) and (3) of this Article, the originals shall also be produced at the same time for the examination of the customs house. | | 提交本条（二）、（三）项文件时，还应同时出示原件供海关审核。 |
Article 10 The customs house shall examine the conditions for supervision over vehicles and the relevant documents; if they are up to the standard, it shall issue a Navicert of the Customs of the People's Republic of China for Vehicles Carrying Goods under Customs Supervision within the Territory of China (See Annex VI, hereinafter referred to as the Navicert), a Register of the Customs of the People's Republic of China for Vehicles Carrying Goods under Customs Supervision within the Territory of China (See Annex VII, hereinafter referred to as the Register for Carrying Cargo by Vehicles).
