Notice of the General Office of the Ministry of Human Resources and Social Security and the General Office of the All-China Federation of Industry and Commerce on Launching the Demonstrative Work on Labor Dispute Prevention and Mediation in Non-public Enterprises and Chambers of Commerce (Associations)
The departments (bureaus) of human resources and social security and associations of industry and commerce of all provinces, autonomous regions, municipalities directly under the Central Government and Xinjiang Production and Construction Corps:
In order to implement the Opinions on Strengthening the Prevention and Mediation of Labor Disputes of Non-public Enterprises (No. 2 [2013] of the Ministry of Human Resources and Social Security), encourage non-public enterprises and chambers of commerce (associations) to generally establish prevention and mediation mechanisms for labor disputes, enhance their capabilities for preventing and solving labor disputes, and promote the harmonious labor relationship and social stability, the Ministry of Human Resources and Social Security and the All-China Federation of Industry and Commerce have decided to launch the demonstrative work on prevention and mediation of labor disputes (hereinafter referred to as the “demonstrative work”) in 40 large and medium-sized non-public enterprises and 34 chambers of commerce (associations). The relevant issues are hereby announced as follows:

I. Main Content of Demonstrative Work 各省、自治区、直辖市及新疆生产建设兵团人力资源社会保障厅(局),工商业联合会:
1. Establishing and developing labor dispute mediation organizations.The headquarters and branches of the demonstrative enterprises shall establish labor dispute mediation committees, and gradually form the internal labor dispute prevention mechanism of level-to-level accountability and cooperation between upper and lower levels of the enterprises. The demonstrative chambers of commerce (associations) shall establish labor dispute mediation organizations, with the president, executive vice president or secretary-general of the chambers of commerce (associations) being the major person in charge and the secretary-general being responsible for the routine work. The demonstrative enterprises and chambers of commerce (associations) shall provide necessary office facilities, premises and other work conditions to support mediation organizations in their launching of work in accordance with laws. Mediation organizations may invite lawyers, experts and scholars to participate in mediation activities. 为贯彻落实《关于加强非公有制企业劳动争议预防调解工作的意见》(人社部发〔2013〕2号),推动非公有制企业、商会(协会)普遍建立劳动争议预防调解机制,提升预防解决劳动争议的能力,促进劳动关系和谐与社会稳定,人力资源社会保障部、全国工商联确定在40家大中型非公有制企业、34家商会(协会)开展劳动争议预防调解示范工作(以下简称“示范工作”)。现将有关事项通知如下:
2. Establishing an effective labor dispute prevention mechanism.The demonstrative enterprises shall earnestly implement the guideline of “combining mediation and prevention with prevention as the priority”, practice the labor contract system and collective contract system in accordance with laws, standardize employment management, create a healthy and harmonious enterprise culture, strengthen humanistic concern and psychological counseling, and prevent and reduce labor disputes from the source. The demonstrative enterprises shall rely on the labor dispute mediation committee, smooth the communication channels between the management of enterprises and the employees by holding labor and management talks and meetings and other means, and establish internal labor dispute negotiation and solving mechanism of the enterprises. The demonstrative enterprises shall form a collective labor disputes warning system, effectively eliminate hidden troubles for labor disputes by means of predicting, prevention and other measures, and solve disputes at the very beginning. The demonstrative chambers of commerce (associations) shall establish industrial labor dispute prevention mechanisms, guide private enterprises and small and micro enterprises in particular in establishment of flexible and effective labor dispute prevention mechanisms by providing consultation service, organizing experience exchange and strengthening publicity and education, and voluntarily intervene in when necessary, actively mediate labor disputes of enterprises, and prevent intensification of labor dispute contradictions of enterprises. 
3. Establishing and developing mediation work systems.The labor dispute mediation organizations of demonstrative enterprises and chambers of commerce (associations) shall establish and develop the registration, urging of enforcement of mediations and other systems, and develop the appointment, training and performance evaluation of mediators and other management systems. They shall voluntarily strengthen communication and coordination with the local administrative departments of human resources and social security and the industry and commerce federation organizations, and establish a joint conference system, a major collective labor dispute report system and other systems.   一、示范工作的主要内容
4. Strengthening the connection between mediation and arbitration.All local arbitration institutes shall strengthen the guidance to demonstrative enterprises and chambers of commerce (associations), actively carry out entrusted mediation and other work, and establish a convenient and effective mechanism for review and confirmation of mediation agreements and arbitral awards. All local arbitration institutes shall establish a labor dispute mediation proposal system and a case feedback system, and notify demonstrative enterprise and chambers of commerce (associations) of the labor dispute cases involved and the treatment thereof on a regular basis. 
5. Forming a team of full-time and part-time mediators with high quality.The labor dispute mediation committee of demonstrative enterprises shall, in consideration of the actual circumstances in work, designate a number of full-time and part-time mediators, and support the mediators in carrying out mediation activities. Where a mediator must utilize production or working time to perform the mediation duties according to law, the performance of the mediation duties shall be treated as normal attendance, and the labor contract term and the employment term of the mediator shall be matched. The labor dispute mediation organizations of demonstrative chambers of commerce (associations) shall have representatives jointly recommended by enterprises and employees of the industries as mediators, and actively engage entrepreneurs and experienced professionals of chambers of commerce (associations) in the mediation. Incentive and restraint mechanisms in labor disputes prevention and mediation by mediators shall be established to stabilize and develop the team of mediators. (一)建立健全劳动争议调解组织。示范企业总部和分支机构要建立劳动争议调解委员会,逐步形成劳动争议分级负责、上下联动的企业内部劳动争议预防调解工作机制。示范商会(协会)要建立劳动争议调解组织,主要负责人由商会(协会)会长、常务副会长或秘书长担任,秘书长负责日常工作。示范企业和商会(协会)应当提供必要的办公设施、场所等工作条件,支持调解组织依法开展工作。调解组织可以邀请律师、专家学者参加调解活动。
II. Progress Arrangement of Demonstrative Work 
1. Start Period (July 2013 – September 2013).All localities shall, by taking into consideration local conditions and in joint efforts with demonstrative enterprises and chambers of commerce (associations), develop implementation programs for demonstrative work which include objectives of work, progress arrangement, guarantee measures and other contents, and submit the implementation programs to the Mediation and Arbitration Administration Department of the Ministry of Human Resources and Social Security and the Legal Department of the All-China Federation of Industry and Commerce before the end of September for recordation. All localities may concurrently carry out the demonstrative work on labor dispute prevention and mediation in non-public enterprises and chambers of commerce (associations) according to actual circumstances. (二)建立有效的劳动争议预防工作机制。示范企业要认真落实“调防结合,以防为主”的方针,依法实行劳动合同和集体合同制度,规范劳动用工管理,营造健康和谐的企业文化,加强人文关怀和心理疏导,从源头上预防和减少劳动关系矛盾;要依托劳动争议调解委员会,采取召开劳资恳谈会或劳资协商会等方式,畅通企业经营管理者与职工之间的沟通交流渠道,建立企业内部劳动争议协商解决机制;要建立集体劳动争议预警制度,通过预测、预报和预防等措施,有效排查劳动争议隐患,及时将纠纷化解在萌芽状态。示范商会(协会)要建立行业性劳动争议预防工作机制,通过提供咨询服务、组织经验交流、加强宣传教育,指导民营企业特别是小型微型企业建立灵活有效的劳动争议预防机制,必要时应主动介入、积极协调企业的劳动争议,防范企业劳动关系矛盾激化。
2. Implementation Period (October 2013 – December 2014).All localities shall strengthen the business trainings including laws and regulations on labor security, mediation methods and skills and so on for the labor disputes prevention and mediation staff, and enhance the professional level of the team of mediators. All localities shall strengthen the urging and examination of the implementation of establishment of labor dispute mediation organizations, establishment of labor dispute negotiation and solving mechanisms, the work guarantee measures, among others. All localities shall conduct in-depth research to actively explore laws in labor disputes prevention and mediation in non-public enterprises, and summarize fresh experience in the demonstrative work and expand the demonstrative effect. 
3. Summarization, Check and Acceptance Period (January 2015 – June 2015).The Ministry of Human Resources and Social Security and the All-China Federation of Industry and Commerce shall formulate quantitative standards for evaluation and check for acceptance, organize all localities to carry out summarization and check for acceptance of the demonstrative work, and publicize the demonstrative enterprises and chambers of commerce (associations) with work properly done. (三)建立健全调解工作制度。示范企业和商会(协会)劳动争议调解组织要建立健全调解登记、督促履行等制度,完善调解员选聘、培训、工作考评等管理制度。要主动与所在地人力资源社会保障行政部门、工商联组织加强沟通协调,建立联席会议和重大集体劳动争议报告等制度。
III. Organization and Leadership of Demonstrative Work
Conducting demonstrative work on labor disputes prevention and mediation in some enterprises and chambers of commerce (associations) is a key task in labor disputes prevention and mediation at present and for a period in the future. All local administrative departments of human resources and the industry and commerce federation organizations shall attach high importance to the work and cooperate fully in specifying the objectives and major tasks in each stage of the demonstrative work and the entities and individuals of responsibility. They shall pay close attention to the progress of the demonstrative work, diligently study and solve new problems encountered, and report any important issue in a timely manner to the Mediation and Arbitration Administration Department of the Ministry of Human Resources and Social Security and the Legal Department of the All-China Federation of Industry and Commerce.

 (四)加强调解与仲裁工作衔接。各地调解仲裁机构要加大对示范企业和商会(协会)的指导力度,积极开展委托调解等工作,建立便捷的调解协议仲裁审查确认机制。要建立劳动争议调解建议书制度和案例反馈制度,定期向示范企业和商会(协会)通报涉及的劳动争议案件及处理情况。
 (五)建立具有较高素质的专兼职调解员队伍。示范企业劳动争议调解委员会应结合工作实际,配备一定数量的专兼职调解员,支持调解员从事调解活动,对调解员依法履行调解职责需要占用生产或者工作时间的,按照正常出勤对待,将调解员的劳动合同期限与聘期对应起来。示范商会(协会)劳动争议调解组织要由本行业企业与职工共同推举代表担任调解员,积极吸收企业家和商会(协会)资深人士参加调解工作。要建立调解员开展劳动争议预防调解工作的激励和约束机制,稳定和发展调解员队伍。
