Article 1 To strengthen legal supervision over the commutation for, parole of and temporary service of sentences outside prisons by offenders in duty-related crimes, and enhance leadership of the people's procuratorates at higher levels in the execution of modified sentences by the people's procuratorates at lower levels, these Provisions are hereby formulated in accordance with the Criminal Law of the People's Republic of China, the Criminal Procedure Law of the People's Republic of China | | 第一条 为了强化对职务犯罪罪犯减刑、假释、暂予监外执行的法律监督，加强上级人民检察院对下级人民检察院办理刑罚变更执行案件工作的领导，根据《中华人民共和国刑法》、《中华人民共和国刑事诉讼法》和《中华人民共和国监狱法》等有关规定，结合检察工作实际，制定本规定。 |
| Article 2 A people's procuratorate shall handle the recordation and review of cases involving the commutation for, parole of or temporary service of sentences outside prisons by offenders in duty-related crimes separately in accordance with the following circumstances: | | 第二条 人民检察院对职务犯罪罪犯减刑、假释、暂予监外执行案件实行备案审查，按照下列情形分别处理： |
| (1) In cases involving the commutation for, parole of or temporary service of sentences outside prisons by offenders previously holding positions at department, bureau or a higher level in duty-related crimes, the people's procuratorate shall, within 10 days upon receipt of the commutation or parole rulings or the decisions on temporary service of a sentence outside prison, submit each case level by level to the Supreme People's Procuratorate for recordation and review. | | (一)对原厅局级以上职务犯罪罪犯减刑、假释、暂予监外执行的案件，人民检察院应当在收到减刑、假释裁定书或者暂予监外执行决定书后十日以内，逐案层报最高人民检察院备案审查； |
| (2) In cases involving the commutation for, parole of or temporary service of sentences outside prisons by offenders previously holding positions at the county or division level in duty-related crimes, the people's procuratorate shall, within 10 days upon receipt of the commutation or parole rulings or the decisions on temporary service of a sentence outside prison, submit each case level by level to a people's procuratorate at the provincial level for recordation and review. | | (二)对原县处级职务犯罪罪犯减刑、假释、暂予监外执行的案件，人民检察院应当在收到减刑、假释裁定书或者暂予监外执行决定书后十日以内，逐案层报省级人民检察院备案审查。 |
Article 3 When a people's procuratorate submits a commutation or parole case for recordation and review, it shall complete the registration form for recordation and review, and attach copies of the following materials:
