| Chapter I: General Provisions | | 第一章 总 则 |
| Article 1 These Regulations are formulated with a view to strengthening the supervision and control over ships by the State, and safeguarding the legitimate rights and interests of the parties involved in the registration of ships. | | |
| Article 2 The following ships shall be registered in accordance with the provisions of these Regulations: | | 第一条 为了加强国家对船舶的监督管理，保障船舶登记有关各方的合法权益，制定本条例。 |
| (1) Ships owned by citizens of the People's Republic of China whose residences or principal places of business are located within the territory thereof; | | |
| (2) Ships owned by enterprises with legal person status established under the laws of the People's Republic of China and whose principal places of business are located within the territory thereof, provided that, where foreign investment is involved, the proportion of registered capital contributed by Chinese investors shall not be less than 50 per cent; | | 第二条 下列船舶应当依照本条例规定进行登记： |
| (3) Service ships of the government of the People's Republic of China and ships owned by institutions with legal person status; and | | （一）在中华人民共和国境内有住所或者主要营业所的中国公民的船舶。 |
| (4) Other ships whose registration is considered necessary by the competent authority of harbour superintendency of the People's Republic of China. | | （二）依据中华人民共和国法律设立的主要营业所在中华人民共和国境内的企业法人的船舶。但是，在该法人的注册资本中有外商出资的，中方投资人的出资额不得低于50%。 |
| The registration of military ships, fishery ships and sports craft shall be handled in compliance with the provisions of the relevant laws and regulations. | | （三）中华人民共和国政府公务船舶和事业法人的船舶。 |
| Article 3 Ships are allowed to sail under the national flag of the People's Republic of China only after being registered according to law and granted the nationality of the People's Republic of China. No ship may sail under the national flag of the People's Republic of China without being registered. | | （四）中华人民共和国港务监督机构认为应当登记的其他船舶。 |
| Article 4 A ship shall not have dual nationality. A ship registered abroad whose former registration of nationality has not been suspended or deleted shall not be granted the Chinese nationality. | | 军事船舶、渔业船舶和体育运动船艇的登记依照有关法规的规定办理。 |
| Article 5 The acquisition, transfer or extinction of the ownership of a ship shall be registered at the ship registration authority; no acquisition, transfer or extinction of the ship's ownership shall act against a third party unless registered. | | |
| Where a ship is jointly owned by two or more legal persons or individuals, the joint ownership thereof shall be registered at the ship registration authority. The joint ownership of the ship shall not act against a third party unless registered. | | 第三条 船舶经依法登记，取得中华人民共和国国籍，方可悬挂中华人民共和国国旗航行；未经登记的，不得悬挂中华人民共和国国旗航行。 |
| Article 6 The establishment, transference or extinction of ship mortgage or bareboat chartering shall be registered at the ship registration authority. No ship mortgage or bareboat chartering shall act against a third party unless registered. | | |
| Article 7 Seafarers on board ships of Chinese nationality who are required to possess certificates of competency shall hold the appropriate certificates of competency issued by the People's Republic of China. | | 第四条 船舶不得具有双重国籍。凡在外国登记的船舶，未中止或者注销原登记国国籍的，不得取得中华人民共和国国籍。 |
| Article 8 The harbour superintendency of the People's Republic of China shall be the competent authority in charge of registration of ships. | | |
| The competent authorities of harbour superintendency at various ports are the organs conducting the registration of ships (hereinafter referred to as the ship registration authority). The scope of authority thereof shall be defined by the competent authorities of harbour superintendency of the People's Republic of China. | | 第五条 船舶所有权的取得、转让和消灭，应当向船舶登记机关登记；未经登记的，不得对抗第三人。 |
| Article 9 The port where a ship is registered shall be the port of registry of the ship. | | 船舶由二个以上的法人或者个人共有的，应当向船舶登记机关登记；未经登记的，不得对抗第三人。 |
| The owner of a ship may choose a port closer to his residence or his principal place of business as the port of registry, but not allowed to choose two or more ports as the port of registry. | | |
| Article 10 Each ship shall have only one name. | | 第六条 船舶抵押权、光船租赁权的设定、转移和消灭，应当向船舶登记机关登记；未经登记的，不得对抗第三人。 |
| The name of a ship shall be checked and approved by the ship registration authority at the port of registry. A ship's name shall not be the same as any of those that have already been registered, neither in wording nor in pronunciation. | | |
| Article 11 The ship registration authority shall establish a register of ships. | | 第七条 中国籍船舶上应持适任证书的船员，必须持有相应的中华人民共和国船员适任证书。 |
| The register of ships shall be accessible to those having an interest therein. | | |
| Article 12 Where an enterprise owned by the whole people and having a legal person status is authorized by the State to operate and manage to a State-owned ship, the provisions of these Regulations concerning the shipowner shall be applicable to that legal person. | | 第八条 中华人民共和国港务监督机构是船舶登记主管机关。 |
| Chapter II: Registration of Ownership of Ships | | 各港的港务监督机构是具体实施船舶登记的机关（以下简称船舶登记机关），其管辖范围由中华人民共和国港务监督机构确定。 |
| Article 13 A shipowner applying for registration of the ownership of a ship shall produce to the ship registration authority at the port of registry the documents adequately evidencing his legitimate identification, and submit the originals and copies of the documents evidencing the procurement of his ownership over the ship and the technical information thereof. | | |
| For the registration of ownership of a ship purchased, the following documents shall be submitted: | | 第九条 船舶登记港为船籍港。 |
| (1) Seller's invoice or sales contract and delivery document; | | 船舶登记港由船舶所有人依据其住所或者主要营业所所在地就近选择，但是不得选择2个或者2个以上的船舶登记港。 |
| (2) Document issued by the ship registration authority at the original port of registry certifying the deletion of the original ownership registration; and | | |
| (3) Document evidencing that the ship is not under mortgage or that the mortgagees agree to the transfer of the mortgaged ship. | | 第十条 一艘船舶只准使用一个名称。 |
| For the registration of ownership of a newly-built ship, the contract of ship construction and the delivery document shall be submitted. For the registration of ownership of a ship under construction, the contract of ship construction shall be submitted. For the registration of ownership of a ship built by oneself for one's own use, a document evidencing the procurement of ownership shall be submitted. | | 船名由船籍港船舶登记机关核定。船名不得与登记在先的船舶重名或者同音。 |
| For the registration of ownership of a ship procured through heritage, donation, auction under legal process, or court judgement, a document with appropriate legal effect evidencing the ship's ownership shall be submitted. | | |
| Article 14 The ship registration authority, having examined and verified the application for registration of ownership, shall issue to the shipowner whose application meets the requirements of these Regulations the certificate of registration of ship's ownership within 7 days after the date of receipt of the application, whereupon an official registration number shall be granted to the registered ship and the following particulars shall be recorded in the register of ships: | | 第十一条 船舶登记机关应当建立船舶登记簿。 |
| (1) Ship's name and its call sign; | | 船舶登记机关应当允许利害关系人查阅船舶登记簿。 |
| (2) Port of registry, official registration number and identification mark of the ship; | | |
| (3) Name and address of the shipowner and name of his legal representative; | | 第十二条 国家所有的船舶由国家授予具有法人资格的全民所有制企业经营管理的，本条例有关船舶所有人的规定适用于该法人。 |
| (4) Way in which the ship's ownership was procured and the date of procurement; | | 第二章 船舶所有权登记 |
| (5) Date on which the ship's ownership was registered; | | |
| (6) Name of ship builder, and time and place of building; | | 第十三条 船舶所有人申请船舶所有权登记，应当向船籍港船舶登记机关交验足以证明其合法身份的文件，并提供有关船舶技术资料和船舶所有权取得的证明文件的正本、副本。 |
| (7) Value of the ship, material of ship's hull and ship's main technical information; | | 就购买取得的船舶申请船舶所有权登记的，应当提供下列文件： |
| (8) Original name and port of registry of the ship and the date of deletion or suspension of its original registration; | | （一）购船发票或者船舶的买卖合同和交接文件； |
| (9) Information about joint ownership if the ship is owned by two or more owners; | | （二）原船籍港船舶登记机关出具的船舶所有权登记注销证明书； |
| (10) Name and address of bareboat charterer or ship operator, and name of his legal representative, in case the shipowner is not the one who operates or actually controls the ship; and | | （三）未进行抵押的证明文件或者抵押权人同意被抵押船舶转让他人的文件。 |
| (11) Information about the establishment of mortgage, if any. | | 就新造船舶申请船舶所有权登记的，应当提供船舶建造合同和交接文件。但是，就建造中的船舶申请船舶所有权登记的，仅需提供船舶建造合同；就自造自用船舶申请船舶所有权登记的，应当提供足以证明其所有权取得的文件。 |
| The ship registration authority shall inform the shipowner in writing of any non-compliance of his application with these Regulations within 7 days after the date of receipt of the application. | | 就因继承、赠与、依法拍卖以及法院判决取得的船舶申请船舶所有权登记的，应当提供具有相应法律效力的船舶所有权取得的证明文件。 |
| Chapter III: Nationality of Ships | | |
| Article 15 A shipowner applying for the nationality of a ship shall, in addition to the certificate of registration of ship's ownership, submit the following documents according to the ship's navigation zone: | | 第十四条 船籍港船舶登记机关应当对船舶所有权登记申请进行审查核实；对符合本条例规定的，应当自收到申请之日起7日内向船舶所有人颁发船舶所有权登记证书，授予船舶登记号码，并在船舶登记簿中载明下列事项： |
| (1) For ships engaged in international voyages, the valid technical documents of the ship issued by an statutory organization for survey of ships in accordance with the type of the ship: | | （一）船舶名称、船舶呼号； |
| (a) International tonnage measurement certificate; | | （二）船籍港和登记号码、登记标志； |
| (b) International loadline certificate; | | （三）船舶所有人的名称、地址及其法定代表人的姓名； |
| (c) Cargo ship safety construction certificate; | | （四）船舶所有权的取得方式和取得日期； |
| (d) Cargo ship safety equipment certificate; | | （五）船舶所有权登记日期； |
| (e) Passenger quota certificate; | | （六）船舶建造商名称、建造日期和建造地点； |
| (f) Passenger ship safety certificate; | | （七）船舶价值、船体材料和船舶主要技术数据； |
| (g) Cargo ship safety radiotelegraphy certificate; | | （八）船舶的曾用名、原船籍港以及原船舶登记的注销或者中止的日期； |
| (h) International oil pollution prevention certificate; | | （九）船舶为数人共有的，还应当载明船舶共有人的共有情况； |
| (i) Ship safety navigation certificate; | | （十）船舶所有人不实际使用和控制船舶的，还应当载明光船承租人或者船舶经营人的名称、地址及其法定代表人的姓名； |
| (j) Other relevant technical certificates. | | （十一）船舶已设定抵押权的，还应当载明船舶抵押权的设定情况。 |
| (2) For a ship engaged in domestic voyages, the ship survey book issued by an statutory organization for survey of ships and other valid technical certificates according to the type of the ship. | | 船舶登记机关对不符合本条例规定的，应当自收到申请之日起7日内书面通知船舶所有人。 |
| A shipowner applying for the Chinese nationality of a ship of foreign nationality purchased abroad, shall submit a certificate issued by the original ship registration authority at the former port of registry to the effect that the former nationality has been deleted or that the former nationality will be deleted upon such time as the new registration is effected. | | 第三章 船舶国籍 |
| The ship registration administration authority at the port of registry shall, upon approval, issue a certificate of ship's nationality to the ship whose application has been examined to be in compliance with these Regulations. | | |
| Article 16 Subject to its approval, the ship registration authority shall issue the certificate of ship's nationality to a ship registered under Article 13 of these Regulations. The validity period of the certificate of ship's nationality shall be 5 years. | | 第十五条 船舶所有人申请船舶国籍，除应当交验依照本条例取得的船舶所有权登记证书外，还应当按照船舶航区相应交验下列文件： |
| Article 17 For a ship newly built which is to be sold overseas, the shipowner shall apply to the ship registration authority at the place of construction for a provisional certificate of ship's nationality by submitting the document evidencing the procurement of ownership of the ship, and the valid technical certificate thereof. | | （一）航行国际航线的船舶，船舶所有人应当根据船舶的种类交验法定的船舶检验机构签发的下列有效船舶技术证书： |
| For a newly-built ship purchased from overseas, the shipowner shall apply to the local embassy or consulate of the People's Republic of China for a provisional certificate of ship's nationality by submitting the document evidencing the procurement of ownership of the ship and its valid technical certificates. | | 1.国际吨位丈量证书； |
| For a ship built in a place within this country other than its intended port of registry, the shipowner who needs a provisional certificate of ship's nationality, shall apply to the ship registration authority at the place of ship building for the certificate by submitting the contract of ship construction, the delivery document and its valid technical certificates. | | 2.国际船舶载重线证书； |
| For a ship built overseas, the shipowner shall apply to the local embassy or consulate of the People's Republic of China for a provisional certificate of ship's nationality by submitting the contract of ship construction, the delivery document and the valid technical certificates of the ship. | | 3.货船构造安全证书； |
| For a ship bareboat chartered overseas, the bareboat charterer shall apply to the ship registration authority for a provisional certificate of ship's nationality by submitting the bareboat charter party and the certificate issued by the ship registration authority at the former port of registry to the effect that the former nationality of the ship has been suspended or deleted, or that the former nationality of the ship will be suspended or deleted upon such time as the new registration is effected. | | 4.货船设备安全证书； |
| The ship registration authority or the local embassy or consulate of the People's Republic of China, having examined and verified that the application is in compliance with these Regulations, shall issue a provisional certificate of ship's nationality to the ship. | | 5.乘客定额证书； |
| Article 18 The validity period of a provisional certificate of ship's nationality shall generally not exceed 1 year. | | 6.客船安全证书； |
| For a ship which is bareboat chartered overseas, the validity period of the provisional certificate of ship's nationality may be determined according to the charter period, provided not exceed 2 years to the longest. Where the charter period exceed 2 years, the charterer shall, within the period of validity, apply to the ship registration authority at ship's port of registry for the renewal of its provisional certificate of ship's nationality. | | 7.货船无线电报安全证书； |
| Article 19 The provisional certificate of ship's nationality shall have the same legal effect as the certificate of ship's nationality. | | 8.国际防止油污证书； |
| Chapter IV: Registration of Ship Mortgage | | 9.船舶航行安全证书； |
| Article 20 Where mortgage is established with respect to a ship of 20 tons gross tonnage or over, the mortgagee and the mortgagor shall apply to the ship registration authority at the ship's port of registry for the registration of ship mortgage by submitting the following documents: | | 10.其他有关技术证书。 |
| (1) Written application signed by the mortgagee and the mortgagor; | | （二）国内航行的船舶，船舶所有人应当根据船舶的种类交验法定的船舶检验机构签发的船舶检验证书簿和其他有效船舶技术证书。 |
| (2) Certificate of ship's ownership or contract of ship construction; | | 从境外购买具有外国国籍的船舶，船舶所有人在申请船舶国籍时，还应当提供原船籍港船舶登记机关出具的注销原国籍的证明书或者将于重新登记时立即注销原国籍的证明书。 |
| (3) Contract of ship mortgage. | | 对经审查符合本条例规定的船舶，船籍港船舶登记机关予以核准并发给船舶国籍证书。 |
| Where there are other mortgages established on the ship, the relevant certificates shall be submitted. | | |
| Where mortgage is established on a jointly-owned ship, the joint owners shall, in addition, submit a document evidencing the agreement by the joint owners holding more than two-thirds or contracted proportion of shares thereof. | | 第十六条 依照本条例第十三条规定申请登记的船舶，经核准后，船舶登记机关发给船舶国籍证书。船舶国籍证书的有效期为5年。 |
| Article 21 After the application has been examined and verified to be in compliance with these Regulations, the ship registration authority shall, within 7 days after the date of receipt of the application, record matters regarding the mortgagee, the mortgagor and the ship mortgage as well as the date of mortgage registration in the register of ships and the certificate of ship's ownership, and issue the certificate of registration of ship mortgage to the mortgagee. | | |
| Article 22 The registration of ship mortgage shall specify the following items: | | 第十七条 向境外出售新造的船舶，船舶所有人应当持船舶所有权取得的证明文件和有效船舶技术证书，到建造地船舶登记机关申请办理临时船舶国籍证书。 |
| (1) Name and address of the mortgagee and name and address of the mortgagor; | | 从境外购买新造的船舶，船舶所有人应当持船舶所有权取得的证明文件和有效船舶技术证书，到中华人民共和国驻外大使馆、领事馆申请办理临时船舶国籍证书。 |
| (2) Name and nationality of the mortgaged ship, the number of the certificate of registration of ship's ownership and the title of the authority that issued the certificate; and | | 境内异地建造船舶，需要办理临时船舶国籍证书的，船舶所有人应当持船舶建造合同和交接文件以及有效船舶技术证书，到建造地船舶登记机关申请办理临时船舶国籍证书。 |
| (3) Amount of debt secured, interest rate and payoff period. | | 在境外建造船舶，船舶所有人应当持船舶建造合同和交接文件以及有效船舶技术证书，到中华人民共和国驻外大使馆、领事馆申请办理临时船舶国籍证书。 |
| The ship registration authority should make the information about the registration of ship mortgage available to the public. | | 以光船条件从境外租进船舶，光船承租人应当持光船租赁合同和原船籍港船舶登记机关出具的中止或者注销原国籍的证明书，或者将于重新登记时立即中止或者注销原国籍的证明书到船舶登记机关申请办理临时船舶国籍证书。 |
| Article 23 In case of mortgage transfer, the mortgagee and the transferee shall apply to the ship registration authority at the ship's port of registry for registration of the mortgage transfer by submitting the contract of ship mortgage transfer. | | 对经审查符合本条例规定的船舶，船舶登记机关或者中华人民共和国驻外大使馆、领事馆予以核准并发给临时船舶国籍证书。 |
| The application has been examined and verified to be in compliance with the requirements of these Regulations, the ship registration authority shall record the transferee as the mortgagee in the register of ships and in the certificate of registration of ship's ownership, issue to the transferee a certificate of registration of ship's mortgage, and seal up the former certificate of registration of ship's mortgage. | | |
The mortgagee shall notify the mortgagor of the mortgage transfer prior to its registration thereof.
