The Measures for the Administration of Medical Advertisements, which have been amended by the State Administration for Industry and Commerce and the Ministry of Health of the People's Republic of China, are hereby promulgated and shall come into force as of January 1, 2007.
 
医疗广告管理办法》已经中华人民共和国国家工商行政管理总局和中华人民共和国卫生部决定修改,现予公布,自2007年1月1日起施行。

Measures for the Administration of Medical Advertisements
 
医疗广告管理办法

 
Article 1 For the purpose of strengthening the administration of medical advertisements and safeguarding the people's health, these Measures are formulated according to the Advertisement Law, the Regulation on the Administration of Medical Institutions, the Regulation on Traditional Chinese Medicines, and other laws and regulations.   第一条 为加强医疗广告管理,保障人民身体健康,根据《广告法》、《医疗机构管理条例》、《中医药条例》等法律法规的规定,制定本办法。

 
Article 2 The term “medical advertisements” mentioned in these Measures refers to those advertisements that directly or indirectly introduce medical institutions or medical services by making use of various media or in various means.   第二条 本办法所称医疗广告,是指利用各种媒介或者形式直接或间接介绍医疗机构或医疗服务的广告。

 
Article 3 Before releasing medical advertisements, a medical institution shall apply for the examination of medical advertisements, and shall not release any medical advertisements until it has obtained an Examination Certificate for Medical Advertisements.   第三条 医疗机构发布医疗广告,应当在发布前申请医疗广告审查。未取得《医疗广告审查证明》,不得发布医疗广告。

 
Article 4 The administrative department for industry and commerce shall be responsible for supervising and administrating medical advertisements.   第四条 工商行政管理机关负责医疗广告的监督管理。

The health administrative department and the administrative department for traditional Chinese medicine shall be responsible for examining medical advertisements, and for supervising and administrating medical institutions.
 
卫生行政部门、中医药管理部门负责医疗广告的审查,并对医疗机构进行监督管理。

 
Article 5 No non-medical institution may release medical advertisements, and a medical institution shall not release medical advertisements in the name of its inside department or office.   第五条 非医疗机构不得发布医疗广告,医疗机构不得以内部科室名义发布医疗广告。

 
Article 6 The contents of medical advertisements are only limited to the following items:   第六条 医疗广告内容仅限于以下项目:

 
(1) the first name of the medical institution; (一)医疗机构第一名称;

 
(2) the address of the medical institution; (二)医疗机构地址;

 
(3) the form of ownership; (三)所有制形式;

 
(4) the type of the medical institution; (四)医疗机构类别;

 
(5) clinical subjects; (五)诊疗科目;

 
(6) the number of beds; (六)床位数;

 
(7) the time for admissions; and (七)接诊时间;

 
(8) contact phone numbers. (八)联系电话。

The contents of Items (1) up to (6) shall be identical with those outlined in the Practice License for Medical Institutions issued upon verification by the health administrative department or the administrative department for traditional Chinese medicine or in its duplicate.
 
(一)至(六)项发布的内容必须与卫生行政部门、中医药管理部门核发的《医疗机构执业许可证》或其副本载明的内容一致。

 
Article 7 The forms of medical advertisements shall not be under any of the following circumstances:   第七条 医疗广告的表现形式不得含有以下情形:

 
(1) involving medical technologies, diagnostic methods, names of diseases or drugs; (一)涉及医疗技术、诊疗方法、疾病名称、药物的;

 
(2) guaranteeing a cure or guaranteeing a cure in a concealed form; (二)保证治愈或者隐含保证治愈的;

 
(3) propagandizing cure rate, efficiency or other clinical results; (三)宣传治愈率、有效率等诊疗效果的;

 
(4) containing pornographic, superstitious and absurd contents; (四)淫秽、迷信、荒诞的;

 
(5) belittling others; (五)贬低他人的;

 
(6) taking the names or images of the diseased, health technical personnel, medical education and scientific research institutions and their personnel or any other social group or organization as examples;

 (六)利用患者、卫生技术人员、医学教育科研机构及人员以及其他社会社团、组织的名义、形象作证明的;
