(Issued on April 7, 2016; and amended in accordance with the Decision of the China Meteorological Administration on Amending Four Departmental Rules Including the Measures for the Administration of Meteorological Information Services (Order No. 35; CMA) on March 24, 2020) (2016年4月7日公布 根据2020年3月24日中国气象局令第35号《中国气象局关于修改<气象信息服务管理办法>等四部部门规章的决定》修正)

Article 1 For the purposes of regulating the administrative licensing for the prevention of new construction, expansion, or reconstruction projects from causing harm to the meteorological observation environment, protecting the lawful rights and interests of citizens, legal persons and other organizations, and guaranteeing and supervising the effective implementation of administration by the competent meteorological departments, these Measures are developed in accordance with the Meteorology Law of the People's Republic of China, the Administrative License Law of the People's Republic of China, and the Regulation on the Protection of Meteorological Facilities and Meteorological Observation Environment and other relevant laws and regulations.   第一条 为规范新建、扩建、改建建设工程避免危害气象探测环境行政许可行为,保护公民、法人和其他组织的合法权益,保障和监督气象主管机构有效实施行政管理,根据《中华人民共和国气象法》、《中华人民共和国行政许可法》、《气象设施和气象探测环境保护条例》等有关法律法规,制定本办法。
Article 2 These Measures shall be applicable to the administrative licensing for the prevention of new construction, expansion, or reconstruction projects from causing harm to the meteorological observation environment within the scope of protection of meteorological observation environment in atmospheric background stations, national reference climate stations, national basic meteorological stations, national general weather stations, high-altitude meteorological stations, weather radar stations, and meteorological satellite ground stations.   第二条 在大气本底站、国家基准气候站、国家基本气象站、国家一般气象站、高空气象观测站、天气雷达站、气象卫星地面站气象探测环境保护范围内实施新建、扩建、改建建设工程避免危害气象探测环境的行政许可,适用本办法。
Article 3 The scope of protection of meteorological observation environment and the types of construction projects in meteorological offices and stations as prescribed in these Measures shall be subject to the relevant laws, regulations, and national standards concerning the protection of meteorological observation environment and construction projects in meteorological offices and stations.   第三条 本办法规定的气象台站气象探测环境保护范围和建设工程类别应当按照相应的气象台站气象探测环境保护和建设工程的有关法律法规和国家标准执行。
The meteorological departments of provinces, autonomous regions, and municipalities directly under the Central Government shall release to the public the locations and the scope of protection of observation environment of various meteorological offices and stations within their respective administrative regions. 省、自治区、直辖市气象主管机构应将本行政区域内各类气象台站的位置及其探测环境保护范围向社会公布。
Article 4 The meteorological department of the State Council shall be responsible for the supervision and administration of the administrative licensing for the prevention of new construction, expansion, or reconstruction projects nationwide from causing harm to the meteorological observation environment.   第四条 国务院气象主管机构负责全国新建、扩建、改建建设工程避免危害气象探测环境行政许可的监督管理。
The meteorological departments of provinces, autonomous regions, and municipalities directly under the Central Government shall be responsible for the implementation and administration of the administrative licensing for the prevention of new construction, expansion, or reconstruction projects from causing harm to the meteorological observation environment within their respective administrative regions. The meteorological departments of districted cities or counties (cities) directly under the provincial governments shall be responsible for the preliminary examination and administration of the administrative licensing for the prevention of new construction, expansion, or reconstruction projects from causing harm to meteorological observation environment within their respective administrative regions. 省、自治区、直辖市气象主管机构负责本行政区域内新建、扩建、改建建设工程避免危害气象探测环境行政许可的实施和管理工作。 设区的市气象主管机构或者省直管县(市)气象主管机构负责本行政区域内新建、扩建、改建建设工程避免危害气象探测环境行政许可的初审和管理工作。
Article 5 An applicant for such a construction project shall submit the following materials and be responsible for the authenticity of the application materials:   第五条 申请人提交以下材料,并对申请材料的真实性负责:
1. an application form for the administrative licensing for the prevention of new construction, expansion, or reconstruction projects from causing harm to the meteorological observation environment; (一)新建、扩建、改建建设工程避免危害气象探测环境行政许可申请表;
2. identity information of the applicant; (二)申请人身份信息;
3. a sketch map showing the relative position of the new construction, expansion, or reconstruction project to meteorological observation facilities or observation site; and (三)新建、扩建、改建建设工程与气象探测设施或观测场的相对位置示意图;
4. an agency agreement which should be submitted if an agent is entrusted. (四)委托代理的,应出具委托协议。
If an applicant is a legal person or other organization, the general information and a general layout plan of the new construction, expansion, or reconstruction project shall also be submitted.
