| Chapter I General Provisions | | 第一章 总则 |
| |
|
| Article 1 The present Measures are formulated according to the relevant laws and regulations of the state for the purpose of regulating the order of alcohol circulation, promoting the orderly development of the alcohol market, safeguard the interests of the state and protect the legitimate rights and interests of alcohol producers, operators and consumers. | | 第一条 为规范酒类流通秩序，促进酒类市场有序发展，维护国家利益，保护酒类生产者、经营者和消费者的合法权益，根据国家有关法律、法规，制定本办法。 |

| Article 2 The term “alcohol” as mentioned in the present Measures refers to the alcoholic drink with more than 0.5 % (cubic fraction) of alcoholic degree (ethanol content), including fermented alcohol, distilled alcohol, compound alcohol, edible alcohol and any other drink with alcoholic component, except the medicinal liquor or any alcohol in the category of health food whose production has been approved by the relevant administrative department of the state. | | 第二条 本办法所称酒类是指酒精度（乙醇含量）大于0.5％（体积分数）的含酒精饮料，包括发酵酒、蒸馏酒、配制酒、食用酒精以及其他含有酒精成分的饮品。经国家有关行政管理部门依法批准生产的药酒、保健食品酒类除外。 |
The term “alcohol circulation” as mentioned in the present Measures includes such business operations as the wholesale, retail and storage and transport of alcohol. | |
本办法所称酒类流通包括酒类批发、零售、储运等经营活动。 |

| Article 3 Any entity or individual that engages in any activity of alcohol circulation within the territory of the People's Republic of China shall observe the present Measures. | | 第三条 在中华人民共和国境内从事酒类流通活动，应当遵守本办法。 |
| |
|
| Article 4 A system of archival filing of operators as well as a traceability system shall be established for alcohol circulation. | | 第四条 酒类流通实行经营者备案登记制度和溯源制度。 |
| |
|
| Article 5 The Ministry of Commerce shall take charge of the supervision and administration of alcohol circulation throughout the country. | | 第五条 商务部负责全国酒类流通监督管理工作。 |
The administrative departments of commerce at or above the county level shall take charge of the supervision and administration of alcohol circulation within their administrative divisions. | |
县级以上商务主管部门负责本行政区域内酒类流通监督管理工作。 |

| Chapter II Archival Filing and Registration | | 第二章 备案登记 |
| |
|
| Article 6 An entity or individual that engages in the wholesale or retail of alcohol (herein after referred to in general as “alcohol operator”) shall, within 60 days as of collecting a business license, handle the archival filing and registration in the administrative department of commerce at the same level as the administrative department for industry and commerce where the registration is handled according to the principle of territorial administration. | | 第六条 从事酒类批发、零售的单位或个人（以下统称酒类经营者）应当在取得营业执照后60日内，按属地管理原则，向登记注册地工商行政管理部门的同级商务主管部门办理备案登记。 |

| Article 7 The procedures for archival filing and registration of alcohol operators are as follows: | | 第七条 酒类经营者备案登记程序如下： |

|
| (1) Collecting the Archival Filing and Registration Form of Alcohol Circulation (hereinafter referred to as the Registration Form). The Registration Form may be downloaded from the official website of the Ministry of Commerce (http://www.mofcom.gov.cn) or be collected from the local administrative department of commerce. | | （一）领取《酒类流通备案登记表》（以下简称《登记表》）。《登记表》可以通过商务部政府网站（http：//www.mofcom.gov.cn）下载，或到所在地商务主管部门领取。 |
| |
|
| (2) Filling in the Registration Form. An alcohol operator shall fill in the Registration Form in a complete, accurate and authentic manner and shall, in the meanwhile, earnestly read the terms as attached to the Registration Form, which shall be signed and affixed with a seal by the legal representative or business owner. | | （二）填写《登记表》。酒类经营者应完整、准确、真实地填写《登记表》；同时认真阅读《登记表》所附条款，并由法定代表人或业主签字、盖章。 |

| (3) Submitting the following materials for archival filing and registration to the administrative department of commerce: | | （三）向商务主管部门提交下述备案登记材料： |
| |
|
| a) A Registration Form in duplicate as filled in according to item (2) of Article 7 of the present Measures; | | 1、按本办法第七条第（二）项要求填写的《登记表》一式两份； |
| |
|
| b) A photocopy of the business license that is signed or affixed with a seal by the legal representative or business owner as well as a photocopy of the Sanitation License; and | | 2、由法定代表人或业主签字、盖章的营业执照复印件和卫生许可证复印件； |
| |
|
| c) Any other material as recognized by the Ministry of Commerce that is publicly required by the administrative department of commerce at the provincial level. | | 3、经商务部认可并由省级商务主管部门公示要求提交的其它材料。 |
| |
|
| Article 8 The administrative department of commerce shall, within 5 workdays as of receiving the aforesaid materials as submitted by an alcohol operator, handle the formalities for archival filing and registration and affix its seal to the Registration Form. | | 第八条 商务主管部门应自收到酒类经营者提交的上述材料之日起5个工作日内办理备案登记手续，在《登记表》上加盖印章。 |

| Article 9 The administrative department of commerce shall record and keep the archived and registered information as well as registration materials of alcohol operators in a complete and accurate manner, establish records on archival filing and registration, report them to the administrative department at a higher level on a periodic basis and may publicize them to the general public. | | 第九条 商务主管部门应当完整准确地记录和保存酒类经营者的备案登记信息和登记材料，建立备案登记档案，定期向上级主管部门报送，并可向社会公布。 |

| Article 10 Where any registered item in the Registration Form alters, the relevant alcohol operator shall, within 30 days as of alteration (in the case of any item regarding the industrial and commercial registration, it shall be within 30 days as of the alteration of industrial and commercial registration), handle the formalities for alteration in the administrative department of commerce. | | 第十条 登记表上的任何登记事项发生变更时，酒类经营者应当自变更之日起30日内（属于工商登记事项的自工商登记变更之日起30日内）向商务主管部门办理变更手续。 |
The administrative department of commerce shall, after receiving the written materials as submitted by an alcohol operator, handle the formalities for alteration within 5 workdays. | |
商务主管部门收到酒类经营者提交的书面材料后，应当在5个工作日内办理变更手续。 |
A Registration Form shall, as of the day when an alcohol operator handles the formalities for writing off its registration in the administrative department for industry and commerce or as of the day when the business license of an alcohol operator is revoked, be automatically invalidated. The administrative department of commerce shall verify any write-off or revocation in collaboration with the administrative department for industry and commerce at the same level on a periodic basis. | |
《登记表》自酒类经营者在工商行政管理部门注销登记或被吊销营业执照之日起自动失效。商务主管部门应定期与同级工商行政管理部门核实注销或吊销情况。 |

| Article 11 The administrative department of commerce shall, when handling the registration for archival filing or for any alteration of archival filing and registration, only collect the cost of production of relevant materials as verified by the local administrative department of price and shall not charge any other fee. | | |

|
| Article 12 An alcohol operator shall not forge, alter, rent, lend, transfer, purchase or sell or cheat for the Archival Filing and Registration Form of Alcohol Circulation. | | 第十二条 酒类经营者不得伪造、涂改、出租、出借、转让、买卖或骗取《酒类流通备案登记表》。 |
