The Tourism Law of the People's Republic of China, as adopted at the Second Session of the Standing Committee of the Twelfth National People's Congress of the People's Republic of China on April 25, 2013, is hereby issued and shall come into force on October 1, 2013.

Chapter I General Provisions 

第一章 总则


 
Article 1 This Law is formulated for purposes of protecting the lawful rights and interests of tourists and tourism operators, regulating the order of tourism market, protecting and making rational use of tourism resources, and promoting the sustainable and sound development of the tourist industry.   第一条 为保障旅游者和旅游经营者的合法权益,规范旅游市场秩序,保护和合理利用旅游资源,促进旅游业持续健康发展,制定本法。

 
Article 2 This law shall apply to tours, vacations, recreations and other forms of tourism activities within the territory of the People's Republic of China and the said forms of tourism activities that are outbound but organized within the territory of People's Republic of China and the business activities providing relevant services for tourism activities.   第二条 在中华人民共和国境内的和在中华人民共和国境内组织到境外的游览、度假、休闲等形式的旅游活动以及为旅游活动提供相关服务的经营活动,适用本法。

 
Article 3 The state shall develop the tourism undertaking, improve public services for tourism, and protect the rights of tourists in tourism activities in accordance with law.   第三条 国家发展旅游事业,完善旅游公共服务,依法保护旅游者在旅游活动中的权利。

 
Article 4 Tourism development shall follow the principle of unity of the social, economic and ecological benefits. The state shall encourage various market participants to make rational use of tourism resources in accordance with law under the premise of effective protection of tourism resources. Sightseeing sites constructed by using public resources shall reflect the nature of public welfare.   第四条 旅游业发展应当遵循社会效益、经济效益和生态效益相统一的原则。国家鼓励各类市场主体在有效保护旅游资源的前提下,依法合理利用旅游资源。利用公共资源建设的游览场所应当体现公益性质。

 
Article 5 The state shall advocate a healthy, civilized and environmentally-friendly forms of tourism, provide support for and encourage various social institutions to carry out public welfare publicity of tourism, and shall reward organizations and individuals that have made outstanding contributions in promoting the development of the tourist industry.   第五条 国家倡导健康、文明、环保的旅游方式,支持和鼓励各类社会机构开展旅游公益宣传,对促进旅游业发展做出突出贡献的单位和个人给予奖励。

 
Article 6 The state shall establish and improve tourism service standards and market rules, and prohibit industrial monopoly and regional monopoly. Tourism operators shall operate in good faith, make fair competition, undertake social responsibility, and provide safe, healthy, hygienic and convenient tourism services for tourists.   第六条 国家建立健全旅游服务标准和市场规则,禁止行业垄断和地区垄断。旅游经营者应当诚信经营,公平竞争,承担社会责任,为旅游者提供安全、健康、卫生、方便的旅游服务。

 
Article 7 The State Council shall establish and improve comprehensive tourism coordination mechanisms to comprehensively coordinate the development of the tourist industry.   第七条 国务院建立健全旅游综合协调机制,对旅游业发展进行综合协调。

Local people's governments at or above the county level shall strengthen the organization of and leadership to the tourism work, and specify the relevant departments or institutions to make overall coordination of the tourism development of their respective administrative regions and the supervision and administration thereof.
 
县级以上地方人民政府应当加强对旅游工作的组织和领导,明确相关部门或者机构,对本行政区域的旅游业发展和监督管理进行统筹协调。

 
Article 8 The tourism industrial organizations established in accordance with law shall be subject to self-regulation.   第八条 依法成立的旅游行业组织,实行自律管理。

 

Chapter II Tourists 

第二章 旅游者


 
Article 9 Tourists shall have the right to independently choose tourism products and services, and the right to refuse compulsory transactions with tourism operators.   第九条 旅游者有权自主选择旅游产品和服务,有权拒绝旅游经营者的强制交易行为。

Tourists shall have the right to know the real information on the tourism products and services they purchase.
 
旅游者有权知悉其购买的旅游产品和服务的真实情况。

Tourists shall have the right to require tourism operators to provide products and services as agreed upon.
 
旅游者有权要求旅游经营者按照约定提供产品和服务。

 
Article 10 Tourists' human dignity, ethnic customs and religious beliefs shall be respected.   第十条 旅游者的人格尊严、民族风俗习惯和宗教信仰应当得到尊重。

 
Article 11 Tourists such as the disabled, the elderly and minors shall enjoy convenience and preference in accordance with laws, regulations and relevant provisions during the tourism activities.   第十一条 残疾人、老年人、未成年人等旅游者在旅游活动中依照法律、法规和有关规定享受便利和优惠。

 
Article 12 Where the personal or property safety of tourists is in danger, they shall have the right to request assistance and protection.   第十二条 旅游者在人身、财产安全遇有危险时,有请求救助和保护的权利。

Where the personal safety or property of tourists is infringed upon, they shall have the right to obtain compensation in accordance with law.
 
旅游者人身、财产受到侵害的,有依法获得赔偿的权利。

 
Article 13 During tourism activities, tourists shall comply with social public order and social morality, respect local customs, cultural traditions and religious beliefs, take good care of tourism resources, protect the ecological environment, and abide by the norms of tourist civilized conduct.   第十三条 旅游者在旅游活动中应当遵守社会公共秩序和社会公德,尊重当地的风俗习惯、文化传统和宗教信仰,爱护旅游资源,保护生态环境,遵守旅游文明行为规范。

 
Article 14 During the tourism activities or settlement of disputes, tourists may not damage the lawful rights and interests of local residents, or interfere with others' tourism activities, or damage the lawful rights and interests of tourism operators and tourism employees.   第十四条 旅游者在旅游活动中或者在解决纠纷时,不得损害当地居民的合法权益,不得干扰他人的旅游活动,不得损害旅游经营者和旅游从业人员的合法权益。

 
Article 15 When purchasing or accepting tourism services, tourists shall truthfully inform the tourism operators of the information on personal health related to the tourism activities and comply with the provisions on safety warning in tourism activities.   第十五条 旅游者购买、接受旅游服务时,应当向旅游经营者如实告知与旅游活动相关的个人健康信息,遵守旅游活动中的安全警示规定。

As for the measures of temporarily restricting tourism activities taken by the state to respond to major emergencies and safety protection and emergency response measures taken by relevant departments, institutions or tourism operators, the tourists shall provide cooperation.
 
旅游者对国家应对重大突发事件暂时限制旅游活动的措施以及有关部门、机构或者旅游经营者采取的安全防范和应急处置措施,应当予以配合。

Where tourists violate the provisions on safety warning or do not provide cooperation regarding the measures of temporarily restricting tourism activities taken by the state to respond to major emergencies, or safety protection and emergency response measures, they shall bear corresponding responsibilities in accordance with law.
 
旅游者违反安全警示规定,或者对国家应对重大突发事件暂时限制旅游活动的措施、安全防范和应急处置措施不予配合的,依法承担相应责任。

 
Article 16 Outbound tourists may not illegally stay abroad, and outbound tourists in a touring group may not divide the group into sub-groups or leave the group without permission.   第十六条 出境旅游者不得在境外非法滞留,随团出境的旅游者不得擅自分团、脱团。

Inbound tourists may not illegally stay in China, and inbound tourists in a touring group may not divide the group into sub-groups or leave the group without permission.
 
入境旅游者不得在境内非法滞留,随团入境的旅游者不得擅自分团、脱团。

 

Chapter III Tourism Planning and Promotion 

第三章 旅游规划和促进


 
Article 17 The State Council and local people's governments at or above the county level should include the development of the tourist industry into the national economic and social development planning.   第十七条 国务院和县级以上地方人民政府应当将旅游业发展纳入国民经济和社会发展规划。

The State Council, the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government, and the people's governments at the level of a districted city or county with abundant tourism resources shall, under the requirements of the national economic and social development planning, organize the formulation of tourism development planning. When making use of tourism resources involving more than one administrative region and suitable for overall use, a unified tourism development planning shall be developed by the people's government at the higher level or by the relevant local people's governments through consultation.
 
国务院和省、自治区、直辖市人民政府以及旅游资源丰富的设区的市和县级人民政府,应当按照国民经济和社会发展规划的要求,组织编制旅游发展规划。对跨行政区域且适宜进行整体利用的旅游资源进行利用时,应当由上级人民政府组织编制或者由相关地方人民政府协商编制统一的旅游发展规划。

 
Article 18 A tourism development planning shall include: overall requirements and development goals of the tourist industry, requirements and measures for the protection and utilization of tourism resources, requirements and promotion measures for tourism product development, tourism service quality enhancement, tourism cultural construction, tourism image promotion, and construction of tourism infrastructures and public service facilities.   第十八条 旅游发展规划应当包括旅游业发展的总体要求和发展目标,旅游资源保护和利用的要求和措施,以及旅游产品开发、旅游服务质量提升、旅游文化建设、旅游形象推广、旅游基础设施和公共服务设施建设的要求和促进措施等内容。

The local people's governments at or above the county level may, in accordance with the tourism development planning, draw up special planning for the development and utilization of major tourism resources, to set forth special requirements for the tourism projects, and supporting facilities and service functions in specific areas.
 
根据旅游发展规划,县级以上地方人民政府可以编制重点旅游资源开发利用的专项规划,对特定区域内的旅游项目、设施和服务功能配套提出专门要求。

 
Article 19 The tourism development planning shall be integrated with overall land use planning, urban and rural planning, environmental protection planning, and other planning for the protection and utilization of natural resources, cultural relics and other human culture resources.   第十九条 旅游发展规划应当与土地利用总体规划、城乡规划、环境保护规划以及其他自然资源和文物等人文资源的保护和利用规划相衔接。

 
Article 20 When preparing overall land use planning or urban and rural planning, the people's governments at various levels shall take into full consideration the spatial layout of the relevant tourism projects and facilities and land use requirements for construction. Consideration shall also be given to the needs of the development of the tourist industry in the planning and construction of infrastructures and public service facilities of transportation, communications, water supply, power supply, environmental protection, etc.   第二十条 各级人民政府编制土地利用总体规划、城乡规划,应当充分考虑相关旅游项目、设施的空间布局和建设用地要求。规划和建设交通、通信、供水、供电、环保等基础设施和公共服务设施,应当兼顾旅游业发展的需要。

 
Article 21 As for the use of natural resources, cultural relics and other human culture resources for tourism purpose, the relevant laws and regulations must be strictly abided by, the requirements for resource protection, ecological protection and safety of cultural relics shall be met, local traditional culture and customs shall be respected and maintained, the regional integrity, cultural representation and geographical particularity shall be maintained, and consideration shall be given to the needs of protection of military facilities. The relevant competent departments shall strengthen the supervision and inspection on the conservation and utilization of resources for tourism purpose.   第二十一条 对自然资源和文物等人文资源进行旅游利用,必须严格遵守有关法律、法规的规定,符合资源、生态保护和文物安全的要求,尊重和维护当地传统文化和习俗,维护资源的区域整体性、文化代表性和地域特殊性,并考虑军事设施保护的需要。有关主管部门应当加强对资源保护和旅游利用状况的监督检查。

 
Article 22 The people's governments at various levels shall organize assessment of implementation of the tourism development planning they have prepared and announce the planning to the public.   第二十二条 各级人民政府应当组织对本级政府编制的旅游发展规划的执行情况进行评估,并向社会公布。

 
Article 23 The State Council and local people's governments at or above the county level shall formulate and organize the implementation of industrial policies conducive to the sustainable and sound development of the tourist industry, promote the construction of tourism and leisure system, take measures to promote regional cooperation in tourism, encourage cross-regional tour routes and product development, promote the integration of tourism with industry, agriculture, commerce, culture, health, sports, science, education and other fields, and support the tourism development in ethnic minority areas, old revolutionary base areas, remote areas and poverty-stricken areas.   第二十三条 国务院和县级以上地方人民政府应当制定并组织实施有利于旅游业持续健康发展的产业政策,推进旅游休闲体系建设,采取措施推动区域旅游合作,鼓励跨区域旅游线路和产品开发,促进旅游与工业、农业、商业、文化、卫生、体育、科教等领域的融合,扶持少数民族地区、革命老区、边远地区和贫困地区旅游业发展。

 
Article 24 The State Council and local people's governments at or above the county level shall, in accordance with the actual conditions, arrange funds to strengthen the tourism infrastructure construction, tourism public services and promotion of tourism image.   第二十四条 国务院和县级以上地方人民政府应当根据实际情况安排资金,加强旅游基础设施建设、旅游公共服务和旅游形象推广。

 
Article 25 The state shall develop and implement strategies for the promotion of tourism image. The administrative department of tourism under the State Council shall make overall organization of the overseas promotion of the national tourism image, establish tourism image promotion institutions and networks and carry out international tourism cooperation and exchanges.   第二十五条 国家制定并实施旅游形象推广战略。国务院旅游主管部门统筹组织国家旅游形象的境外推广工作,建立旅游形象推广机构和网络,开展旅游国际合作与交流。

Local people's governments at or above the county level shall make overall organization of the promotion of local tourism images.
 
县级以上地方人民政府统筹组织本地的旅游形象推广工作。

 
Article 26 The administrative department of tourism under the State Council and local people's governments at or above the county level shall, in accordance with the needs, establish tourism public information and consultation platforms to provide necessary information on tourist attractions, routes, transportation, weather, accommodation, safety, and emergency medical treatment and consulting services free of charge. The people's governments at the level of a districted city or county shall, in accordance with needs, establish tourist information centers at transportation hubs, commercial centers and tourist gathering places, and set tourism signs in the scenic spots and on the roads leading to the major scenic spots.   第二十六条 国务院旅游主管部门和县级以上地方人民政府应当根据需要建立旅游公共信息和咨询平台,无偿向旅游者提供旅游景区、线路、交通、气象、住宿、安全、医疗急救等必要信息和咨询服务。设区的市和县级人民政府有关部门应当根据需要在交通枢纽、商业中心和旅游者集中场所设置旅游咨询中心,在景区和通往主要景区的道路设置旅游指示标识。

The people's governments at the level of a districted city or county with abundant tourism resources may, in accordance with the local conditions, set up special tourist transportation lines or tourist transit stations to provide services for tourists to travel to or around the cities.
 
旅游资源丰富的设区的市和县级人民政府可以根据本地的实际情况,建立旅游客运专线或者游客中转站,为旅游者在城市及周边旅游提供服务。

 
Article 27 The state shall encourage and support the development of tourism vocational education and training to improve the quality of tourism employees.   第二十七条 国家鼓励和支持发展旅游职业教育和培训,提高旅游从业人员素质。

 

Chapter IV Tourism Operation 

第四章 旅游经营


 
Article 28 A travel agency established to attract, organize, and receive tourists, and provide tourism services for them shall meet the following conditions, obtain the permit from the administrative department of tourism and handle industrial and commercial registration in accordance with law:   第二十八条 设立旅行社,招徕、组织、接待旅游者,为其提供旅游服务,应当具备下列条件,取得旅游主管部门的许可,依法办理工商登记:

 
(1) It has a fixed business premise; (一)有固定的经营场所;

 
(2) It has necessary business facilities; (二)有必要的营业设施;

 
(3) It has registered capital as required; (三)有符合规定的注册资本;

 
(4) It has necessary business management personnel and tour guides; and (四)有必要的经营管理人员和导游;

 
(5) Other conditions as prescribed by laws and administrative regulations. (五)法律、行政法规规定的其他条件。

 
Article 29 A travel agency may engage in the following businesses:   第二十九条 旅行社可以经营下列业务:

 
(1) domestic tourism; (一)境内旅游;

 
(2) outbound tourism; (二)出境旅游;

 
(3) border tourism; (三)边境旅游;

 
(4) inbound tourism; and (四)入境旅游;

 
(5) other tourism businesses. (五)其他旅游业务。

To engage in the businesses of items (2) and (3) of the preceding paragraph, a travel agency shall obtain corresponding business permit, and the specific conditions shall be provided for by the State Council.
 
旅行社经营前款第二项和第三项业务,应当取得相应的业务经营许可,具体条件由国务院规定。

 
Article 30 No travel agency may lease or lend its business permit for travel agencies or illegally transfer its business permit for travel agencies in any other form.   第三十条 旅行社不得出租、出借旅行社业务经营许可证,或者以其他形式非法转让旅行社业务经营许可。

 
Article 31 Travel agencies shall pay tourism service quality deposits in accordance with the relevant provisions for compensation for damage to tourists' rights and interests and advance payment of expenses for emergency assistance when the tourists' personal safety is in danger.   第三十一条 旅行社应当按照规定交纳旅游服务质量保证金,用于旅游者权益损害赔偿和垫付旅游者人身安全遇有危险时紧急救助的费用。

 
Article 32 The information released by travel agencies to attract or organize tourists must be authentic and accurate, and no false publicity may be made to mislead tourists.   第三十二条 旅行社为招徕、组织旅游者发布信息,必须真实、准确,不得进行虚假宣传,误导旅游者。

 
Article 33 When organizing or receiving tourists, travel agencies and their employees may not organize the tourists to visit or participate in the items or activities in violation of Chinese laws, regulations or social morality.   第三十三条 旅行社及其从业人员组织、接待旅游者,不得安排参观或者参与违反我国法律、法规和社会公德的项目或者活动。

 
Article 34 When organizing tourism activities, travel agencies shall order products and services from qualified suppliers.   第三十四条 旅行社组织旅游活动应当向合格的供应商订购产品和服务。

 
Article 35 Travel agencies may not organize tourism activities at unreasonably low prices to lure tourists, and obtain kickbacks and other improper benefits through arranging shopping or separate charging tourism items.   第三十五条 旅行社不得以不合理的低价组织旅游活动,诱骗旅游者,并通过安排购物或者另行付费旅游项目获取回扣等不正当利益。

When organizing or receiving tourists, travel agencies may not specify specific shopping places, or arrange separate charging tourism items, unless it is agreed upon by both parties through consultation or requested by tourists and does not affect the itinerary of other tourists.
 
旅行社组织、接待旅游者,不得指定具体购物场所,不得安排另行付费旅游项目。但是,经双方协商一致或者旅游者要求,且不影响其他旅游者行程安排的除外。

In the case of occurrence of any circumstance in violation of the provisions of the preceding two paragraphs, the tourists shall, within 30 days after the end of the tour, have the right to request the travel agency to return the goods for them and pay the refund in advance, or to refund the fees paid for the separate charging tourism items.
 
发生违反前两款规定情形的,旅游者有权在旅游行程结束后三十日内,要求旅行社为其办理退货并先行垫付退货货款,或者退还另行付费旅游项目的费用。

 
Article 36 When organizing an outbound touring group, or organizing or receiving an inbound touring group, a travel agency shall, in accordance with the relevant provisions, arrange for a tour leader or tour guide to accompany the touring group in the whole tour.   第三十六条 旅行社组织团队出境旅游或者组织、接待团队入境旅游,应当按照规定安排领队或者导游全程陪同。

 
Article 37 A person who has passed the tour guide qualification examination, and has signed an employment contract with a travel agency or registered in the relevant tourist industry organization may apply for a tour guide certificate.   第三十七条 参加导游资格考试成绩合格,与旅行社订立劳动合同或者在相关旅游行业组织注册的人员,可以申请取得导游证。

 
Article 38 Travel agencies shall conclude employment contracts in accordance with law with the tour guides they employ, any pay labor remunerations and social insurance premiums.   第三十八条 旅行社应当与其聘用的导游依法订立劳动合同,支付劳动报酬,缴纳社会保险费用。

Where a travel agency temporarily employs a tour guide to provide services for tourists, it shall pay the tour guide service fees as prescribed in Paragraph 3 of Article 60 of this Law in full amount.
 
旅行社临时聘用导游为旅游者提供服务的,应当全额向导游支付本法第六十条第三款规定的导游服务费用。

Where a travel agency arranges for tour guides to provide services for touring groups, it may not require the tour guides to pay any fees in advance or charge the tour guides any fees.
 
旅行社安排导游为团队旅游提供服务的,不得要求导游垫付或者向导游收取任何费用。

 
Article 39 A person who has obtained a tour guide certificate, has corresponding educational background, language skills and experience in tourism, and has signed an employment contract with a travel agency may apply for a tour leader certificate.   第三十九条 取得导游证,具有相应的学历、语言能力和旅游从业经历,并与旅行社订立劳动合同的人员,可以申请取得领队证。

 
Article 40 To provide services for tourists, tour guides and tour leaders must accept the assignment from travel agencies and may not privately undertake the tour guide or tour leader services.   第四十条 导游和领队为旅游者提供服务必须接受旅行社委派,不得私自承揽导游和领队业务。

 
Article 41 Tour guides and tour leaders engaged in business activities shall wear their tour guide certificates, or tour leader certificates, abide by professional ethics, respect the customs and religious beliefs of the tourists, and shall inform and explain the norms of tourist civilized conduct to tourists, guide the tourists to healthy and civilized tourism, and discourage tourists from committing acts in violation of social morality.   第四十一条 导游和领队从事业务活动,应当佩戴导游证、领队证,遵守职业道德,尊重旅游者的风俗习惯和宗教信仰,应当向旅游者告知和解释旅游文明行为规范,引导旅游者健康、文明旅游,劝阻旅游者违反社会公德的行为。

Tour guides and tour leaders shall strictly implement the itinerary, and may not change the itinerary or discontinue service activities without permission, or demand tips from tourists, or induce, deceive, force or force in disguise tourists to make shopping or participate in separate charging tourism items.
 
导游和领队应当严格执行旅游行程安排,不得擅自变更旅游行程或者中止服务活动,不得向旅游者索取小费,不得诱导、欺骗、强迫或者变相强迫旅游者购物或者参加另行付费旅游项目。

 
Article 42 The opening of a scenic spot shall meet the following conditions, and the opinions of the administrative department of tourism shall be listened to:   第四十二条 景区开放应当具备下列条件,并听取旅游主管部门的意见:

 
(1) The scenic spot has necessary tourism supporting services and auxiliary facilities; (一)有必要的旅游配套服务和辅助设施;

 
(2) The scenic spot has necessary safety facilities and rules, has passed the safety risk assessment and meets the safety conditions; (二)有必要的安全设施及制度,经过安全风险评估,满足安全条件;

 
(3) The scenic spot has necessary environmental protection facilities and ecological protection measures; and

 (三)有必要的环境保护设施和生态保护措施;
