| Article 1 For the purposes of improving the judicial case handling organizations of organs of the Supreme People's Procuratorate, and regulating the operation of judicial case handling organizations, these Measures are developed in accordance with the Several Opinions on Improving the Judicial Responsibility System of People's Procuratorates, the Implementing Opinions on the Reform of the Judicial Responsibility System of Organs of the Supreme People's Procuratorate (for Trial Implementation), the List of Judicial Case Handling Authority of Prosecutors of Organs of the Supreme People's Procuratorate and other provisions, and in light of the actual work of organs. | | 第一条 为健全最高人民检察院机关司法办案组织，规范司法办案组织运行，根据《关于完善人民检察院司法责任制的若干意见》《最高人民检察院机关司法责任制改革实施意见（试行）》和《最高人民检察院机关检察官司法办案权力清单》等规定，结合机关工作实际，制定本办法。 |
| Article 2 In accordance with the requirements for the performance of functions, case types and degree of complexity, the organs of the Supreme People's Procuratorate shall adopt the basic organizational form of sole prosecutor or the case handling team of prosecutors in judicial case handling. | | 第二条 根据履行职能的需要、案件类型和复杂难易程度，最高人民检察院机关在司法办案中实行独任检察官或者检察官办案组的基本组织形式。 |
| Article 3 The case handling team of prosecutors shall consist of two or more prosecutors. For the purpose of strengthening professional legal supervision, the case handling team of prosecutors may be set in a fixed manner, or may be temporarily organized according to judicial case handling requirements. The person in charge of the case handling team of prosecutors is the chief prosecutor. | | 第三条 检察官办案组由两名以上检察官组成。为加强法律监督专业化建设，检察官办案组可以固定设置，也可以根据司法办案需要临时组成。检察官办案组负责人为主任检察官。 |
| The temporarily organized case handling team of prosecutors and chief prosecutor shall be designated by the person in charge of business department or procurator-general (deputy procurator-general) and full-time members of the procuratorial committee. With respect to the fixed case handling team of prosecutors and chief prosecutor, the person in charge of the business department shall offer opinions and submit them to the procurator-general (deputy procurator-general) and full-time members of the procuratorial committee for approval or decision, and report them to the political department for recordation. | | 临时组成的检察官办案组及主任检察官由业务部门负责人或者检察长（分管副检察长）、检察委员会专职委员指定。固定设置的检察官办案组及主任检察官由业务部门负责人提出意见，报请检察长（分管副检察长）、检察委员会专职委员批准决定，并报政治部备案。 |
| Where the procurator-general (deputy procurator-general), full-time member of the procuratorial committee or person in charge of the business department participates in the case handling team of prosecutors, he or she shall be the chief prosecutor. If they are of the same case handling team, the position of chief prosecutor shall be held based on sequence, or the procurator-general shall designate the chief prosecutor. | | 检察长（分管副检察长）、检察委员会专职委员、业务部门负责人参加检察官办案组的，为主任检察官；参加同一办案组的，依序或者由检察长指定担任主任检察官。 |
| Article 4 When the sole prosecutor or case handling team of prosecutors handles a case, necessary prosecutor assistants and clerks shall be assigned. Prosecutor assistants and clerks may be assigned in a fixed manner and may be managed in a centralized manner, and may be assigned according to case handling requirements. | | 第四条 独任检察官、检察官办案组办理案件，配备必要的检察官助理和书记员。检察官助理、书记员可以固定配置，也可以集中管理，根据办案需要随案配备。 |
Article 5 Cases undertaken by a sole prosecutor generally means simple cases and cases prescribed in paragraph 1, Article 6 of the Implementing Opinions on the Reform of the Judicial Responsibility System of Organs of the Supreme People's Procuratorate (for Trial Implementation).
