The natural resources departments of all provinces, autonomous regions, municipalities directly under the Central Government, and cities under separate state planning; the natural resources department of Xinjiang Production and Construction Corps; the offices of the State Taxation Administration (“STA”) in all provinces, autonomous regions, municipalities directly under the Central Government, and cities under separate state planning; all local special commissioner's offices of the SAT; all local offices of the China Banking and Insurance Regulatory Commission (“CBIRC”); all policy banks, large banks, and joint-stock banks; and all insurance companies and financial assets management companies: 各省、自治区、直辖市及计划单列市自然资源主管部门,新疆生产建设兵团自然资源主管部门,国家税务总局各省、自治区、直辖市和计划单列市税务局,国家税务总局驻各地特派员办事处,各银保监局,各政策性银行、大型银行、股份制银行,各保险公司、金融资产管理公司:
For the purposes of deepening the reform of “simplification of administrative procedures, decentralization of powers, combination of decentralization with appropriate control, and optimization of services,” further optimizing the business environment, and fully implementing the Regulation on Optimizing the Business Environment and the Notice by the General Office of the State Council of Shortening the Time Required for Handling Real Estate Registration (No. 8 [2019], General Office of the State Council), the following opinions on advancing in a coordinated manner the System of “Internet + Real Estate Registration” and other matters are hereby offered: 为深化“放管服”改革,进一步优化营商环境,全面贯彻落实《优化营商环境条例》以及《国务院办公厅关于压缩不动产登记办理时间的通知》(国办发〔2019〕8号),现就协同推进“互联网+不动产登记”等有关事项提出以下意见:
I. Accelerating the establishment of integrated and unified online “one-window acceptance” platforms. Real estate registration institutions shall implement their responsibilities, seek support from local governments, accelerate the implementation of the Regulation on Optimizing the Business Environment, and, on the basis of comprehensively implementing “one-window acceptance and parallel handling” for real estate registration, transactions and tax payment, advance the development of “Internet + Real Estate Registration” to a higher level, and complete the construction of integrated and unified online “one-window acceptance” platforms as soon as possible. Provinces where conditions permit may take the lead in establishing and implementing unified online “one-window acceptance” platforms throughout the provinces, and localities where conditions do not permit may also use the online “one-window acceptance” platforms uniformly allocated by the Ministry of Natural Resources. Through the online “one-window acceptance” platforms, seamless connection with tax collection administration and other systems shall be achieved to realize one-time acceptance, automatic distribution, parallel handling, legal connection, and “all-in-one network for handling affairs” and prevent “visiting multiple websites and accessing to multiple networks.” Online “one window” and offline “one window” shall be integrated and connected, and a set of service standards and one handling platform shall be implemented; online and offline workforce and windows shall be arranged for in a scientific manner so as to provide services in an all-round manner. All-out efforts shall be made to achieve full coverage of “one-window acceptance and parallel handling” in all cities and counties across the country before the end of this year, and the promotion of integrated and unified online and offline “one-window acceptance” platforms shall be accelerated.   一、加快建立集成统一的网上“一窗受理”平台。不动产登记机构要落实主体责任,争取地方政府支持,加快贯彻《优化营商环境条例》,在全面实施不动产登记、交易和缴税“一窗受理、并行办理”的基础上,推动“互联网+不动产登记”向更高层级发展,尽快建立集成、统一的网上“一窗受理”平台。具备条件的省份可以率先建立实施全省统一的网上“一窗受理”平台,不具备条件的地方也可使用自然资源部统一配发的网上“一窗受理”平台。通过网上“一窗受理”平台,与税收征管等系统无缝衔接,实现一次受理、自动分发、并行办理、依法衔接、一网通办,杜绝“进多站、跑多网”。线上“一窗”和线下“一窗”要融合衔接,实行一套服务标准、一个办理平台;线上线下人员力量和窗口要科学配备,做到全面提供服务。今年年底前力争全国所有市县实现“一窗受理、并行办理”全覆盖,并加快推进线上线下集成统一的“一窗受理”平台。
II. Vigorously promoting online acceptance and examination. Online “one-window acceptance” platforms shall be utilized to accelerate online acceptance and examination of real estate registration and tax return filing, among others. In localities where effective information sharing and integration are achieved, the materials required for real estate registration shall be obtained by registration institutions through interdepartmental information sharing, and applicants shall have their identities verified online, and handle relevant matters by “face scanning” without the need to be physically present, achieving “no need to be onsite at all.” In localities where effective information sharing and integration is not available for the time being, applicants shall take photos of or scan the paper materials and submit them online, online examination thereof shall be conducted and original materials shall be verified, and the handling of relevant matters shall be completed all at once, with express delivery services provided, so as to achieve the handling of affairs without the need to be physically present. At the same time, quality services shall be provided for onsite handling. All localities shall, through online “one-window acceptance” platforms and their mobile APPs, and WeChat mini-programs, among others, boost the online facilitated handling, faster handling, and handling with priority, and gradually realize the “universal handling across the cities,” “possibility of handling at the nearest places,” and “permission to handling at different places.” Before the end of this year, cities at or above the prefecture level and counties and cities where conditions permit nationwide shall fully implement “Internet + Real Estate Registration.”   二、大力推进网上受理审核。利用网上“一窗受理”平台,加快推进不动产登记、申报纳税等网上受理审核。信息共享集成到位的地方,不动产登记所需材料由登记机构通过部门信息共享获取,申请人在网上验证身份,“刷脸”不见面办理,实现“一次不用跑”;信息共享集成暂时不能到位的地方,由申请人将纸质材料拍照或扫描后在网上提交,网上审核,核验原始材料,一次性办结,辅助快递邮寄,力争实现不见面办理。同时,要做好现场办理的优质服务。各地要通过网上“一窗受理”平台及其手机APP、微信小程序等,推进网上便捷办、更快办、优先办,并逐步实现全城通办、就近能办、异地可办。今年年底前,全国地级及以上城市和具备条件的县市全面实施“互联网+不动产登记”。
III. Popularizing the use of electronic certificates, licenses and electronic materials. In accordance with laws and regulations, the electronic real estate registration certificates and proofs have the same legal force as paper real estate registration certificates and proofs, and shall be vigorously promoted and applied by all localities. In localities where conditions permit, electronic certificates and proofs conforming to national standards shall be issued; and in localities where conditions do not permit for the time being, efforts shall be made to provide such services as mailing of paper certificates and proofs and self-service printing so as to facilitate enterprises and the public in handling affairs without the need to be physically present. The use of electronic signatures, electronic seals, electronic contracts, and electronic certificates and proofs in such services as real estate registration, tax return filing, and granting of mortgage loans shall be promoted; electronic seals meeting the specified conditions shall have the same legal force as handwritten signatures or seals, and electronic seals shall have the same legal force as physical seals; electronic materials which are electronically signed or to which electronic seals are affixed shall be legal and valid; information obtained through sharing and electronic materials submitted by the parties can be used as the basis for handling affairs; and electronic materials are no longer required to be archived in paper form. The banking and insurance regulatory departments and real estate registration institutions in localities where conditions permit may jointly develop model texts of real estate mortgage contracts.

   三、推广使用电子证照及电子材料。按照法律法规规定,电子不动产登记证书证明与纸质不动产登记证书证明具有同等法律效力,各地要积极推广应用。有条件的地方,应当核发符合国家标准的电子证书证明;暂时不具备条件的,要努力提供纸质证书证明邮寄、自助打印等服务,方便企业群众不见面办理。在不动产登记、申报纳税和抵押放贷等服务中推广使用电子签名、电子印章、电子合同、电子证书证明,符合规定条件的电子签名与手写签名或者盖章、电子印章与实物印章具有同等法律效力,经电子签名或加盖电子印章的电子材料合法有效,通过共享获得的信息以及当事人提交的电子材料可以作为办事依据,电子材料可以不再以纸质形式归档。具备条件的地方银保监部门与不动产登记机构可以联合制定不动产抵押合同示范文本。
