Your Request for Instructions on the Determination of the Amount of Fines for Violations of the Law on the Prevention and Control of Pollution from Environmental Noise (No. 17 [2017], Environmental Protection Department of Zhejiang Province) has been received. Upon deliberation, the following reply is hereby provided: 你厅《关于对违反〈中华人民共和国环境噪声污染防治法〉行为确定罚款幅度的请示》(浙环〔2017〕17号)收悉。经研究,函复如下:
I. The Law on the Prevention and Control of Pollution from Environmental Noise has specified corresponding administrative penalties for violations of the “three simultaneities” system, failure to pay excessive pollutant discharge fees and other violations of laws, but there is no clear range or scope for fines. In the Reply on How to Determine the Amount of Fines Prescribed in the Law on the Prevention and Control of Pollution from Environmental Noise (No. 639 [1997], State Environmental Protection Administration) as made by the former State Environmental Protection Administration on October 22, 1997, the basic principle of “being applicable mutatis mutandis” was established. It is no longer appropriate to continue the implementation of the said Reply as the Law of the People's Republic of China on the Prevention and Control of Environment Pollution Caused by Solid Wastes, the Water Pollution Prevention and Control Law of the People's Republic of China and the Atmospheric Pollution Prevention and Control Law of the People's Republic of China have been subsequently amended (and the Detailed Rules for the Implementation of Atmospheric Pollution Prevention and Control Law of the People's Republic of China has been repealed).

   一、中华人民共和国环境噪声污染防治法》对违反“三同时”制度、不按规定缴纳超标准排污费等违法行为规定了相应的行政处罚,但没有明确罚款的幅度范围。原国家环境保护局于1997年10月22日作出的《关于如何确定〈环境噪声污染防治法〉规定的罚款数额问题的复函》(环发〔1997〕639号),确立了“比照适用”的基本原则。该复函随着《中华人民共和国固体废物污染环境防治法》《中华人民共和国水污染防治法》《中华人民共和国大气污染防治法》的相继修订(《中华人民共和国大气污染防治法实施细则》已废止),已不宜再继续实施。
