The Procedures on Customs Control over Bonded Areas, as approved by the State Council on June 10, 1997, are hereby issued, and shall come into force on the date of issuance. The Customs Regulations of the People's Republic of China Concerning Control over the Goods, Means of Transport and Personal Articles Entering or Leaving the Waigaoqiao Bonded Zone of Shanghai issued by the General Administration of Customs on September 9, 1990, as well as relevant detailed rules for implementation as developed in accordance with these Regulations shall be repealed concurrently. | |
《保税区海关监管办法》已于１９９７年６月１０日经国务院批准，现予发布，自发布之日起施行。１９９０年９月９日我署发布的《中华人民共和国海关对进出上海外高桥保税区货物、运输工具和个人携带物品的管理办法》以及根据该办法制定的有关实施细则同时废止。 |

| CHAPTER ONE GENERAL PROVISIONS | | 第一章 总则 |

| Article 1 This set of procedures has been formulated in accordance with provisions of the Customs Law and other related laws with a view to strengthening and improving the control of Customs over bonded areas and promoting healthy development of bonded areas. | | 第一条 为了加强与完善海关对保税区的监管，促进保税区的健康发展，根据海关法和其他有关法律的规定，制定本办法。 |

| Article 2 Any bonded area must be available with an approval from the State Council for its establishment within the territory of the People's Republic of China. | | 第二条 在中华人民共和国境内设立保税区，必须经国务院批准。 |
| |
|
| Article 3 Bonded areas are special areas put under the control of the Customs with all goods, means of transport and articles carried by individuals having to be put under the control of the Customs in accordance with this set of procedures upon their entry into or exit from the bonded areas. | | 第三条 保税区是海关监管的特定区域。海关依照本办法对进出保税区的货物、运输工具、个人携带物品实施监管。 |
To facilitate the control by Customs, bonded areas should be isolated from other areas in the territory of the People's Republic of China (hereinafter referred to as "non-bonded areas") with proper facilities. | |
保税区与中华人民共和国境内的其他地区（以下简称非保税区）之间，应当设置符合海关监管要求的隔离设施。 |

| Article 4 As only administrative organs and enterprises are eligible to be established in bonded areas, no person whosoever except security guards and personnel are allowed to reside in such areas. | | 第四条 保税区内仅设置保税区行政管理机构和企业。除安全保卫人员外，其他人员不得在保税区内居住。 |
| |
|
| Article 5 Enterprises established in bonded areas (hereinafter referred to as "enterprises in bonded areas") should all handle registration formalities with the Customs. | | 第五条 在保税区内设立的企业（以下简称区内企业），应当向海关办理注册手续。 |
Enterprises in bonded areas should install, in accordance with provisions of relevant laws and administrative decrees of the State, proper account books as well as take accounts, make audits and formulate various financial statements on the strength of legal and effective certificates, and put storage, transfer, relocation, sales, processing, use, loss and other conditions, such as brought in and out, of goods andarticles in the bonded areas into record. | |
区内企业应当依照国家有关法律、行政法规的规定设置帐簿、编制报表，凭合法、有效凭证记帐并进行核算，记录有关进出保税区货物和物品的库存、转让、转移、销售、加工、使用和损耗等情况。 |

| Article 6 A Customs checking system should be introduced in bonded areas. | | 第六条 保税区实行海关稽查制度。 |
Computers of enterprises in bonded areas should be wired up with that of the Customs for exchange of electronic data. | |
区内企业应当与海关实行电子计算机联网，进行电子数据交换。 |

| Article 7 The Customs shall have the right to check and inspect goods, articles, means of transport, and personnel during their entry into or exit from the bonded areas, and relevant sites in the areas according to Customs Law. | | 第七条 海关对进出保税区的货物、物品、运输工具、人员及区内有关场所，有权依照海关法的规定进行检查、查验。 |

| Article 8 Goods and articles banned from import and export by the State are also banned from the entry in or exit from bonded areas. | | 第八条 国家禁止进出口的货物、物品，不得进出保税区。 |

| CHAPTER TWO CONTROL OF GOODS INTERFLOWING BETWEEN BONDED AREAS AND AREAS OUTSIDE THE CHINESE TERRITORY | | 第二章 对保税区与境外之间进出货物的监管 |

| Article 9 The Customs shall exercise convenient as well as effective control over goods interflowing between bonded areas and areas outside the Chinese territory. | | 第九条 海关对保税区与境外之间进出的货物，实施简便、有效的监管。 |
| |
|
| Article 10 For interflow of goods between bonded areas and areas outside Chinese territory, consignees, consignors or sales agents of the goods should declare to the Customs for the record. | | 第十条 保税区与境外之间进出的货物，由货物的收货人、发货人或其代理人向海关备案。 |
| |
|
Article 11 Except for passive export quota control, there are no other import and export quota and license control over goods interflow between bonded areas and areas outside Chinese territory.
