The present Plan is formulated for the purpose of implementing the spirit of the Eighteenth National Congress of the CPC, put the strategy of “propelling development by innovation” into practice, promoting the achievement of the five-year target of the Outline of National Intellectual Property Strategies, and specify the key tasks and work measures for implementation in 2013. | |
为贯彻党的十八大精神，落实创新驱动发展战略，推动实现《国家知识产权战略纲要》五年目标，明确2013年战略实施重点任务和工作措施，制定本计划。 |

| I. Improvement of Intellectual Property Creation Capacities | | 一、提升知识产权创造水平 |
Objective Tasks: to enhance the quality and creation efficiency of intellectual property rights, improve the review and administration of intellectual property rights, including patents, trademarks, copyrights and new varieties of plants, improve the appraisal and evaluation system of intellectual property rights, direct creators of intellectual property rights to shift their focus on the quantity of intellectual property rights to the quality of intellectual property rights, and boost the value increment of intellectual property rights. | |
目标任务：提高知识产权质量和创造效率，改进专利、商标、版权、植物新品种等知识产权审查管理工作，完善知识产权考核评价体系，引导知识产权创造主体从注重知识产权数量向注重知识产权质量转变，促进提升知识产权价值。 |

Implement the revised evaluation indicator system of national technological invention awards, improve the requirements for the intellectual property certification documents in the application materials of candidate projects, and direct experts to strengthen the evaluation on the quality and transformation and application of intellectual property rights of candidate projects. | | 1.落实修订后的国家技术发明奖评价指标体系，完善对候选项目申报材料知识产权证明文件的要求，引导专家加强对候选项目知识产权质量及转化运用情况的评价。 |

Improve the patent examination guidance system and the quality assurance system, and promote the improvement of the retrieval capaticities; formulate promotion policies for patent quality improvement, specify the policy orientation for subsidizing patents, and enhance the patent subsidy effectiveness; and strengthen the monitoring and handling of abnormal patent applications and standardize the patent application acts. | | 3.完善专利审查业务指导体系和质量保障体系，促进提高检索能力；制定提升专利质量促进政策，明确专利资助政策导向，提高专利资助效能；加强对非正常专利申请的监控和处理，规范专利申请行为。 |

Objective Tasks: to promote the in-depth integration of intellectual property policies and industry policies, strengthen intellectual property risk assessment and early warning for strategic emerging industries, advantageous industries with local characteristics and other industries, strengthen the guidance to the layout of intellectual property rights in key industries, and direct industrial enterprises to improve the capacity to take advantage of intellectual property rights to participate in international competition. | |

Implement the Administrative Measures for the Priority Examination of Invention Patent Applications, and conduct priority examination of the patent applications in such technology fields of strategic emerging industries as energy conservation and environmental protection, new-generation information technology, biology, high-end equipment manufacturing, new energy and new materials, as well as the patent applications conducive to environment-friendly development, such as those related to low-carbon technologies and resource conservation; | | 8.落实《发明专利申请优先审查管理办法》，面向节能环保、新一代信息技术、生物、高端装备制造、新能源、新材料等战略性新兴产业技术领域，以及低碳技术、节约资源等有助于绿色发展的专利申请，开展优先审查工作。 |

Objective Tasks: to strengthen the dominant role of enterprises in the application of intellectual property rights, improve the mechanisms for innovation achievements transformation and application with intellectual property rights as pivot and core, implement the policies and measures which promote the smooth transfer and transformation of intellectual property rights to enterprises, and promote the productization, commercialization and industrialization of intellectual property achievements. | |

Objectives Tasks: to improve the relevant laws and regulations on intellectual property rights, improve the long-term mechanisms for fighting against infringements upon intellectual property rights according to law, and carry out performance assessments on intellectual property protection; enhance the effectiveness of judicial protection of intellectual property rights, improve the administrative law enforcement capacity, conduct task force protection and aid in defending rights in key areas and key industries, and promote the legal disclosure of the intellectual property administrative penalty cases; and strengthen the protection of intellectual property resources in traditional areas of strength and improve the international response level. | |
目标任务：完善知识产权相关法律法规，健全依法打击侵犯知识产权的长效机制，开展知识产权保护绩效考核。提升知识产权司法保护效能，提高行政执法能力，针对重点领域、重点产业开展专项保护和维权援助工作，推动知识产权行政处罚案件信息依法公开。加强对传统优势领域知识产权资源的保护，提升国际应对水平。 |

22. Amend the Several Provisions on Issues concerning the Application of Law in the Trial of Cases of Disputes over Patents (2001), and formulate the Interpretation on Several Issues concerning the Application of Law in the Trial of Pre-Action Preservation of Intellectual Property Rights, the Interpretation on Several Issues concerning the Application of Law in the Trial of Cases of Civil Disputes Arising from Trademarks, and the Interpretation on Several Issues concerning the Application of Law in the Trial of Cases of Trademark Rights Licensing and Confirmation; and timely issue guiding opinions on the application of law in disputes over patent infringement, patent licensing and confirmation, protection of well-known trademarks, service trademark protection, trade secret protection, the application of law in disputes over copyrights of Kara OK operators, among others.
