| In order to promote the voluntary performance of obligations determined in effective legal instruments by persons subject to enforcement, and boost the building of the social credit system, these Provisions are formulated in accordance with the provisions of the Civil Procedure Law of the People's Republic of China and in light of the work actualities of people's courts. | | 为促使被执行人自觉履行生效法律文书确定的义务，推进社会信用体系建设，根据《中华人民共和国民事诉讼法》的规定，结合人民法院工作实际，制定本规定。 |
| Article 1 Where the judgment debtor fails to perform the obligations determined in an effective legal instrument, and falls under any of the following circumstances, a people's court shall include him or it in the list of dishonest judgment debtors and impose credit-related punishment thereon in accordance with the law: | | 第一条 被执行人未履行生效法律文书确定的义务，并具有下列情形之一的，人民法院应当将其纳入失信被执行人名单，依法对其进行信用惩戒： |
| (1) Having the capability of performing obligations but refusing to perform the obligations determined in the effective legal instrument. | | （一）有履行能力而拒不履行生效法律文书确定义务的； |
| (2) Obstructing or resisting enforcement by forged evidence, violence, threat or any other method. | | （二）以伪造证据、暴力、威胁等方法妨碍、抗拒执行的； |
| (3) Evading enforcement by fraudulent litigation or false arbitration, concealment or transfer of property or any other method. | | （三）以虚假诉讼、虚假仲裁或者以隐匿、转移财产等方法规避执行的； |
| (4) Violating the property reporting system. | | （四）违反财产报告制度的； |
| (5) Violating the Order on Restriction of Consumption. | | （五）违反限制消费令的； |
| (6) Refusing to perform the enforcement reconciliation agreement without any good reason. | | （六）无正当理由拒不履行执行和解协议的。 |
| Article 2 The judgment debtor that falls under any of the circumstances as prescribed in Items (2) through (6) of Article 1 of these Provisions shall be included in the list of dishonest judgment debtors for two years. Where the judgment debtor obstructs or resists enforcement by violence, threat or any other method with serious circumstances or has more than one dishonest conduct, the two-year period may be extended by one to three years. | | 第二条 被执行人具有本规定第一条第二项至第六项规定情形的，纳入失信被执行人名单的期限为二年。被执行人以暴力、威胁方法妨碍、抗拒执行情节严重或具有多项失信行为的，可以延长一至三年。 |
| Where the judgment debtor actively performs the obligations determined in the effective legal instrument or takes the initiative to correct the dishonest conduct, the people's court may decide to delete the dishonest information ahead of time. | | 失信被执行人积极履行生效法律文书确定义务或主动纠正失信行为的，人民法院可以决定提前删除失信信息。 |
| Article 3 Under any of the following circumstances, a people's court shall not list the judgment debtor in the list of dishonest judgment debtors in accordance with the provisions of Item (1) of Article 1 of these Provisions: | | 第三条 |
| (1) Sufficient and effective guarantee has been provided. | | （一）提供了充分有效担保的； |
| (2) The property against which seizure, impoundment, freeze or any other measure has been taken is sufficient to repay the debts determined in the effective legal document. | | （二）已被采取查封、扣押、冻结等措施的财产足以清偿生效法律文书确定债务的； |
| (3) The judgment debtor shall not be subject to compulsory enforcement in accordance with the law because it or he is arranged later in sequence to perform the obligations. | | （三）被执行人履行顺序在后，对其依法不应强制执行的； |
| (4) Any other circumstance under which the judgment debtor does not fall within the scope of having the capability of performing obligations but refusing to perform the obligations determined in the effective legal instrument. | | （四）其他不属于有履行能力而拒不履行生效法律文书确定义务的情形。 |
| Article 4 Where the judgment debtor is a minor, a people's court shall not include him in the list of dishonest judgment debtors. | | 第四条 被执行人为未成年人的，人民法院不得将其纳入失信被执行人名单。 |
| Article 5 The notice of enforcement issued by a people's court to the judgment debtor shall state the risk alerts on being included in the list of dishonest judgment debtors and other contents. | | 第五条 人民法院向被执行人发出的执行通知中，应当载明有关纳入失信被执行人名单的风险提示等内容。 |
Where the enforcement applicant deems that the judgment debtor falls under any of the circumstances as prescribed in Article 1 of these Provisions, he or it may file a request with the people's court for including the judgment debtor in the list of dishonest judgment debtors, and the people's court shall, within 15 days of receipt of the request, examine it and make a decision. Where the people's court deems that the judgment debtor falls under any of the circumstances as prescribed in Article 1 of these Provisions, it may also, according to the court's powers, make the decision of including the judgment debtor in the list of dishonest judgment debtors.
