| Decision of the Standing Committee of the National People's Congress on Authorizing the Implementation of the Pilot Program on the Reform of the System of People's Assessors in Certain Areas | | 全国人民代表大会常务委员会关于授权在部分地区开展人民陪审员制度改革试点工作的决定 |

To further improve the system of people's assessors, boost judicial democracy, and promote judicial justice, as decided at the 14th session of the Standing Committee of the Twelfth National People's Congress, the Supreme People's Court is authorized to select five courts (including basic people's courts and intermediate people's courts) each in ten provinces (autonomous regions and municipalities directly under the Central Government), namely, Beijing, Hebei, Heilongjiang, Jiangsu, Fujian, Shandong, Henan, Guangxi, Chongqing, and Shaanxi to conduct the pilot program on the reform of the system of people's assessors, so as to reform theconditions and procedures for the selection ofpeople's assessors, the scope of, mechanism for and powers of participation in trial, the exit and punishment mechanisms, and the guarantee system forthe performance of duties, among others. The provisions of Article 37 of the Law of the People's Republic of China on the Organization of the People's Courts, Article 1, Article 2, Article 4, Article 7, Article 8, paragraph 1 of Article 11, and paragraph 2 of Article 14 of the Decision of the Standing Committee of the National People's Congress on Improving the System of People's Assessors, paragraph 1 (excluding the contents of the proviso) and paragraph 3 of Article 178 of the Criminal Procedure Law of the People's Republic of China, and paragraph 3 of Article 39 of the Civil Procedure Law of the People's Republic of China shall be temporarily adjusted applicable to pilot areas. The pilot work shall follow the basic principles of the litigation system as provided by the law, be conducive to boosting judicial democracy, promoting judicial justice, guaranteeing people's orderly participation in justice, and enhancing judicial credibility, and enable people to enjoy fairness and justice in all judicial cases. The specific measures for the pilot program shall be researched and developed by the Supreme People's Court jointly with the relevant departments, and be reported to the Standing Committee of the National People's Congress for recordation. The term of the pilot program is two years, beginning from the date when the measures for the pilot program are issued.
．．．．．． | | 为进一步完善人民陪审员制度，推进司法民主，促进司法公正，第十二届全国人民代表大会常务委员会第十四次会议决定：授权最高人民法院在北京、河北、黑龙江、江苏、福建、山东、河南、广西、重庆、陕西十个省（区、市）各选择五个法院（含基层人民法院及中级人民法院）开展人民陪审员制度改革试点工作，对人民陪审员选任条件、选任程序、参审范围、参审机制、参审职权、退出和惩戒机制、履职保障制度等进行改革。试点地区，暂时调整适用《中华人民共和国人民法院组织法》第三十七条，《全国人民代表大会常务委员会关于完善人民陪审员制度的决定》第一条、第二条、第四条、第七条、第八条、第十一条第一款、第十四条第二款，《中华人民共和国刑事诉讼法》第一百七十八条第一款（但书内容除外）、第三款，《中华人民共和国民事诉讼法》第三十九条第三款的规定。试点工作应当遵循法律所规定的诉讼制度的基本原则，有利于推进司法民主，促进司法公正，保障人民群众有序参与司法，提升司法公信力，让人民群众在每一个司法案件中感受到公平正义。试点具体办法由最高人民法院会同有关部门研究制定，报全国人民代表大会常务委员会备案。试点期限为二年，自试点办法印发之日起算。
