《环境监察执法证件管理办法》已于2013年12月5日由环境保护部部务会议审议通过，现予公布，自2014年3月1日起施行。原国家环境保护局发布的《环境监理执法标志管理办法》（国家环境保护局令第9号）同时废止。

第一章　总则

　　第一条　为加强环境监察执法证件管理，规范环境监察执法人员的执法行为，根据《中华人民共和国环境保护法》、《中华人民共和国行政处罚法》等有关法律法规，制定本办法。
　　第二条　本办法适用于环境监察执法证件的申领、使用和管理。
　　第三条　环境监察执法证件是环境监察执法人员依法开展环境监察执法活动资格和身份的证明。
　　第四条　环境保护部负责全国环境监察执法证件的管理工作。
省级环境保护主管部门负责本行政区域内环境监察执法证件的管理工作。
环境保护部环境监察局、省级环境监察机构负责具体实施环境监察执法证件管理工作。
　　第五条　环境监察执法证件的样式、编码方式和制作要求由环境保护部统一制定。
　　第六条　从事现场执法工作的环境监察执法人员进行现场检查时，有权依法采取以下措施：
（一）进入有关场所进行勘察、采样、监测、拍照、录音、录像、制作笔录；
（二）查阅、复制相关资料；
（三）约见、询问有关人员，要求说明相关事项，提供相关材料；
（四）责令停止或者纠正违法行为；
（五）适用行政处罚简易程序，当场作出行政处罚决定；
（六）法律、法规、规章规定的其他措施。
环境监察执法人员在执行环境监察执法任务时，应当出示环境监察执法证件或者有效的地方行政执法证件。
未取得环境监察执法证件的，不得从事环境监察执法工作。

第二章　证件申领

　　第七条　县级以上环境保护主管部门具有正式编制拟从事环境监察执法工作的人员，具备下列条件的，可以申请领取环境监察执法证件：
（一）具有全日制大专以上学历；
（二）在环境保护主管部门工作满一年；
（三）熟悉环境保护法律、法规、规章和环境监察执法的业务知识；
（四）参加环境监察执法资格培训并经考试合格。
　　第八条　环境保护部负责组织以下人员的执法资格培训和考试：
（一）省级以上环境保护主管部门拟从事环境监察执法工作的人员；
