In order to implement the spirit of the Notice of the Central Committee of the CPC on Forwarding the Preliminary Opinions of the Leading Group for Central Judicial System Reform about the Judicial System and the Working Mechanism (No. 21 [2004] of the Central Committee of the CPC), regulate the charge of lawyers' fees and maintain the lawful rights and interests of clients and law firms, we specially formulated the Measures for the Administration of Lawyers' Fees, which are hereby printed and distributed to you, please implement them accordingly. | |
为贯彻落实《中共中央转发〈中央司法体制改革领导小组关于司法体制和工作机制改革的初步意见〉的通知》（中发[2004]21号）精神，规范律师服务收费行为，维护委托人和律师事务所的合法权益，特制定了《律师服务收费管理办法》。现印发给你们，请按照执行。 |

| Article 1 These Measures are formulated according to the Price Law, the Law on Lawyers, and other relevant laws and regulations for the purpose of regulating the charge of lawyers' fees, maintaining the lawful rights and interests of clients and law firms, and promoting the sound development of the lawyering industry. | | 第一条 为规范律师服务收费行为，维护委托人和律师的合法权益，促进律师服务业健康发展，依据《价格法》和《律师法》等有关法律法规，制定本办法。 |

| Article 2 The charge of fees by the law firms established according to the Lawyers Lawof the People's Republic of China and by the lawyers whose practices have been approved for their legal services provided to their clients shall be governed by these Measures. | | 第二条 依照《中华人民共和国律师法》设立的律师事务所和获准执业的律师，为委托人提供法律服务的收费行为适用本办法。 |

| Article 3 The principles of openness, fairness, free will, compensation and good faith shall be followed in the charge of lawyers' fees. | | 第三条 律师服务收费遵循公开公平、自愿有偿、诚实信用的原则。 |
A law firm shall facilitate the people, strengthen its internal management, reduce service costs and provide convenient and good legal services to the clients. | |
律师事务所应当便民利民，加强内部管理，降低服务成本，为委托人提供方便优质的法律服务。 |

| Article 4 The lawyers' fees shall be subject to government-guided pricing and market-regulated pricing. | | 第四条 律师服务收费实行政府指导价和市场调节价。 |
| |
|
| Article 5 A law firm shall implement government-guided pricing for providing the following legal services: | | 第五条 律师事务所依法提供下列法律服务实行政府指导价： |
| |
|
| (1)acting as an agent in civil cases; | | （一）代理民事诉讼案件； |
| |
|
| (2)acting as an agent in administrative cases; | | （二）代理行政诉讼案件； |
| |
|
| (3)acting as an agent in the cases of state compensation; | | （三）代理国家赔偿案件； |
| |
|
| (4)acting as an agent in criminal cases, including the provision of legal consultancy to, filing complaints and charges for, and applying for probation for criminal suspects, acting as a defender for the accused, private prosecutor or the victim; and | | （四）为刑事案件犯罪嫌疑人提供法律咨询、代理申诉和控告、申请取保候审，担任被告人的辩护人或自诉人、被害人的诉讼代理人； |
| |
|
| (5)acting as an agent in the various kinds of litigation cases for appealing to the court. | | （五）代理各类诉讼案件的申诉。 |
A law firm shall implement market-regulated pricing for providing other legal services. | |
律师事务所提供其他法律服务的收费实行市场调节价。 |
| |
|
| Article 6 The benchmark price and the floating range of market-regulated price shall be determined by the competent department of price of the people's government of each province, autonomous region or municipality directly under the Central Government together with the judicial administrative department at the same level. | | 第六条 政府指导价的基准价和浮动幅度由各省、自治区、直辖市人民政府价格主管部门会同同级司法行政部门制定。 |

| Article 7 The government shall, when determining the lawyers' fees, extensively solicit the opinions from all sides of the society, and may hold a hearing when necessary. | | 第七条 政府制定律师服务收费，应当广泛听取社会各方面意见，必要时可以实行听证。 |
| |
|
| Article 8 The local economic development level, the social affordability as well as the long-term development of the lawyering industry shall be taken into full account for the government to determine the lawyers' fees. And the charging rates shall be determined on the basis of the social average costs for compensating lawyers' services plus the reasonable profits and statutory taxes. | | 第八条 政府制定的律师服务收费应当充分考虑当地经济发展水平、社会承受能力和律师业的长远发展，收费标准按照补偿律师服务社会平均成本，加合理利润与法定税金确定。 |

| Article 9 The lawyers' fees subject to market regulation shall be determined through the consultation between the law firm and the client. | | 第九条 实行市场调节的律师服务收费，由律师事务所与委托人协商确定。 |
The following main factors shall be taken into account when a law firm is consulting about the lawyers' fees with its clients: | |
律师事务所与委托人协商律师服务收费应当考虑以下主要因素： |

| (1)time to be spent on the work | | （一）耗费的工作时间； |
| |
|
| (2)complexity of the legal affair; | | （二）法律事务的难易程度； |
| |
|
| (3)affordability of the clients; | | （三）委托人的承受能力； |
| |
|
| (4)risks and responsibilities the law firm might assume; and | | （四）律师可能承担的风险和责任； |
| |
|
| (5)social reputation and working level, etc. of the lawyers. | | （五）律师的社会信誉和工作水平等。 |
| |
|
| Article 10 The lawyers' fees may, in light of different service contents, be charged on the case-by-case basis, at a certain proportion of the amount involved, or the time spent, etc. | | 第十条 律师服务收费可以根据不同的服务内容，采取计件收费、按标的额比例收费和计时收费等方式。 |
The fees charged on the case-by-case basis shall be generally applicable to the legal affairs not involving property relationship. | |
计件收费一般适用于不涉及财产关系的法律事务； |
The fees charged on the basis of a proportion of the amount involved shall be applicable to the legal affairs involving property relationship. | |
按标的额比例收费适用于涉及财产关系的法律事务； |
The fees charged on the basis of the time spent may be applicable to all legal affairs. | |
计时收费可适用于全部法律事务。 |

Article 11 In the handling of a civil case involving property relationship, if the client still requires to implement the risk agency after being informed of the government-guided pricing, the law firm may charge fees on the basis of risk agency, unless it is under any of the following circumstances:
