Guiding Opinions of the Ministry of Ecology and Environment on Improving the Capabilities of Environmental Monitoring, Utilization and Disposal, and Environmental Risk Prevention for Hazardous Wastes 

生态环境部关于提升危险废物环境监管能力、利用处置能力和环境风险防范能力的指导意见

The departments (bureaus) of ecology and environment of all provinces, autonomous regions and municipalities directly under the Central Government; and the Ecology and Environment Bureau of the Xinjiang Production and Construction Corps: 各省、自治区、直辖市生态环境厅(局),新疆生产建设兵团生态环境局:
Environmental management of hazardous wastes plays a crucial role in promoting ecological progress and protecting ecological environment, and holds a leading position in the combat against pollution. It is also of vital importance in enhancing environmental quality, preventing environmental risks, protecting ecological environment, and maintaining human health. For the purposes of improving the capabilities of environmental monitoring, utilization and disposal, and environmental risk prevention (hereinafter referred to as the “three capabilities”) for hazardous wastes, the Opinions are hereby offered as follows: 危险废物环境管理是生态文明建设和生态环境保护的重要方面,是打好污染防治攻坚战的重要内容,对于改善环境质量,防范环境风险,维护生态环境安全,保障人体健康具有重要意义。为切实提升危险废物环境监管能力、利用处置能力和环境风险防范能力(以下简称“三个能力”),提出以下意见。
I. General requirements   一、总体要求
With Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era as the guideline, efforts shall be made to earnestly implement the vision of ecological progress proposed by General Secretary Xi Jinping and the principles set forth at the National Conference on Environmental Protection, with environmental quality as the core and environmental risk prevention as the objective; revolve around the combat against pollution by following the principles of combining prevention and control, carrying out pilot programs, taking gradual steps, and establishing a joint mechanism in key areas and targeted sectors; and vigorously improve the “three capabilities” in handling hazardous wastes to protect the safety of ecological environment and the health of the people. 以习近平新时代中国特色社会主义思想为指导,深入贯彻落实习近平生态文明思想和全国生态环境保护大会精神,以改善环境质量为核心,以有效防范环境风险为目标,以疏堵结合、先行先试、分步实施、联防联控为原则,聚焦重点地区和重点行业,围绕打好污染防治攻坚战,着力提升危险废物“三个能力”,切实维护生态环境安全和人民群众身体健康。
By the end of 2025, the system of monitoring hazardous wastes at the sources of pollution and punishing the wrongful behavior in a strict manner shall be established and improved; the capability of using and disposing of hazardous wastes shall meet the actual needs in each province (autonomous region, municipality directly under the Central Government) so as to ensure that such capability can meet the general demands and be distributed evenly in China; and the capability of environmental risk prevention shall be notably enhanced so that illegal transfer and dumping of hazardous wastes can be successfully controlled. In particular, the Yangtze River Delta region (including Shanghai, Jiangsu and Zhejiang) shall take the lead in building pilot “wasteless cities” before December 31, 2020; and the Pearl River Delta region, the Beijing-Tianjin-Hebei region, and other areas along the Yangtze Economic Belt shall commence the pilot program before December 31, 2022. 到2025年年底,建立健全“源头严防、过程严管、后果严惩”的危险废物环境监管体系;各省(区、市)危险废物利用处置能力与实际需求基本匹配,全国危险废物利用处置能力与实际需要总体平衡,布局趋于合理;危险废物环境风险防范能力显著提升,危险废物非法转移倾倒案件高发态势得到有效遏制。其中,2020年年底前,长三角地区(包括上海市、江苏省、浙江省)及“无废城市”建设试点城市率先实现;2022年年底前,珠三角、京津冀和长江经济带其他地区提前实现。
II. Strengthening the capability of monitoring hazardous wastes   二、着力强化危险废物环境监管能力
1. Improving the list of hazardous waste sources monitored: The ecology and environment departments at all levels shall, in conjunction with the second national survey of pollution sources and the national environmental statistical work, upgrade the list of entities generating hazardous wastes (“hazardous waste generators”) and the list of entities having their own treatment and disposal facilities, based on which a list of key enterprises monitored shall be created by referring to the list of entities operating and handling hazardous wastes (“hazardous waste handlers”). From the year 2020 on, the above lists shall be integrated in the national solid waste management information system. (一)完善危险废物监管源清单。各级生态环境部门要结合第二次全国污染源普查、环境统计工作分别健全危险废物产生单位清单和拥有危险废物自行利用处置设施的单位清单,在此基础上,结合危险废物经营单位清单,建立危险废物重点监管单位清单。自2020年起,上述清单纳入全国固体废物管理信息系统统一管理。
2. Constantly promoting the standardized management of hazardous wastes: Local ecology and environment departments at all levels shall strengthen the inspection of law enforcement concerning hazardous wastes, and urge enterprises to fulfill the requirements as specified in laws, regulations and standards. In all provinces (autonomous regions and municipalities directly under the Central Government), the management of hazardous wastes shall be included in their respective environmental protection performance assessment indicator systems, and local authorities shall be supervised in the fulfillment of their responsibilities in monitoring the environment. An environmental creditability assessment system for enterprises shall be introduced so that those violating the relevant laws can be added to the list of illegal and dishonest enterprises in the ecological environment protection field; the list shall be exposed to the public; and joint punishment shall be imposed. Hazardous waste generators and hazardous waste handlers shall be incorporated in the coverage of compulsory environmental pollution liability insurance according to law. (二)持续推进危险废物规范化环境管理。地方各级生态环境部门要加强危险废物环境执法检查,督促企业落实相关法律制度和标准规范要求。各省(区、市)应当将危险废物规范化环境管理情况纳入对地方环境保护绩效考核的指标体系中,督促地方政府落实监管责任。推进企业环境信用评价,将违法企业纳入生态环境保护领域违法失信名单,实行公开曝光,开展联合惩戒。依法将危险废物产生单位和危险废物经营单位纳入环境污染强制责任保险投保范围。
3. Intensifying the efforts to monitor the complete process of handling hazardous wastes: Local ecology and environment departments at all levels shall strictly examine and approve the permits of handling hazardous wastes; and shall not delegate the approval authorities without permission in violation of the state laws and regulations. They shall establish a mechanism that can effectively connect the approval for the permits to the approval for environmental impact assessment documents. If there is a new construction project, it shall strictly comply with the Guideline for Environmental Impact Assessment of Hazardous Wastes from Construction Projects and the General Specifications of Engineering and Technology for Hazardous Waste Disposal; the percentage of verification and spot-check in the environmental impact assessment documents of key industrial construction projects involving hazardous wastes shall be increased. Where the types, quantities and disposal methods of hazardous wastes generated by regular handlers are highly inconsistent with the original environmental impact assessment documents, the handlers shall make corrections in a timely manner according to the requirements in the relevant laws, regulations, guidelines and other documents; and if a crime is constituted, severe punishment shall be imposed. Solid wastes shall be subject to the management of pollutant discharge permits in accordance with the pollutant discharge permitting system at fixed pollution sources. The daily monitoring of hazardous wastes shall be included in the law enforcement of the “regulation of randomly selected entities by randomly selected regulators and the public disclosure of regulatory results” in the ecological environment field. The approval procedures for inter-province transfer of hazardous wastes shall be optimized, the time limit for approval shall be clarified, and the electronic manifests shall be adopted, making it easier for moving and using hazardous wastes across different regions. (三)强化危险废物全过程环境监管。地方各级生态环境部门要严格危险废物经营许可证审批,不得违反国家法律法规擅自下放审批权限;应建立危险废物经营许可证审批与环境影响评价文件审批的有效衔接机制。新建项目要严格执行《建设项目危险废物环境影响评价指南》及《危险废物处置工程技术导则》;加大涉危险废物重点行业建设项目环境影响评价文件的技术校核抽查比例,长期投运企业的危险废物产生种类、数量以及利用处置方式与原环境影响评价文件严重不一致的,应尽快按现有危险废物法律法规和指南等文件要求整改;构成违法行为的,依法严格处罚到位。结合实施固定污染源排污许可制度,依法将固体废物纳入排污许可管理。将危险废物日常环境监管纳入生态环境执法“双随机、一公开”内容。优化危险废物跨省转移审批手续、明确审批时限、运行电子联单,为危险废物跨区域转移利用提供便利。
4. Strengthening the trainings for regulators and professional personnel: More trainings shall be provided on the management of hazardous wastes in the whole country; some hazardous waste generators and handlers in good conditions shall be encouraged to establish an internship training base on hazardous wastes, in which the personnel engaging in supervision of ecological environment protection, environmental impact assessment, pollutant discharge permitting, environmental law enforcement, and solid waste management can be properly trained and can exchange views with each other. The trainings for professional organizations and personnel shall be strengthened; a team of experts in the management of hazardous wastes shall be built; and more technical support shall be provided to address critical issues and difficult problems. (四)加强监管机构和人才队伍建设。强化全国危险废物环境管理培训,鼓励依托条件较好的危险废物产生单位和危险废物经营单位建设危险废物培训实习基地,加强生态环境保护督察、环境影响评价、排污许可、环境执法和固体废物管理机构人员的技术培训与交流。加强危险废物专业机构及人才队伍建设,组建危险废物环境管理专家团队,强化重点难点问题的技术支撑。
5. Improving the capability of information-based supervision and management: The online application and registration of hazardous waste generators and the online record-filing of hazardous waste management plans shall be supported; the electronic manifests for transferring hazardous wastes shall be adopted in an all-round way; and a single information-based management network for hazardous wastes shall be built across the country. Local authorities shall ensure that the operation & maintenance personnel and the funds for the solid waste management information system shall be in place, and protect the security of online operation and network information. The information related to hazardous wastes shall be released to the public through the information system, and an information exchange platform shall be established. The areas where conditions permit shall be encouraged to support integrated smart monitoring devices such as video monitoring and electronic labeling at the critical points of key entities so as to track and manage the complete process of handling hazardous wastes. Local authorities shall make full use of the “Internet + supervision” system; strengthen interim and ex post environmental monitoring; collect and share various data and information; and discover and prevent emerging risks in a timely manner.

 (五)提升信息化监管能力和水平。开展危险废物产生单位在线申报登记和管理计划在线备案,全面运行危险废物转移电子联单,2019年年底前实现全国危险废物信息化管理“一张网”。各地应当保障固体废物管理信息系统运维人员和经费,确保联网运行和网络信息安全。通过信息系统依法公开危险废物相关信息,搭建信息交流平台。鼓励有条件的地区在重点单位的重点环节和关键节点推行应用视频监控、电子标签等集成智能监控手段,实现对危险废物全过程跟踪管理。各地应充分利用“互联网+监管”系统,加强事中事后环境监管,归集共享各类相关数据,及时发现和防范苗头性风险。
