The Interim Provisions may be delivered internally and shall not be made public. Interim Provisions of the State Council on Investment Preferences for Overseas Chinese | | 国务院关于华侨投资优惠的暂行规定 |
| The present Interim Provisions are formulated in accordance with the Constitution and relevant laws and regulations of the People's Republic of China for the purpose of encouraging overseas Chinese to contribute investments. | | 根据中华人民共和国宪法和有关法律、法规的规定，为鼓励华侨投资，特制定本暂行规定。 |
| Article 1 The present Interim Provisions may apply to investments contributed by overseas Chinese in the form of foreign exchange, mechanical equipment, know-how or patent right, etc. | | |
| Article 2 Based on the need of economic or cultural construction of the state, an overseas Chinese investor may contribute investments in a way of establishing a wholly-owned enterprise, establishing a equity joint venture or cooperative enterprise with a state-run enterprise or a collectively-owned enterprise, or in other ways. | | 第二条 根据国家经济、文化建设的需要，华侨投资者可以选择独资经营，同国营企业合资、合作经营，同集体企业合资、合作经营等方式进行投资。 |
| An overseas Chinese may also contribute investments in a way of depositing spot exchange in or purchasing bonds from state-run overseas Chinese investment companies or trust and investment companies. | | 华侨投资还可以采取向国营华侨投资公司、信托投资公司进行现汇存款和购买债券等方式。 |
| Article 3 Where an overseas Chinese invests to establish an enterprise outside a special economic zone or an economic and technological development zone, the enterprise may enjoy the following preferences in addition to implementing the relevant laws and regulations of China: | | 第三条 华侨在经济特区和经济技术开发区以外投资兴办企业，除按我国有关法律、法规执行外，还可以享受下列优惠： |
(1) The enterprise invested by an overseas Chinese may be exempted from income tax for three years as of the year when it begins to make profits, and whose income tax may be levied at a half rate for four years as of the fourth year.
