Article 1 The Regulation is formulated to strengthen the protection of intellectual property rights, stimulate the vitality of innovation, construct a modernized, international and innovative city, and build a globally influential hub of creativity based on the actual conditions of Shenzhen Special Economic Zone (“SSEZ”) in accordance with the basic principles of laws and administrative regulations. | | 第一条 为了加强知识产权保护工作,激发创新活力,建设现代化国际化创新型城市,打造具有世界影响力的创新创意之都,根据法律、行政法规的基本原则,结合深圳经济特区(以下简称特区)实际,制定本条例。 |
Article 2 The Regulation shall be applied to the work mechanism, administrative enforcement, public services, self-discipline management, and credit regulation of intellectual property protection in SSEZ. | | 第二条 特区知识产权保护工作机制、行政执法、公共服务、自律管理、信用监管等适用本条例。 |
For the purpose of the Regulation, “intellectual property rights” refer to the exclusive rights to the following objects enjoyed by right holders: | | 本条例所称知识产权,是指权利人依法就下列客体享有的专有的权利: |
1. Works; | | (一)作品; |
2. Inventions, utility models, and designs; | | (二)发明、实用新型、外观设计; |
3. Trademarks; | | (三)商标; |
4. Geographic indications; | | (四)地理标志; |
5. Trade secrets; | | (五)商业秘密; |
6. Layout designs of integrated circuits; | | (六)集成电路布图设计; |
7. New varieties of plants; or | | (七)植物新品种; |

Article 3 The People's Government of Shenzhen Municipality (hereinafter referred to as the “Municipal People's Government”) and the people's governments of all districts of Shenzhen shall incorporate the work of intellectual property protection into the planning for national economy and social development, strengthen education, training, publicity, administrative enforcement and guarantee of operating funds, perfect the intellectual property protection mechanism, and create an intellectual property protection environment that upholds innovation, integrity and observance of law. | | 第三条 深圳市人民政府(以下简称市人民政府)以及各区人民政府应当将知识产权保护工作纳入国民经济和社会发展规划,加强知识产权保护的教育、培训、宣传、行政执法和经费保障,完善知识产权保护工作机制,营造崇尚创新、诚信守法的知识产权保护环境。 |
Article 4 The Regulatory Department of Intellectual Property Rights of the Municipal People's Government (hereinafter referred to as the “Municipal Regulatory Department”) shall be responsible for the overall coordination, organization and implementation of intellectual property protection, and fulfill the duties thereof according to law. | | 第四条 市人民政府知识产权主管部门(以下简称市主管部门)负责知识产权保护工作的统筹协调与组织实施,依法履行知识产权保护工作职责。 |
The administrative departments responsible for the protection of intellectual property rights in such areas as development and reform, industry and information, science and innovation, public finance, culture, sports and tourism, public security, judicial administration, and customs shall fulfill the duties thereof in accordance with laws, regulations and the provisions of the Regulation. | | 发展改革、工业信息、科技创新、财政、文体旅游、公安、司法行政、海关等依法负有知识产权保护工作职责的管理部门,根据有关法律、法规以及本条例的规定,履行知识产权保护工作职责。 |
Article 5 The Municipal Regulatory Department shall issue an annual report regarding the protection of intellectual property rights. | | 第五条 市主管部门应当每年发布知识产权保护工作情况报告。 |
Article 6 A diversified mechanism for handling intellectual property disputes shall be established and improved in an effort to ensure the effective coordination of administrative enforcement, judicial proceedings, arbitration, and mediation in intellectual property protection. | | 第六条 建立和完善多元化知识产权纠纷处理机制,实现知识产权保护行政执法、司法审判、仲裁、调解等工作的有效衔接。 |
Article 7 Shenshen Qianhai Shekou Area of China (Guangdong) Pilot Free Trade Zone may conduct pilot programs in terms of work mechanism, dispute settlement, rights protection in international trade, and comprehensive law enforcement in intellectual property protection, provide convenient and efficient services, and construct a demonstration area for the protection of intellectual property rights, the achievements of which, when conditions permit, may be promoted throughout the city. | | 第七条 中国(广东)自由贸易试验区深圳前海蛇口片区可以在创新知识产权保护工作机制和纠纷处理、涉外维权、综合执法等方面先行先试,提供便捷高效服务,建设知识产权保护工作示范区,其探索成果条件成熟时可以在全市推广。 |
Article 8 The Standing Committee of the People's Congress of Shenzhen Municipality shall step up the supervision over intellectual property protection, and listen carefully to the special report of the Municipal People's Government on the work of intellectual property protection. | | 第八条 市人民代表大会常务委员会应当加强对知识产权保护工作的监督,听取市人民政府有关知识产权保护工作的专项报告。 |
Chapter II Work Mechanism | | 第二章 工作机制 |
Article 9 The Municipal People's Government shall establish the Shenzhen Intellectual Property Joint Meeting and a coordination mechanism on the work of intellectual property protection so as to push forward the resolution of major issues pertaining to such work. | | 第九条 市人民政府设立市知识产权联席会议,建立知识产权保护工作协调机制,推动解决知识产权保护工作中的重大问题。 |
The Joint Meeting shall be convened by the head of the Municipal People's Government or the person-in-charge of the Municipal Regulatory Department. It shall be held at least once a year, and its routine work shall be undertaken by the Municipal Regulatory Department. | | 联席会议由市人民政府负责人或者其委托的市主管部门主要负责人召集,每年至少召开一次。联席会议的日常工作由市主管部门承担。 |
The members of the Joint Meeting shall be determined by the Municipal People's Government. | | 联席会议成员单位由市人民政府确定。 |
Article 10 The Notification System of Intellectual Property Protection shall be further enhanced. When a member of the Joint Meeting finds any clues of a case under the jurisdiction of another department, it shall circulate a written notice to the competent department in a timely manner. | | 第十条 完善知识产权工作情况通报制度。联席会议成员单位发现属于其他部门管辖的知识产权案件线索时,应当及时书面通报有管辖权的部门。 |
The competent department receiving the notice shall promptly investigate the case. | | 有管辖权的部门接到通报后,应当依法及时查处。 |
Article 11 An intellectual property appraisal system shall be established. | | 第十一条 建立知识产权评议制度。 |
The municipal and district people's governments may conduct intellectual property appraisal for major industrial plans, government investment projects and key economic and technological activities so as to improve innovation efficiency and prevent intellectual property risks. | | 市、区人民政府可以对重大产业规划、政府投资项目、重大经济科技活动进行知识产权评议,提高创新效率,防范知识产权风险。 |
The specific measures for intellectual property appraisal shall be developed by the Municipal Regulatory Department in conjunction with other relevant departments. | | 知识产权评议的具体办法由市主管部门会同相关部门制定。 |
Article 12 The Municipal People's Government shall establish an assessment mechanism of intellectual property protection in a bid to examine and assess the performance of the district people's governments and the Municipal Regulatory Department in fulfilling their respective duties of intellectual property protection. | | 第十二条 市人民政府应当建立知识产权保护工作考核机制,对区人民政府、市主管部门以及其他管理部门依法履行知识产权保护工作职责的情况进行考核。 |
Article 13 The Municipal Regulatory Department and other administrative departments shall, according to the requirements of intellectual property protection, conduct special activities for the protection of intellectual property rights, and intensify efforts in protecting the intellectual property rights in certain new areas and new business such as broadband mobile Internet, cloud computing, Internet of Things, big data, high-performance computing, and mobile intelligent terminals. | | 第十三条 市主管部门以及其他管理部门应当根据知识产权保护工作的需要,开展知识产权保护专项行动,加大宽带移动互联网、云计算、物联网、大数据、高性能计算、移动智能终端等新领域新业态知识产权保护力度。 |
Article 14 The public security organs shall fulfill their duties of intellectual property protection, crack down harder on criminal conducts involving intellectual property rights, and exercise administrative enforcement of law together with the Municipal Regulatory Department and other administrative departments. | | 第十四条 公安机关应当依法履行知识产权保护工作职责,加大对知识产权犯罪行为打击力度,并协同市主管部门以及其他管理部门开展相关行政执法工作。 |
Article 15 If a case of suspected intellectual property crime is transferred to the public security organ, the public security organ shall, within the specified time limit, decide whether to accept it or not and notify in writing the transferring department of its decision; and, if the case is not within its jurisdiction, forward it to the competent department and notify the transferring department in writing. | | 第十五条 公安机关对于移送的涉嫌知识产权犯罪案件,应当在规定时限内决定是否受理,并书面告知移送案件的部门。经审查不属于其管辖的,应当转送有管辖权的部门,并书面告知移送案件的部门。 |
If the public security organ accepts the case of suspected intellectual property crime, the articles involved in the case shall be taken evidence and sealed up according to law, and, if conditions permit, may be handed over to the Municipal Public Property Storehouse for storage. | | 公安机关受理的涉嫌知识产权犯罪案件,涉案物品在提取证据依法封存后,具备条件的可以交市公物仓保管。 |
Article 16 For an application for evidence preservation of intellectual property rights in compliance with laws and regulations, the notarial office shall issue an notarial certificate to the party concerned within five working days after accepting the application. However, the time for force majeure, supplementing documents and certificates, or verifying the relevant information shall not be included in the aforesaid time period. | | 第十六条 公证机构对符合法律、法规规定的知识产权证据保全公证申请,应当自受理公证申请之日起五个工作日内向当事人出具公证书。但是,因不可抗力、需要补充证明材料或者核实有关情况的,所需时间不计算在期限内。 |
Where the notarial office violates the aforesaid provisions, the municipal judicial administrative department shall give it a warning; and if the circumstance is serious, it shall impose upon the notarial office a fine of RMB 20,000 up to RMB 50,000. | | 公证机构违反前款规定的,由市司法行政部门予以警告;情节严重的,处以二万元以上五万元以下罚款。 |
Article 17 Except for a case of suspected intellectual property crime, the Municipal Regulatory Department and other administrative departments may, prior or subsequent to case filing, conduct mediation by themselves or entrust mediation to relevant organizations. If the right holder claims for damages less than five times the amount of losses, his or her claim may be supported. If a mediation agreement has been reached and fulfilled prior to case filing, the case may not be filed. If a mediation agreement has been reached and fulfilled subsequent to case filing, a lighter or mitigated punishment may be given according to law; and if no third-party's lawful rights and interests or public interests are impaired, an exemption from punishment may be granted. | | 第十七条 除涉嫌知识产权犯罪的案件外,市主管部门以及其他管理部门在知识产权案件立案前或者立案后,可以自行或者委托相关组织进行调解。权利人提出给予损失数额五倍以内赔偿的,可以予以支持。立案前达成调解协议并履行完毕的,可以不予立案。立案后达成调解协议并履行完毕的,可以依法从轻、减轻处罚;没有损害第三人合法权益和公共利益的,可以免除处罚。 |
Article 18 The Intellectual Property Protection Center set up by the Municipal People's Government shall fulfill the following duties: | | 第十八条 市人民政府设立的知识产权保护中心履行下列职责: |
1. Undertaking the tasks entrusted by the national regulatory department of intellectual property rights, including patent application acceptance, rapid patent examination and rapid patent confirmation; | | (一)承担国家知识产权主管部门委托的专利申请受理、专利快速审查和快速确权工作; |
2. Publicizing the knowledge relating to intellectual property rights, and encouraging independent innovations of enterprises in intellectual property protection; | | (二)宣传推广知识产权相关知识,促进企业知识产权自主创新; |
3. Providing services for public welfare, such as cooperation on intellectual property protection, business consulting, monitoring and pre-warning, guidance for rights protection, and rapid rights protection. | | (三)承担知识产权保护协作、业务咨询、监测预警、维权指引、快速维权等公益性服务; |
4. Offering advice and suggestions to the municipal and district people's governments in intellectual property protection; and | | (四)对市、区人民政府的知识产权保护工作提出意见和建议; |
5. Other duties prescribed by the Municipal People's Government. ...... | | (五)市人民政府规定的其他职责。 ...... |
