最高人民法院关于广东省高级人民法院请示阳江虹阳食品工业有限公司与叶冠东专利侵权纠纷案的答复

广东省高级人民法院：
你院粤高法[2006]380号《关于阳江虹阳食品工业有限公司与叶冠东专利侵权纠纷一案如何适用法律的请示》收悉。经研究，答复如下：
根据《中华人民共和国专利法》第五十六条第一款的规定，发明或者实用新型专利权的保护范围以其权利要求的内容为准，说明书及附图可以用于解释权利要求。对于权利要求记载的技术特征，应当首先以说明书及附图为依据进行解释。权利要求书等有关表述歧义，不能直接得出具体、确定、惟一的解释的，应当依据所属领域的技术人员通过阅读权利要求书和说明书及附图，对实现要求保护的技术方案得出具体、确定、惟一的解释，以达到确定该专利保护范围的目的。本案所涉及技术方案中的滤网的位置，所属领域技术人员通过阅读权利要求书和说明书及附图后综合判断，应当可以得出滤网只能在桶体底部胶质出口之上的理解。至于本案被控侵权产品是否落入专利保护范围，请你院经依法审判自行认定。
