生态环境部办公厅关于进一步加强石油天然气行业环境影响评价管理的通知

The ecology and environment departments (bureaus) of all provinces, autonomous regions, and municipalities directly under the Central Government; the Ecology and Environment Bureau of Xinjiang Production and Construction Corps; China National Petroleum Corporation; China Petrochemical Corporation; China National Offshore Oil Corporation; and Shaanxi Yanchang Petroleum: 各省、自治区、直辖市生态环境厅(局),新疆生产建设兵团生态环境局,中国石油天然气集团有限公司,中国石油化工集团有限公司,中国海洋石油集团有限公司,陕西延长石油(集团)有限责任公司:
For the purposes of implementing Xi Jinping Thought on Ecological Civilization, carrying out the spirit of the important instructions on oil and gas exploration and development given by General Secretary Xi Jinping, advancing the coordination between oil and gas development and ecological and environmental protection, deepening the reform of “simplifying procedures, decentralizing powers, combining decentralization with appropriate control, and optimizing services” with respect to environmental impact assessment in the oil and gas industry, and contributing to effectively preventing and controlling pollution, you are hereby notified of further strengthening the management of environmental impact assessment in the oil and gas industry as follows: 为贯彻习近平生态文明思想,落实习近平总书记关于油气勘探开发的重要批示精神,推进石油天然气开发与生态环境保护相协调,深化石油天然气行业环评“放管服”改革,助力打好污染防治攻坚战,现就进一步加强石油天然气行业环评管理工作通知如下。
I. Advancing planning environmental impact assessment   一、推进规划环境影响评价
1. All relevant entities shall prepare chapters or notes covering environmental impacts in accordance with law when preparing comprehensive plans or special guiding plans, such as oil and gas development plans; and when special plans related to oil and gas development are prepared, plan environmental impact reports shall be prepared according to law and submitted to the ecology and environment authority for examination to be convened in accordance with the law. The conclusions and examination opinions of the plan environmental impact assessment shall be used as an important basis for plan approval and related project environmental impact assessment, the materials for and results of plan environmental impact assessment may be shared with project environmental impact assessment, and project environmental impact assessment may be simplified in light of the actual circumstances. (一)各有关单位编制油气发展规划等综合规划或指导性专项规划,应当依法同步编制环境影响篇章或说明;编制油气开发相关专项规划,应当依法同步编制规划环境影响报告书,报送生态环境主管部门依法召集审查。规划环评结论和审查意见,应当作为规划审批决策和相关项目环评的重要依据,规划环评资料和成果可与项目环评共享,项目环评可结合实际简化。
2. When preparing an internal special plan related to oil and gas development, an oil and gas enterprise shall be encouraged to concurrently prepare a plan of environmental impact report, focus on analyzing the cumulative and long-term environmental impacts of the implementation of the plan, propose countermeasures to prevent and mitigate adverse environmental impacts, organize expert justification on its own, and report relevant results to the provincial ecology and environment authority, or to the Ministry of Ecology and Environment and its corresponding watershed or sea area ecology and environment administration, in the case of offshore oil and gas development. (二)油气企业在编制内部相关油气开发专项规划时,鼓励同步编制规划环境影响报告书,重点就规划实施的累积性、长期性环境影响进行分析,提出预防和减轻不良环境影响的对策措施,自行组织专家论证,相关成果向省级生态环境主管部门通报。涉及海洋油气开发的,应当通报生态环境部及其相应流域海域生态环境监督管理局。
3. A plan environmental impact assessment shall, in light of such requirements as the resource and environment characteristics of the oil and gas development areas, plans for main functional areas, nature reserves, and control by the ecological protection red line, effectively maintain the integrity and stability of the ecosystem, specify development-prohibited areas and the restrictive resource environment factors of the implementation of the plans, put forward recommendations for optimizing the layout, scale, methods, and construction sequence of the development of oil and gas resources, reasonably determine development plans, and specify countermeasures to prevent and mitigate adverse environmental impacts. The control requirements of the “three lines and one list” (ecological protection red line, environmental quality bottom line, resource utilization ceiling line, and ecological and environmental access list) shall be strictly implemented, and for shale gas and other exploitation, the ceiling on the utilization of water resources for the implementation of plans shall be specified. If a protected area or ecological protection red line is related, its control requirements shall also be met. In an area where the total key pollutant discharges exceed the total quantity control indicators as specified by the state or the region, the planning of a new oil and gas development project that discharges the key pollutant shall be suspended. The arrangement of development projects in geological structure areas with material risks of groundwater pollution shall be prudential, and if development is compellingly needed, the environmental feasibility of the implementation of plans shall be thoroughly justified, with strict environmental risk prevention measures being taken. (三)规划环评应当结合油气开发区域的资源环境特征、主体功能区规划、自然保护地、生态保护红线管控等要求,切实维护生态系统完整性和稳定性,明确禁止开发区域和规划实施的资源环境制约因素,提出油气资源开发布局、规模、开发方式、建设时序等优化建议,合理确定开发方案,明确预防和减轻不良环境影响的对策措施。严格落实“三线一单”(生态保护红线,环境质量底线,资源利用上线,生态环境准入清单)管控要求,页岩气等开采应当明确规划实施的水资源利用上限。涉及自然保护地、生态保护红线的,还应当符合其管控要求。在重点污染物排放总量超过国家或者地方规定的总量控制指标区域内,应当暂停规划新增排放该重点污染物的油气开发项目。在具有重大地下水污染风险的地质构造区域布局开发项目应当慎重,确需开发的,应当深入论证规划实施的环境可行性,采取严格的环境风险防范措施。
II. Deepening the reform of “simplifying procedures, decentralizing powers, combining decentralization with appropriate control, and optimizing services” with respect to project environment impact assessment   二、深化项目环评“放管服”改革
4. For oil and gas exploitation projects (including new and rolling development projects), an environment impact assessment shall, in principle, be conducted in blocks (hereinafter referred to as the “block environment impact assessment”), generally covering new wells, infill wells, adjustment wells, yards, equipment, pipelines and cables and their replacement works, abandonment works, and ancillary works, among others, proposed in the blocks. For a project environmental impact assessment, a thorough assessment shall be made with respect to the environmental impacts and the environmental risks brought about by the construction and operation of the project and effective measures shall be proposed for ecological and environmental protection and environmental risk prevention. The environmental impact assessment document of a rolling development block capacity building project shall also retroactively assess the environmental impacts of existing works and propose effective measures for the prevention and control of existing ecological and environmental problems and hidden environmental risks. If other prevention and control facilities are relied on, or disposal is commissioned from a third party, their feasibility and effectiveness shall be justified. (四)油气开采项目(含新开发和滚动开发项目)原则上应当以区块为单位开展环评(以下简称区块环评),一般包括区块内拟建的新井、加密井、调整井、站场、设备、管道和电缆及其更换工程、弃置工程及配套工程等。项目环评应当深入评价项目建设、运营带来的环境影响和环境风险,提出有效的生态环境保护和环境风险防范措施。滚动开发区块产能建设项目环评文件中还应对现有工程环境影响进行回顾性评价,对存在的生态环境问题和环境风险隐患提出有效防治措施。依托其他防治设施的或者委托第三方处置的,应当论证其可行性和有效性。
5. For the construction of any exploration well in a new onshore oil and gas exploration block in relation to which the scale of capacity building has not been determined, an environmental impact report form shall be prepared in accordance with the law. For offshore oil and gas exploration works, an environmental impact registration form shall be submitted to make a filing. After the scale of capacity building has been determined, no single-well environmental impact assessment may continue to be conducted in the name of exploration in principle. An exploration well converted into a production well may be included in the block environmental impact assessment. As from January 1, 2021, no single-well environmental impact assessment shall be conducted, as is a general principle. During the transitional period, a project owner may apply for approval of a block environmental impact assessment or single-well environmental impact assessment based on actual circumstances. For the adjustment well projects of offshore oil and gas development works for which environmental impact assessment approval has been obtained before the issuance of this Notice and which are neither situated in a marine ecology and environment-sensitive area nor included in the environmental impact assessment of oil and gas exploitation block capacity building project, whose discharges are not in excess of the total discharges permitted by the original environmental impact assessment approval, the management of filing environmental impact registration forms shall be implemented. (五)未确定产能建设规模的陆地油气开采新区块,建设勘探井应当依法编制环境影响报告表。海洋油气勘探工程应当填报环境影响登记表并进行备案。确定产能建设规模后,原则上不得以勘探名义继续开展单井环评。勘探井转为生产井的,可以纳入区块环评。自2021年1月1日起,原则上不以单井形式开展环评。过渡期间,项目建设单位可以根据实际情况,报批区块环评或单井环评。在本通知印发前已经取得环评批复、不在海洋生态环境敏感区内、未纳入油气开采区块产能建设项目环评且排污量未超出原环评批复排放总量的海洋油气开发工程调整井项目,实施环境影响登记表备案管理。
6. When approving a block environmental impact assessment, an ecology and environment authority shall not set or retain prerequisites in violation of legal provisions such as the pre-examination of soil and water conservation and planned siting and land use (sea use) and pre-examination by industry or lower ecology and environment authorities. When a nature reserve, drinking water source protection area, ecological protection red line, or any other statutory protected area is affected, the opinions of the competent authority shall not be used as a prerequisite for environmental impact assessment approval, subject to complying with the laws and regulations. For single works included in a block environmental impact assessment which have not undergone major changes, ecology and environment authorities may not require a repeated construction project environmental impact assessment.

 (六)各级生态环境主管部门在审批区块环评时,不得违规设置或保留水土保持、规划选址用地(用海)预审、行业或下级生态环境主管部门预审等前置条件。涉及自然保护地、饮用水水源保护区、生态保护红线等法定保护区域的,在符合法律法规的前提下,主管部门意见不作为环评审批的前置条件。对于已纳入区块环评且未产生重大变动情形的单项工程,各级生态环境主管部门不得要求重复开展建设项目环评。
