| Chapter I General Provisions | | 第一章 总则 |
| Article 1 For the purposes of regulating the administration of the business permit for express business, and promoting the sound development of the express industry, these Measures are developed according to the Postal Law of the People's Republic of China, the Administrative Licensing Law of the People's Republic of China, the Interim Regulation on Express Delivery, and other laws and administrative regulations. | | 第一条 为了规范快递业务经营许可管理，促进快递业健康发展，根据《中华人民共和国邮政法》《中华人民共和国行政许可法》《快递暂行条例》等法律、行政法规，制定本办法。 |
| Article 2 The application for, approval of, and relevant supervision and administration of the business permit for express business shall be governed by these Measures. | | 第二条 快递业务经营许可的申请、审批以及相关监督管理，适用本办法。 |
| Article 3 The postal administration of the State Council, the postal management institutions of provinces, autonomous regions and municipalities directly under the Central Government, and the postal management institutions at or below the provincial level established according to the provisions of the State Council (hereinafter collectively referred to as “postal administrations”) shall be responsible for the administration of the business permit for express business. | | 第三条 国务院邮政管理部门和省、自治区、直辖市邮政管理机构以及按照国务院规定设立的省级以下邮政管理机构（以下统称邮政管理部门）负责快递业务经营许可管理工作。 |
| Article 4 The administration of the business permit for express business shall be conducted under the principles of openness, fairness, impartiality, convenience and efficiency. | | 第四条 快递业务经营许可管理遵循公开、公平、公正、便民、高效的原则。 |
| The postal administrations shall make full use of computer network, big data and other information technologies, to improve the service efficiency of the administration of the business permit for express business. | | 邮政管理部门应当充分利用计算机网络、大数据等信息技术，提升快递业务经营许可管理服务效能。 |
| Article 5 To carry out express business, an entity or individual shall obtain the business permit for express business according to the law, and accept the supervision and administration of the postal administration and other relevant departments; and no entity or individual may carry out express business without permit. | | 第五条 经营快递业务，应当依法取得快递业务经营许可，并接受邮政管理部门及其他有关部门的监督管理；未经许可，任何单位和个人不得经营快递业务。 |
| Chapter II Application and Acceptance | | 第二章 申请与受理 |
| Article 6 An applicant for the business permit for express business shall comply with the provisions of Article 52 of the Postal Law of the People's Republic of China. | | 第六条 申请快递业务经营许可，应当符合《中华人民共和国邮政法》第五十二条的规定。 |
| Article 7 An applicant for the business permit for express business shall have the following service capabilities: | | 第七条 申请快递业务经营许可，应当具备下列服务能力： |
| (1) It has a service network commensurate with the geographical area and business scope for which an application for operation is filed, and the delivery capability for letters, parcels, presswork and other articles to be delivered (hereinafter collectively referred to as “express mails”). | | （一）与申请经营的地域范围、业务范围相适应的服务网络和信件、包裹、印刷品、其他寄递物品（以下统称快件）的运递能力； |
| (2) It is able to provide business consulting, inquiry by telephone, and information inquiry via Internet for delivery of express mails. | | （二）能够提供寄递快件的业务咨询、电话查询和互联网信息查询服务； |
| (3) It has the premises or facilities commensurate with the geographical area and business scope for which an application for operation is filed, for receiving and delivering express mails. | | （三）收寄、投递快件的，有与申请经营的地域范围、业务范围相适应的场地或者设施； |
| (4) It has the information processing capability commensurate with the geographical area and business scope for which an application for operation is filed and is able to keep the express service information for not less than three years, for carrying out express business via Internet and other information networks. | | （四）通过互联网等信息网络经营快递业务的，有与申请经营的地域范围、业务范围相适应的信息处理能力，能够保存快递服务信息不少于3年； |
| (5) It has closed handling premises with appropriate area for sorting, sealing, sending, storage, exchanging, and transferring, among others, and satisfy the requirements of the postal administrations and the state safety organ for performance of functions according to the law. | | （五）对快件进行分拣、封发、储存、交换、转运等处理的，有封闭的、面积适宜的处理场地，配置相应的设备，且符合邮政管理部门和国家安全机关依法履行职责的要求。 |
| An applicant specializing in receipt and delivery services of express mails in provinces, autonomous regions, and municipalities directly under the Central Government shall have the service capacity prescribed from item (1) to (4) of the preceding paragraph; and shall also enter into written agreements or letters of intent with enterprises carrying out express business with which it cooperates. | | 在省、自治区、直辖市范围内专门从事快件收寄、投递服务的，应当具备前款第一项至第四项的服务能力；还应当与所合作的经营快递业务的企业签订书面协议或者意向书。 |
| Article 8 An applicant for the business permit for express business shall have the following service quality management systems and business operation specifications: | | 第八条 申请快递业务经营许可，应当具备下列服务质量管理制度和业务操作规范： |
| (1) the service commitment publicity management system for service types, service time limit, and service prices, among others; | | （一）服务种类、服务时限、服务价格等服务承诺公示管理制度； |
| (2) the management system for complaint acceptance methods and compensation methods, among others; and | | （二）投诉受理办法、赔偿办法等管理制度； |
| (3) the operation specifications for business inquiry, receipt, sorting, and delivery, among others. | | （三）业务查询、收寄、分拣、投递等操作规范。 |
| Article 9 An applicant for the business permit for express business shall, according to the business scope for which an application for operation is filed, have the following security guarantee systems and measures: | | 第九条 申请快递业务经营许可，根据其申请经营的业务范围，应当具备下列安全保障制度和措施： |
| (1) the guarantee systems for the safety of practitioners, and user information security, among others; | | （一）从业人员安全、用户信息安全等保障制度； |
| (2) the emergency plans; | | （二）突发事件应急预案； |
| (3) the systems for inspection of receipt and delivery, real-name receipt and delivery, among others; | | （三）收寄验视、实名收寄等制度； |
| (4) the safety inspection system for express mails; | | （四）快件安全检查制度； |
| (5) being equipped with monitoring, security inspection and other facilities and equipment in compliance with the provisions of the state; | | （五）配备符合国家规定的监控、安检等设备设施； |
| (6) being equipped with unified computer management system and data interface in compliance with the provisions of the postal administration, and being able to provide relevant data on express services; | | （六）配备统一的计算机管理系统，配置符合邮政管理部门规定的数据接口，能够提供快递服务有关数据； |
| (7) the technical measures for monitoring and recording the operating status of the computer management system; and | | （七）监测、记录计算机管理系统运行状态的技术措施； |
| (8) the backup and encryption measures for express service information and data. | | （八）快递服务信息数据备份和加密措施。 |
| Article 10 An applicant for carrying out international express business shall be able to provide relevant departments with the customs declaration data for delivery of express mails, and its handling premises, facilities and equipment at airports, import and export ports, and other places under customs supervision and administration shall satisfy the requirements of the Customs for performance of functions according to the law. | | 第十条 申请经营国际快递业务的，还应当能够向有关部门提供寄递快件的报关数据，位于机场和进出口岸等属于海关监管的处理场地、设施、设备应当符合海关依法履行职责的要求。 |
| Article 11 An applicant for the business permit for express business shall file the following materials with the postal administration as prescribed in paragraph 1 of Article 53 of the Postal Law of the People's Republic of China: | | 第十一条 申请快递业务经营许可，应当向《中华人民共和国邮政法》第五十三条第一款规定的邮政管理部门提交下列材料： |
| (1) the application for express business permit; | | （一）快递业务经营许可申请书； |
| (2) the materials for the pre-approval of enterprise name or the business license for an enterprise legal person; | | （二）企业名称预先核准材料或者企业法人营业执照； |
| (3) the explanations on its compliance with the conditions prescribed from Article 7 to 10 of these Measures; and | | （三）符合本办法第七条至第十条规定条件的情况说明； |
(4) other materials proscribed by laws and administrative regulations.
