| According to the actual needs of Shanghai's judicial reform and the trial work, with the approval of the Supreme People's Court, the Higher People's Court of Shanghai Municipality has decided to adjust the centralized jurisdiction over cases involving intellectual property rights, administrative cases and criminal cases involving minors of the grassroots courts within this Municipality. The relevant matters are hereby announced as follows: | | 根据上海司法改革和审判工作实际需要，经最高人民法院批准，上海市高级人民法院决定调整本市基层法院知识产权案件、行政案件和未成年人刑事案件的集中管辖。现将有关事项公告如下： |
| I. Cases involving Intellectual Property Rights | | 一、知识产权案件 |
| (1) The cases involving intellectual property rights of the courts in Shanghai shall be tried through the “Three in One” approach of civil, administrative and criminal cases. Civil cases involving intellectual property rights include civil dispute cases involving copyrights, trademark rights, patent rights, technology contracts, trade secrets, new varieties of plants, integrated circuit layout designs, or other intellectual property rights or involving unfair competition, monopoly, or franchise contracts, among others; administrative cases involving intellectual property rights include administrative dispute cases filed by the parties against the administrative actions taken by the administrative agencies in respect of copyrights, trademark rights, patent rights, or other intellectual property rights, unfair competition or production or sale of fake or shoddy commodities, among others; and criminal cases involving intellectual property rights include criminal cases as provided for in Section 1 “Crimes of Manufacturing and Selling Fake and Shoddy Goods” and in Section 7 “Crimes of Infringing Upon Intellectual Property Rights,” Chapter III: Crimes of Undermining the Order of Socialist Market Economy, Specific Provisions of the Criminal Law of the People's Republic of China. | | （一）上海法院知识产权案件实行民事、行政、刑事“三合一”审判机制。其中，知识产权民事案件包括涉及著作权、商标权、专利权、技术合同、商业秘密、植物新品种和集成电路布图设计等知识产权以及不正当竞争、垄断、特许经营合同等民事纠纷案件； 知识产权行政案件包括当事人对行政机关就著作权、商标权、专利权等知识产权、不正当竞争以及生产、销售伪劣商品等所作出的行政行为不服提起的行政纠纷案件； 知识产权刑事案件包括 《中华人民共和国刑法》 分则第三章“破坏社会主义市场经济秩序罪”第一节“生产、销售伪劣商品罪" 规定的刑事犯罪案件和第七节”侵犯知识产权罪" 规定的刑事犯罪案件。 |
| (2) The cases involving intellectual property rights accepted by grassroots people's courts shall be subject to the relatively centralized jurisdiction, and shall be tried by People's Courts of Pudong New Area, Xuhui District, Yangpu District and Putuo District, Shanghai Municipality. | | （二）基层人民法院受理的知识产权案件实行相对集中管辖，由上海市浦东新区、徐汇区、杨浦区、普陀区人民法院负责审理。 |
| The People's Court of Pudong New Area shall have jurisdiction over cases involving intellectual property rights as the court of the first instance within Pudong New Area; the People's Court of Xuhui District shall have jurisdiction over cases involving intellectual property rights as the court of the first instance within Xuhui District, Changning District, Minhang District, Fengxian District, Songjiang District and Jinshan District; the People's Court of Yangpu District shall have jurisdiction over cases involving intellectual property rights as the court of the first instance within Yangpu District, Huangpu District, Hongkou District, Baoshan District and Chongming District; and the People's Court of Putuo District shall have jurisdiction over cases involving intellectual property rights as the court of the first instance within Putuo District, Jing'an District, Jiading District and Qingpu District. | | 浦东新区人民法院管辖浦东新区内的第一审知识产权案件； 徐汇区人民法院管辖徐汇区、长宁区、闵行区、奉贤区、松江区、金山区内的第一审知识产权案件； 杨浦区人民法院管辖杨浦区、黄浦区、虹口区、宝山区、崇明区内的第一审知识产权案件； 普陀区人民法院管辖普陀区、静安区、嘉定区、青浦区内的第一审知识产权案件。 |
| (3) The scope of jurisdiction and hierarchical jurisdiction of civil cases involving intellectual property rights of the courts in Shanghai shall be governed by the Provisions of the Higher People's Court of Shanghai Municipality on Adjusting the Jurisdiction of Courts in Shanghai Municipality over Civil Cases involving Intellectual Property Rights (No. 35 [2016], Higher People's Court of Shanghai Municipality). | | （三）上海法院知识产权民事案件管辖范围和级别管辖按照沪高法 〔2016〕35号 《上海市高级人民法院关于调整本市法院知识产权民事案件管辖的规定》 执行。 |
| (4) Grassroots people's courts shall have jurisdiction over the first-instance administrative cases involving intellectual property rights filed by the parties against the administrative actions taken by the administrative agencies in respect of intellectual property rights, unfair competition and production or sale of fake or shoddy commodities, among others (excluding first-instance administrative cases over which intellectual property right courts have jurisdiction). | | （四）基层人民法院管辖当事人对行政机关就知识产权，不正当竞争，生产、销售伪劣商品等作出的行政行为提起的第一审知识产权行政案件（知识产权法院管辖的第一审行政案件除外）。 |
| The Shanghai Intellectual Property Court shall have jurisdiction over the following administrative cases involving intellectual property rights: (a) First-instance administrative cases involving patents, new varieties of plants, integrated circuit layout designs, know-how, computer software, and monopoly, among others. (b) First-instance administrative cases filed against the administrative actions taken by the people' courts at or above the district level in respect of intellectual property rights or unfair competition. (c) Cases of appeals filed against the administrative judgments or rulings on intellectual property rights rendered by grassroots people's courts as courts of first instance. | | 上海知识产权法院管辖下列知识产权行政案件：1、专利、植物新品种、集成电路布图设计、技术秘密、计算机软件、垄断等第一审行政案件；2、对区以上人民政府所作的涉及知识产权、不正当竞争行政行为提起诉讼的第一审行政案件；3、对基层人民法院作出的第一审知识产权行政判决、裁定提起上诉的案件。 |
| The Higher People's Court of Shanghai Municipality shall have jurisdiction over the cases of appeals filed against the administrative judgments or rulings on intellectual property rights rendered by the Shanghai Intellectual Property Court as court of first instance. | | 上海市高级人民法院管辖对上海知识产权法院作出的第一审知识产权行政判决、裁定提起上诉的案件。 |
The jurisdiction over administrative retrial petition cases involving intellectual property rights shall be determined in accordance with the provisions of the Administrative Litigation Law of the People's Republic of China.
