| Measures for the Administration of Construction Permits for Construction Projects | | 建筑工程施工许可管理办法 |
| Article 1 To strengthen the supervision and administration of construction activities, maintain the normal order of the construction market, and guarantee the quality and safety of construction projects, these Measures are developed in accordance with the Construction Law of the People's Republic of China. | | 第一条 为了加强对建筑活动的监督管理，维护建筑市场秩序，保证建筑工程的质量和安全，根据《中华人民共和国建筑法》，制定本办法。 |
| Article 2 For the construction, renovation and decoration of all kinds of buildings and the auxiliary facilities thereof, the installation of supporting lines, pipes and equipment, and the construction of municipal infrastructure projects in cities and towns, the construction entity shall, before starting construction, apply to the housing and urban-rural development administrative department of the people's government at or above the county level (hereinafter referred to as “permit-issuing authority”) where the project is located for a construction permit in accordance with these Measures. | | 第二条 在中华人民共和国境内从事各类房屋建筑及其附属设施的建造、装修装饰和与其配套的线路、管道、设备的安装，以及城镇市政基础设施工程的施工，建设单位在开工前应当依照本办法的规定，向工程所在地的县级以上地方人民政府住房城乡建设主管部门（以下简称发证机关）申请领取施工许可证。 |
| For a construction project whose investment is less than 300,000 yuan or whose construction area is less than 300 square meters, the construction entity may be allowed not to apply for a construction permit. The housing and urban-rural development administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government may, in accordance with the specific circumstances of their respective regions, adjust the limits and report to the housing and urban-rural development administrative department under the State Council for recordation. | | 工程投资额在30万元以下或者建筑面积在300平方米以下的建筑工程，可以不申请办理施工许可证。省、自治区、直辖市人民政府住房城乡建设主管部门可以根据当地的实际情况，对限额进行调整，并报国务院住房城乡建设主管部门备案。 |
| For a construction project whose construction commencement report has been approved according to the powers and procedures as prescribed by the State Council, the construction entity is not required to apply for a construction permit. | | 按照国务院规定的权限和程序批准开工报告的建筑工程，不再领取施工许可证。 |
| Article 3 If no permit has been obtained for a construction project for which a construction permit must be obtained as required by these Measures, its construction may not be started. | | 第三条 本办法规定应当申请领取施工许可证的建筑工程未取得施工许可证的，一律不得开工。 |
| No entity or individual may dismember a construction project for which a construction permit must be obtained into a number of construction projects below the limits for the purpose of shunning the requirement of applying for construction permits. | | 任何单位和个人不得将应当申请领取施工许可证的工程项目分解为若干限额以下的工程项目，规避申请领取施工许可证。 |
| Article 4 A construction entity that applies for a construction permit shall satisfy the following conditions and submit relevant certification documents: | | 第四条 建设单位申请领取施工许可证，应当具备下列条件，并提交相应的证明文件： |
| (1) It has obtained approval for use of land for the project if it is legally required. | | （一）依法应当办理用地批准手续的，已经办理该建筑工程用地批准手续。 |
| (2) It has obtained a construction project planning permit if the construction project is located in the planning area of a city or town. | | （二）在城市、镇规划区的建筑工程，已经取得建设工程规划许可证。 |
| (3) The construction site has basically met the conditions for starting construction; where any building needs to be expropriated, the expropriation process meets the construction needs. | | （三）施工场地已经基本具备施工条件，需要征收房屋的，其进度符合施工要求。 |
| (4) It has decided the enterprise to undertake the construction. The decision on the enterprise that is to undertake the construction shall be invalid if the construction is contracted without bidding or public bidding when it is legally required, the construction is contracted by way of dismembering, or the construction is contracted to enterprises without required qualifications. | | （四）已经确定施工企业。按照规定应当招标的工程没有招标，应当公开招标的工程没有公开招标，或者肢解发包工程，以及将工程发包给不具备相应资质条件的企业的，所确定的施工企业无效。 |
| (5) It has technical materials that satisfy the construction needs, and the construction drawing design documents have passed examination as required. | | （五）有满足施工需要的技术资料，施工图设计文件已按规定审查合格。 |
| (6) It has concrete measures for guaranteeing the quality and safety of the construction. The construction organization design made by the enterprise undertaking the construction has incorporated technical measures for guaranteeing the quality and safety of the construction that are peculiar to the construction project. A construction quality and safety responsibility system has been established, and responsibilities have been assigned to individuals. If the project is fairly specialized, special quality and safety construction organization designs have been made, and the construction quality and safety supervision procedures have been undergone as required. | | （六）有保证工程质量和安全的具体措施。施工企业编制的施工组织设计中有根据建筑工程特点制定的相应质量、安全技术措施。建立工程质量安全责任制并落实到人。专业性较强的工程项目编制了专项质量、安全施工组织设计，并按照规定办理了工程质量、安全监督手续。 |
| (7) It has entrusted a supervisory agency where supervision is required. | | （七）按照规定应当委托监理的工程已委托监理。 |
(8) It has raised enough funds for the construction. Generally, if the construction duration is less than a year, the funds received shall not be less than 50% of the total contract value; if the duration is longer than a year, the funds received shall not be less than 30% of the total contract value. The construction entity shall provide a letter of commitment that it has no default on construction payments by the date of application or any other document that suffices to prove that it has no default on construction payments in any way, and a certificate issued by a bank on the amount of funds already received. Where it is possible, it may provide a letter of guaranty for payment issued by a bank or any other third-party guaranty.
．．．．．． | | （八）建设资金已经落实。建设工期不足一年的，到位资金原则上不得少于工程合同价的50％，建设工期超过一年的，到位资金原则上不得少于工程合同价的30％。建设单位应当提供本单位截至申请之日无拖欠工程款情形的承诺书或者能够表明其无拖欠工程款情形的其他材料，以及银行出具的到位资金证明，有条件的可以实行银行付款保函或者其他第三方担保。
