For the purposes of thoroughly studying and implementing the Xi Jinping Thought on Socialism with Chinese Characteristics in a New Era and the spirit of the 19th CPC National Congress, advancing the building of a credit system in the e-commerce field, resolving the prominent problem of a lack of faith, and carrying out the spirit of the Video Conference on the Special Campaign against Bad Faith Problems in the E-commerce Field on October 27, 2017, you are hereby notified of the work on further strengthening the special campaign against the bad faith problems in the e-commerce field (hereinafter referred to as the "special campaign"): 为深入学习贯彻习近平新时代中国特色社会主义思想和党的十九大精神,推进电子商务领域信用体系建设,解决突出的诚信缺失问题,落实2017年10月27日电子商务领域失信问题专项治理工作视频会议精神,现就进一步加强电子商务领域失信问题专项治理工作(以下简称“专项治理工作”)通知如下:
I. Fully understanding the significance of carrying out the special campaign   一、充分认识开展专项治理工作的重要意义
The building of a credit system in the e-commerce field is an important part of the building of a social credit system. In June 2014, the Notice of the State Council on Issuing the Outline of the Social Credit System Building Plan (2014-2020) (No. 21 [2014], State Council) made express requirements for the credit building in the e-commerce field with the aim of tightening the quality inspection of the products of online stores and strictly investigating and punishing the production and sale of counterfeits, pyramid schemes, false advertising, shoddy goods, service breaches, and other frauds in the e-commerce field; and combating the conduct of internal and external collusion and the falsification of traffic and goodwill and establishing a system of prohibiting access to industries for unfaithful entities. The National Development and Reform Commission, the People's Bank of China, the Office of the Central Cyberspace Affairs Commission, the Ministry of Public Security, the Ministry of Transport, the Ministry of Commerce, the State Administration for Industry and Commerce, the General Administration of Quality Supervision, Inspection and Quarantine, and the China Food and Drug Administration jointly issued the Guiding Opinions on Comprehensively Strengthening Good Faith Construction in the E-commerce Field (No. 2794 [2016], the NDRC) made further requirements with respect to strictly combating illegal and unfaithful conduct of fabricating trading records and logistics information by false trading in bad faith, comments in bad faith, consignment on behalf of empty mail parcels, and other means so as to achieve "credit upgrading" or "credit downgrading." Carrying out the special campaign is an important measure to comprehensively implement the Xi Jinping Thought on Socialism with Chinese Characteristics in a New Era and the spirit of the 19th CPC National Congress and execute the Guiding Opinions on Comprehensively Strengthening Good Faith Construction in the E-commerce Field (No. 2794 [2016], the NDRC), a significant means to tighten interim and ex-post regulation in the e-commerce field, and is of great significance for creating a good e-commerce ecology and environment and promoting the building of a social credit system. 电子商务领域信用体系建设是社会信用体系建设的重要内容。2014年6月,《国务院关于印发社会信用体系建设规划纲要(2014-2020年)的通知》(国发〔2014〕21号),对电子商务领域信用建设提出明确要求,加强网店产品质量检查,严厉查处电子商务领域制假售假、传销活动、虚假广告、以次充好、服务违约等欺诈行为;打击内外勾结、伪造流量和商业信誉的行为,对失信主体建立行业限期禁入制度。国家发展改革委、人民银行、中央网信办、公安部、交通部、商务部、工商总局、质检总局、食品药品监管总局联合印发的《关于全面加强电子商务领域诚信建设的指导意见》(发改财金〔2016〕2794号),进一步指出严厉打击通过恶意刷单、恶意评价、空包裹代发邮寄等方式伪造交易记录和物流信息实现“增信”“降信”的违法失信行为。开展专项治理工作,是全面贯彻习近平新时代中国特色社会主义思想和党的十九大精神,落实《关于全面加强电子商务领域诚信建设的指导意见》(发改财金〔2016〕2794号)的重要举措,也是加强电子商务领域事中事后监管的重要手段,对创造良好的电子商务生态环境、推动社会信用体系建设具有重要意义。
II. Accelerating the establishment and improvement of a permanent working mechanism for the special campaign   二、加快建立健全专项治理长效工作机制
The special campaign is not only a systematic work but also a long-term work. The relevant departments in all regions shall focus on strengthening the work in the following three aspects and carry out the campaign on a long-time basis. 专项治理工作既是一项系统性工作,也是一项长期性工作,各地区相关部门要着重加强以下三项工作,并长效开展下去。
1. Consolidating departmental resources and establishing and improving inter-departmental and cross-regional working mechanisms. (一)整合部门资源,建立健全跨部门跨地区工作机制。
The departments leading the building of a social credit system in all regions shall take the lead in establishing inter-departmental and cross-regional working mechanisms, and as required at the Video Conference on the Special Campaign against Bad Faith Problems in the E-commerce Field, the provincial departments leading the building of a social credit system shall, in conjunction with provincial offices of cybersecurity affairs commissions, industry and information technology departments, communications administrations, public security departments, transport departments, post bureaus, commerce departments, Customs offices (former inspection and quarantine bureaus), administrations for commerce and industry, quality supervision bureaus (market regulatory departments), and food and drug administrations (subject to the decision by local governments as needed for the work), among others, establish a provincial work group for the special campaign against bad faith in the e-commerce field (hereinafter referred to as the "provincial task force"), specify lead entities and the responsible persons and liaisons of relevant departments, carry out a thematic research on the bad faith problems in the e-commerce field within their respective jurisdictions, and put forward targeted measures and work plans. Provincial task forces shall be encouraged to guide relevant municipal and county departments in establishing a municipal and county task force for the special campaign against bad faith problems in the e-commerce field; and all provincial-level task forces shall be encouraged to cross-conduct cross-regional cooperation, exchange, inspection, and mutual assessment.

 各地社会信用体系建设牵头部门要牵头建立跨部门跨地区工作机制,根据国家电子商务领域失信问题专项治理工作视频会要求,由省社会信用体系建设牵头部门会同省网信办、工业和信息化主管部门、通信管理局、公安厅、交通厅、邮政局、商务厅、海关(原检验检疫局)、工商局、质监局(市场监督管理部门)和食品药品监管局(或由地方根据工作需要决定)等,建立省级电子商务领域失信问题专项治理工作组(以下简称“省级工作组”),明确牵头单位以及各相关部门负责人和联络员,就本辖区内电子商务领域失信问题进行专项研究,并提出有针对性的措施和工作方案。鼓励省级工作组指导市、县级有关部门建立市、县级电子商务领域失信问题专项治理工作组;鼓励各省级工作组交叉开展跨地区合作交流和检查互评。
