| In order to timely and effectively safeguard the lawful rights and interests of all parties, maintain judicial fairness, further standardize the ordered retrial of a civil case and the remanding of a civil case for retrial, and improve the trial supervision quality and efficiency, these Provisions are developed in accordance with the Civil Procedure Law of the People's Republic of China and in light of the trial practice. | | 为了及时有效维护各方当事人的合法权益，维护司法公正，进一步规范民事案件指令再审和再审发回重审，提高审判监督质量和效率，根据《中华人民共和国民事诉讼法》，结合审判实际，制定本规定。 |
| Article 1 The people's court at a higher level shall examine any party's petition for retrial in strict accordance with the provisions of Article 200 of the Civil Procedure Law. If the petition for retrial meets the statutory conditions, the people's court at a higher level shall issue a ruling to retry the case. The people's court at a higher level may not lower the standards for initiating retrial due to the ordered retrial and may not order the people's court at a lower level to retry the case that should not be retried according to the law due to the repeated petitions of the party. | | 第一条 上级人民法院应当严格依照民事诉讼法第二百条等规定审查当事人的再审申请，符合法定条件的，裁定再审。不得因指令再审而降低再审启动标准，也不得因当事人反复申诉将依法不应当再审的案件指令下级人民法院再审。 |
| Article 2 The case that is ruled to be retried upon petition of any party shall generally be tried by the people's court that issues the ruling to retry the case. Under any of the following circumstances, the Supreme People's Court or a higher people's court may order the original people's court to retry the case: | | 第二条 因当事人申请裁定再审的案件一般应当由裁定再审的人民法院审理。有下列情形之一的，最高人民法院、高级人民法院可以指令原审人民法院再审： |
| (1) The retrial is ruled in accordance with the provisions of item (4), (5), or (9) of Article 200 of the Civil Procedure Law. | | （一）依据民事诉讼法第二百条第（四）项、第（五）项或者第（九）项裁定再审的； |
| (2) The effective judgment, ruling, or mediation paper is issued by the court of first instance. | | （二）发生法律效力的判决、裁定、调解书是由第一审法院作出的； |
| (3) The parties on one side are numerous or both parties are citizens. | | （三）当事人一方人数众多或者当事人双方为公民的； |
(4) Other circumstances as decided upon deliberation by the Judicial Committee.
