The Shanghai Head Office of the People's Bank of China ("PBC"), all branches and operations offices of the PBC, all central sub-branches of the PBC in the capital cities of provinces (or autonomous regions), and the central sub-branch of the PBC in Shenzhen; China Development Bank; all policy banks, state-owned commercial banks, and joint-stock commercial banks; Postal Savings Bank of China; China UnionPay Co., Ltd.; Payment & Clearing Association of China; NetsUnion Clearing Corporation; and all non-banking payment institutions: 中国人民银行上海总部,各分行、营业管理部,各省会(首府)城市中心支行,深圳市中心支行;国家开发银行,各政策性银行、国有商业银行、股份制商业银行,中国邮政储蓄银行;中国银联股份有限公司,中国支付清算协会,网联清算有限公司;各非银行支付机构:
For the purposes of effectively coping with and preventing new situation and problems of new types of telecommunications and online illegal and criminal activities and protecting the property safety and lawful rights and interests of the public, matters concerning further strengthening administration of payment and settlement are hereby announced as follows: 为有效应对和防范电信网络新型违法犯罪新形势和新问题,保护人民群众财产安全和合法权益,现就进一步加强支付结算管理有关事项通知如下:
I. Improving the emergency payment stoppage and quick account freezing mechanism   一、健全紧急止付和快速冻结机制
1. Accurately feeding back reference numbers. As from June 1, 2019, banking financial institutions (hereinafter referred to as the "banks") and non-banking payment institutions (hereinafter referred to as the "payment institutions") shall comply with the following provisions when accepting information requests from the public security authorities through the transaction risk event management platform for new types of telecommunications and online illegal and criminal activities (hereinafter referred to as the "management platform"): (一)准确反馈交易流水号。自2019年6月1日起,银行业金融机构(以下简称银行)和非银行支付机构(以下简称支付机构)在受理公安机关通过电信网络新型违法犯罪交易风险事件管理平台(以下简称管理平台)发起的查询业务时,应当执行下列规定:
(1) For a bank account-related online payment business initiated by a payment institution, the bank shall accurately provide the reference number sent by the clearing institution corresponding to the business as required by the message from the management platform (see Annex for specific rules). 1.对于支付机构发起涉及银行账户的网络支付业务,银行应当按照管理平台报文要求,准确提供该笔业务对应的由清算机构发送的交易流水号(具体规则见附件)。
(2) A payment institution shall support access to the information relating to corresponding business based on the reference number sent by the clearing institution and provide feedback as required by the message from the management platform. 2.支付机构应当支持根据清算机构发送的交易流水号查询对应业务的相关信息,并按照管理平台报文要求反馈。
2. Strengthening the administration of requests for information, payment stoppage and freezing of the accounts involved. If a request for information, payment stoppage or freezing of an account involved made by the public security authority through the management platform is in compliance with the laws, regulations and relevant provisions, the bank and the payment institution shall immediately handle it and promptly provide feedback. A bank or payment institution shall establish a 24/7 emergency contact mechanism for requests for information, payment stoppage, and freezing of the accounts involved, adopt shift work, and submit the names, contact information and other information of the emergency contacts to the public security authority in the place where its legal person is located before April 1, 2019. In the event of change in an emergency contact, a new submission shall be made within one working day of the change. (二)强化涉案账户查询、止付、冻结管理。对于公安机关通过管理平台发起的涉案账户查询、止付和冻结业务,符合法律法规和相关规定的,银行和支付机构应当立即办理并及时反馈。银行和支付机构应当建立涉案账户查询、止付、冻结7×24小时紧急联系人机制,设置AB角,并于2019年4月1日前将紧急联系人姓名、联系方式等信息报送法人所在地公安机关。紧急联系人发生变更的,应当于变更之日起1个工作日内重新报送。
II. Strengthening account management under the real-name system   二、加强账户实名制管理
3. Strengthening review in the opening of institutional payment accounts. A payment institution shall, when opening a payment account for an entity, strictly review the authenticity, completeness and compliance of the entity's supporting documents for the opening and the consistency between the account opening applicant and the owner of the supporting documents, verify the willingness of the legal representative or person in charge of the entity to open an account, and retain relevant work records. The payment institution may verify the willingness of the legal representative or person in charge of the entity face to face, by video meeting, or otherwise, at the option of the payment institution based on the customer's risk rating. (三)加强单位支付账户开户审核。支付机构为单位开立支付账户应当严格审核单位开户证明文件的真实性、完整性和合规性,开户申请人与开户证明文件所属人的一致性,并向单位法定代表人或负责人核实开户意愿,留存相关工作记录。支付机构可采取面对面、视频等方式向单位法定代表人或负责人核实开户意愿,具体方式由支付机构根据客户风险评级情况确定。
If the entity falls within the circumstances indicating the abnormality in the opening of an account, the payment institution shall adopt measures such as extending the period for review of the opening and strengthening customer due diligence in accordance with anti-money laundering and other provisions and reject the opening of an account if necessary. 单位存在异常开户情形的,支付机构应当按照反洗钱等规定采取延长开户审核期限、强化客户尽职调查等措施,必要时应当拒绝开户。
4. Verifying existing institutional payment accounts. A payment institution shall, in accordance with the requirements for review of the opening of accounts in Article II. 3 of this Notice, verify the implementation of the real-name system as to all existing institutional payment accounts. If the failure of the institutional payment account to conform to the requirements of the real-name system is discovered in the verification, or the verification of implementation of the real-name system is impossible, all the transactions through the payment account shall be suspended, and no new payment account shall be opened for the relevant entity; and if an account is suspected of being related to any new types of telecommunications and online illegal and criminal activities, a report shall be immediately made to the public security authority. A payment institution shall prepare a verification plan before April 1, 2019 and complete the verification work before June 30, 2019. (四)开展存量单位支付账户核实。支付机构应当按照本通知第三项规定的开户审核要求,开展全部存量单位支付账户实名制落实情况核实工作。核实中发现单位支付账户未落实实名制要求或者无法核实实名制落实情况的,应当中止其支付账户所有业务,且不得为其新开立支付账户;发现疑似电信网络新型违法犯罪涉案账户的,应当立即报告公安机关。支付机构应当于 2019年4月1日前制定核实计划,于2019年6月30日前完成核实工作。
5. Improving the security management of payment account passwords. A payment institution shall improve the security management of the business such as customers' change of payment account login passwords and payment passwords, and shall not provide customers with services such as changing payment account login passwords, payment passwords and reserved mobile phone number only by verifying the information on a bank account linked to the payment accounts. (五)完善支付账户密码安全管理。支付机构应当完善客户修改支付账户登录密码、支付密码等业务的安全管理,不得仅凭验证支付账号绑定银行账户信息即为客户办理修改支付账户登录密码、支付密码和预留手机号码等业务。
6. Improving the risk management of institutional customers. A payment institution shall improve the risk rating management system of institutional customers and reasonably set a total quota for payment with balance of all the payment accounts of the same entity based on its risk rating and make dynamic adjustments. (六)健全单位客户风险管理。支付机构应当健全单位客户风险评级管理制度,根据单位客户风险评级,合理设置并动态调整同一单位所有支付账户余额付款总限额。
If a payment institution discovers the suspicious transaction characteristics of an institutional payment account, it shall verify the customer's identity face to face, by video meeting, or otherwise, examine suspicious transactions, and adopt relevant measures in accordance with the relevant provisions on anti-money laundering if the suspicion is established, or suspend all the transactions through the payment account if verification is impossible; and if the legal representative, person in charge or handling person of the entity that has an account involved referred by the public security authority has opened other institutional payment accounts, such other institutional payment accounts shall be verified as priorities. 支付机构发现单位支付账户存在可疑交易特征的,应当采取面对面、视频等方式重新核实客户身份,甄别可疑交易行为,确属可疑的,应当按照反洗钱有关规定采取相关措施,无法核实的,应当中止该支付账户所有业务;对公安机关移送涉案账户的开户单位法定代表人或负责人、经办人员开立的其他单位支付账户,应当重点核实。
7. Optimizing services for changing and closing individual bank accounts. As from June 1, 2019, a bank shall provide individuals with account change and closure services across different business outlets of any of its domestic branch offices. (七)优化个人银行账户变更和撤销服务。自2019年6月1日起,银行应当为个人提供境内分支机构跨网点办理账户变更和撤销服务。
8. Establishing an undertaking mechanism for lawfully opening and using accounts. As from June 1, 2019, a bank or payment institution shall, when opening an account for its customer, manifestly inform the customer of legal liability and disciplinary actions relating to renting, lending, selling, and purchasing accounts in the account opening application, service agreement or the interface to enter information for opening an account, specify the following statement: "I (or the entity) have (has) a full understanding and clear knowledge of legal liability and disciplinary actions relating to renting, lending, selling, and purchasing accounts and undertake(s) to open and use my (the entity's) account in accordance with the laws and regulations" and request the confirmation from the customer. (八)建立合法开立和使用账户承诺机制。自2019年6月1日起,银行和支付机构为客户开立账户时,应当在开户申请书、服务协议或开户申请信息填写界面醒目告知客户出租、出借、出售、购买账户的相关法律责任和惩戒措施,并载明以下语句:“本人(单位)充分了解并清楚知晓出租、出借、出售、购买账户的相关法律责任和惩戒措施,承诺依法依规开立和使用本人(单位)账户”,由客户确认。
9. Increasing efforts in punishing trading in bank accounts and payment accounts and opening accounts by fraudulently using another person's identity. As from April 1, 2019, with respect to an entity, individual or related organizer that is determined by the public security authority at or above the level of districted city to rent, lend, sell, or purchase bank accounts (including bank cards) or payment accounts, or an entity or individual that opens a bank account or payment account by fraudulently using another person' identity or falsifying a principal-agent relationship, a bank or payment institution shall suspend the non-counter bank account transactions or all payment account transactions for five years, and may not open a new account for it or him within the same period. If, at the expiration of the period for disciplinary action, the entity or individual receiving the disciplinary action institutes the business to open a new account, the bank or payment institution shall increase review efforts. The PBC shall refer the information of the aforesaid entity or individual to the National Financial Credit Information Basic Database and release it to the public. (九)加大买卖银行账户和支付账户、冒名开户惩戒力度。自2019年4月1日起,银行和支付机构对经设区的市级及以上公安机关认定的出租、出借、出售、购买银行账户(含银行卡)或者支付账户的单位和个人及相关组织者,假冒他人身份或者虚构代理关系开立银行账户或者支付账户的单位和个人,5年内暂停其银行账户非柜面业务、支付账户所有业务,并不得为其新开立账户。惩戒期满后,受惩戒的单位和个人办理新开立账户业务的,银行和支付机构应加大审核力度。人民银行将上述单位和个人信息移送金融信用信息基础数据库并向社会公布。
III. Strengthening transfer management   三、加强转账管理
10. Specifying information on non-real time money transfers. As from June 1, 2019, if a customer selects non-real time money transfer service such as standard transfer and next-day transfer, the bank or payment institution shall unequivocally specify in the acknowledgment of the transaction or the interface that the transfer is made in a non-real time manner. (十)载明非实时到账信息。自2019年6月1日起,对于客户选择普通到账、次日到账等非实时到账的转账业务的,银行和支付机构应当在办理结果回执或界面明确载明该笔转账业务非实时到账。
11. Improving the management of transfers through automated teller machine ("ATM"). A bank may, when providing service for an individual through ATM, display payee's name, account number, amount of the transfer, and other information (names shall be subject to desensitization) in Chinese language on the transfer acceptance interface (including the foreign-language interface), unequivocally indicate in Chinese language that the transfer will be completed in a real-time manner, and request confirmation from the customer. Cases which meet the aforesaid requirements can be exempted from the provisions that money transfers on ATMs shall be completed 24 hours after acceptance as set forth in Article II.8 of the Notice by the People's Bank of China of Matters concerning Strengthening the Administration of Payment and Settlement to Prevent New-Type Telecommunications and Online Illegal and Criminal Activities (No. 261 [2016], PBC). Banks are encouraged to apply multi-factor identity authentication methods such as biometrics identification to ATM and actively explore payment services combining safety and facilitation.

 (十一)改进自助柜员机转账管理。银行通过自助柜员机为个人办理业务时,可在转账受理界面(含外文界面)以中文显示收款人姓名、账号和转账金额等信息(姓名应当脱敏处理),并以中文明确提示该业务实时到账,由客户确认。符合上述要求的,可不再执行《中国人民银行关于加强支付结算管理 防范电信网络新型违法犯罪有关事项的通知》(银发〔2016〕261号)第八项关于自助柜员机转账24小时后到账的规定。鼓励银行在自助柜员机应用生物特征识别等多因素身份认证方式,积极探索兼顾安全与便捷的支付服务。
