| Article 1 To further deepen the openness of procuratorial affairs, enhance transparency in the handling of criminal appeal cases, accept social supervision, ensure case handling quality, promote the resolution of social contradictions, protect the appellant's legal rights and interests and improve law enforcement credibility, these Provisions have been formulated in accordance with the Criminal Procedure Law of the People's Republic of China, the Provisions on the Review of Criminal Appeal Cases by the People's Procuratorates and other relevant laws and provisions and in light of the actual circumstances of the procuratorial work on criminal appeals. | | 第一条 为了进一步深化检务公开，增强办理刑事申诉案件透明度，接受社会监督，保证办案质量，促进社会矛盾化解，维护申诉人的合法权益，提高执法公信力，根据《中华人民共和国刑事诉讼法》、《人民检察院复查刑事申诉案件规定》等有关法律和规定，结合刑事申诉检察工作实际，制定本规定。 |

| Article 2 For the purpose of these Provisions, “public examination” means that, as needed for case handling, the people's procuratorates legally and impartially handle criminal appeal cases filed against the handling decisions of procuratorial organs in the form of public hearing and other public forms. | | 第二条 本规定所称公开审查是人民检察院在办理不服检察机关处理决定的刑事申诉案件过程中，根据办案工作需要，采取公开听证以及其他公开形式，依法公正处理案件的活动。 |

| Article 3 A people's procuratorate shall conduct the public examination of criminal appeal cases under the following principles: | | 第三条 人民检察院公开审查刑事申诉案件应当遵循下列原则： |
| |
|
| 1. legality, openness and impartiality; | | （一）依法、公开、公正； |
| |
|
| 2. protection of the legal rights and interests of the parties concerned; | | （二）维护当事人合法权益； |
| |
|
| 3. maintenance of the state's legal authority; and | | （三）维护国家法制权威； |
| |
|
| 4. convenience of the appellants and other participants. | | （四）方便申诉人及其他参加人。 |
| |
|
| Article 4 A people's procuratorate shall conduct the public examination of criminal appeal cases in such forms as public hearing, public presentation of evidence, public argumentation and public reply. | | 第四条 人民检察院公开审查刑事申诉案件包括公开听证、公开示证、公开论证和公开答复等形式。 |
One public form may be adopted for one case, and multiple public forms may be adopted for one case. | |
同一案件可以采用一种公开形式，也可以多种公开形式并用。 |

| Article 5 A people's procuratorate may adopt public examination procedures if there is any major dispute on case facts or the application of law, or the case has a significant social impact, except under the following circumstances: | | 第五条 对于案件事实、适用法律存在较大争议，或者有较大社会影响等刑事申诉案件，人民检察院可以适用公开审查程序，但下列情形除外： |

| 1. the case involves national secrets, trade secrets or personal privacy; | | （一）案件涉及国家秘密、商业秘密或者个人隐私的； |
| |
|
| 2. the appellant is unwilling to conduct public examination; | | （二）申诉人不愿意进行公开审查的； |
| |
|
| 3. the crime is committed by a juvenile; or | | （三）未成年人犯罪的； |
| |
|
| 4. any other circumstance under which it is improper to conduct public examination. | | （四）具有其他不适合进行公开审查情形的。 |
| |
|
| Article 6 The procedures for the public examination of criminal appeal cases shall be conducted openly and informants shall be kept confidential. | | 第六条 刑事申诉案件公开审查程序应当公开进行，但应当为举报人保密。 |

| Chapter II Public Examination Participants and their Responsibilities | | 第二章 公开审查的参加人员及责任 |

|
| Article 7 Public examination shall be organized and the presiding procurator shall be designated by the people's procuratorate handling the case. | | 第七条 公开审查活动由承办案件的人民检察院组织并指定主持人。 |
| |
|
| Article 8 To conduct public examination, a people's procuratorate shall, according to the actual circumstances of the case, invite the deputies to the people's congresses, members of the CPPCC committees, the people's supervisors, special prosecutors, expert advisory committee members, the people's mediators, the personnel from the entity where the appellant works, or the residents' committee or villagers' committee at the place of the appellant's residence, experts, scholars or other community members, who are not interested parties in the case, to participate in the public examination. | | 第八条 人民检察院进行公开审查活动应当根据案件具体情况，邀请与案件没有利害关系的人大代表、政协委员、人民监督员、特约检察员、专家咨询委员、人民调解员或者申诉人所在单位、居住地的居民委员会、村民委员会人员以及专家、学者等其他社会人士参加。 |
“Invited personnel” means the personnel that accept the invitation of the people's procuratorate to participate in public examination, and “hearing examiners” means the invited personnel that participate in the hearing. | |
接受人民检察院邀请参加公开审查活动的人员称为受邀人员，参加听证会的受邀人员称为听证员。 |

Article 9 Public examination participants include the case handling personnel, clerk, invited personnel, appellant and the attorney thereof, other parties to the original case and the attorney thereof.
