The Measures for the Administration of Government Procurement of Services, as deliberated and adopted at the first executive meeting of the Ministry of Finance on November 19, 2019, are hereby issued and shall come into force on March 1, 2020. 《政府购买服务管理办法》已经2019年11月19日第一次部务会议审议通过,现予公布,自2020年3月1日起施行。

Chapter I General Provisions 第一章 总则

Article 1 For the purposes of regulating government procurement of services, promoting the transformation of government functions, and improving the supply of public services, these Measures are developed in accordance with the Budget Law of the People's Republic of China, the Government Procurement Law of the People's Republic of China, the Contract Law of the People's Republic of China and other laws and administrative regulations.   第一条 为规范政府购买服务行为,促进转变政府职能,改善公共服务供给,根据《中华人民共和国预算法》、《中华人民共和国政府采购法》、《中华人民共和国合同法》等法律、行政法规的规定,制定本办法。
Article 2 For the purpose of these Measures, “government procurement of services” means that the state organs at all levels transfer the provision of the service items that fall within the scope of their respective functions and are appropriate to be provided by market-oriented means to eligible service providers based on government procurement methods and procedures, and make payments to such service providers according to such factors as service quantity and quality.   第二条 本办法所称政府购买服务,是指各级国家机关将属于自身职责范围且适合通过市场化方式提供的服务事项,按照政府采购方式和程序,交由符合条件的服务供应商承担,并根据服务数量和质量等因素向其支付费用的行为。
Article 3 Government procurement of services shall follow the principles of budgetary constraints, determination of fees based on service items, public selection on a merit basis, good faith, and emphasis on performance.   第三条 政府购买服务应当遵循预算约束、以事定费、公开择优、诚实信用、讲求绩效原则。
Article 4 The Ministry of Finance shall take charge of developing the national government procurement service system, and guiding and supervising the government procurement of services of all regions and all departments.   第四条 财政部负责制定全国性政府购买服务制度,指导和监督各地区、各部门政府购买服务工作。
The finance departments of the local people's government at or above the county level shall be responsible for the administration of government procurement of services of their respective administrative regions. 县级以上地方人民政府财政部门负责本行政区域政府购买服务管理。
Chapter II Purchasers and Providers 

第二章 购买主体和承接主体

Article 5 The state organs at all levels shall be the purchasers in the government procurement of services.   第五条 各级国家机关是政府购买服务的购买主体。
Article 6 Enterprises and social organizations legitimately formed (with the exception of groups and organizations funded by fiscal appropriation), public institutions of public welfare category II and engaged in production and business activities, rural collective economic organizations, basic-level self-governing mass organizations, and eligible individuals may act as providers in the government procurement of services.   第六条 依法成立的企业、社会组织(不含由财政拨款保障的群团组织),公益二类和从事生产经营活动的事业单位,农村集体经济组织,基层群众性自治组织,以及具备条件的个人可以作为政府购买服务的承接主体。
Article 7 Providers in the government procurement of services shall meet the conditions as prescribed by laws and administrative regulations on government procurement.   第七条 政府购买服务的承接主体应当符合政府采购法律、行政法规规定的条件。
Purchasers may specify the specific conditions of providers in light of the peculiarities of the service items purchased, but shall not give differential or discriminatory treatment to providers by setting unreasonable conditions in violation of the laws and administrative regulations on government procurement. 购买主体可以结合购买服务项目的特点规定承接主体的具体条件,但不得违反政府采购法律、行政法规,以不合理的条件对承接主体实行差别待遇或者歧视待遇。
Article 8 Public institutions of public welfare category I and the groups and organizations that use public institution staffing quotas and are funded by fiscal appropriation shall not act as purchasers or providers in the government procurement of services.   第八条 公益一类事业单位、使用事业编制且由财政拨款保障的群团组织,不作为政府购买服务的购买主体和承接主体。
Chapter III Contents and Catalogue of Services Purchased 

第三章 购买内容和目录

Article 9 The content of services purchased by governments shall include public services provided by governments to the public, and auxiliary services required by governments to perform their functions.   第九条 政府购买服务的内容包括政府向社会公众提供的公共服务,以及政府履职所需辅助性服务。
Article 10 The following items shall not be included in the scope of services purchased by governments:   第十条 以下各项不得纳入政府购买服务范围:
(1) Service items that are not within the scope of government functions. (一)不属于政府职责范围的服务事项;
(2) Service items which governments shall directly perform their functions to provide. (二)应当由政府直接履职的事项;
(3) The goods and engineering projects purchased by governments according to laws and administrative regulations, and items that package engineering projects and services. (三)政府采购法律、行政法规规定的货物和工程,以及将工程和服务打包的项目;
(4) Financing activities. (四)融资行为;
(5) Recruitment and employment of the personnel of purchasers, employment by means of labor dispatch, establishment of public welfare posts, and other items. (五)购买主体的人员招、聘用,以劳务派遣方式用工,以及设置公益性岗位等事项;
(6) Other items which may not be used as content of services purchased by governments according to laws, administrative regulations and the provisions issued by the State Council. (六)法律、行政法规以及国务院规定的其他不得作为政府购买服务内容的事项。
Article 11 The specific scope and content of services purchased by governments shall be subject to the administration of guiding catalogues, which shall be made public.   第十一条 政府购买服务的具体范围和内容实行指导性目录管理,指导性目录依法予以公开。
Article 12 The guiding catalogues for government procurement of services shall be subject to hierarchical administration at the central and provincial levels. The Ministry of Finance and the provincial finance departments shall respectively develop their respective guiding catalogues for procurement of services by governments at the same level, and all departments shall prepare their respective guiding catalogues for government procurement of services within the scope of the guiding catalogues at the same level.

   第十二条 政府购买服务指导性目录在中央和省两级实行分级管理,财政部和省级财政部门分别制定本级政府购买服务指导性目录,各部门在本级指导性目录范围内编制本部门政府购买服务指导性目录。
