| The Decision of the Standing Committee of the National People's Congress to Amend Seven Laws Including the Labor Law of the People's Republic of China, as adopted at the 7th Session of the Standing Committee of the Thirteenth National People's Congress of the People's Republic of China on December 29, 2018, is hereby issued, and shall come into force on the date of issuance. | | 《全国人民代表大会常务委员会关于修改＜中华人民共和国劳动法＞等七部法律的决定》已由中华人民共和国第十三届全国人民代表大会常务委员会第七次会议于2018年12月29日通过，现予公布，自公布之日起施行。 |

| As decided at the 7th Session of the Standing Committee of the Thirteenth National People's Congress: | | 第十三届全国人民代表大会常务委员会第七次会议决定： |
| I. The Labor Law of the People's Republic of China is amended as follows: | | 一、对《中华人民共和国劳动法》作出修改 |
| (1) In paragraph 2 of Article 15, “must undergo approval formalities in accordance with the relevant provisions of the state” is replaced with “must comply with the relevant provisions of the state.” | | （一）将第十五条第二款中的“必须依照国家有关规定，履行审批手续”修改为“必须遵守国家有关规定”。 |
| (2) In Article 69, “examination and appraisal institutions approved by the government” is replaced with “examination and appraisal institutions granted recordation.” | | （二）将第六十九条中的“由经过政府批准的考核鉴定机构”修改为“由经备案的考核鉴定机构”。 |
| (3) In Article 94, “administrative department for industry and commerce” is replaced with “market regulatory department.” | | （三）将第九十四条中的“工商行政管理部门”修改为“市场监督管理部门”。 |
| II. The Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly is amended as follows: | | 二、对《中华人民共和国老年人权益保障法》作出修改 |
| (1) Article 43 is deleted. | | （一）删去第四十三条。 |
| (2) Article 44 is renumbered as Article 43 and amended to read: “To form a public welfare elderly care institution, corresponding registration formalities shall be undergone in accordance with the law. | | （二）将第四十四条改为第四十三条，修改为：“设立公益性养老机构，应当依法办理相应的登记。 |
| “To form a for-profit elderly care institution, registration formalities shall be undergone at the market regulatory department. | | “设立经营性养老机构，应当在市场监督管理部门办理登记。 |
| “An elderly care institution may conduct service activities after registration, and it shall undergo recordation formalities at the civil affairs department of the people's government at or above the county level.” | | “养老机构登记后即可开展服务活动，并向县级以上人民政府民政部门备案。” |
| (3) One article is added as Article 44: “Local people's governments at all levels shall strengthen the leadership of the administration of elderly care institutions in their administrative regions and establish the rules for the comprehensive supervision of elderly care institutions. | | （三）增加一条，作为第四十四条：“地方各级人民政府加强对本行政区域养老机构管理工作的领导，建立养老机构综合监管制度。 |
| “The civil affairs department of the people's government at or above the county level shall be responsible for the guidance, supervision and administration of elderly care institutions, and other relevant departments shall conduct the supervision of elderly care institutions according to their division of functions.” | | “县级以上人民政府民政部门负责养老机构的指导、监督和管理，其他有关部门依照职责分工对养老机构实施监督。” |
| (4) One article is added as Article 45: “The civil affairs department of the people's government at or above the county level shall perform supervision and inspection functions in accordance with the law and may take the following measures: | | （四）增加一条，作为第四十五条：“县级以上人民政府民政部门依法履行监督检查职责，可以采取下列措施： |
| “(1) Obtaining relevant information from elderly care institutions and individuals. | | “（一）向养老机构和个人了解情况； |
| “(2) Entering the elderly care institution suspected of any violation of law to conduct on-site inspection. | | “（二）进入涉嫌违法的养老机构进行现场检查； |
| “(3) Reviewing or copying relevant contracts, bills, account books and other relevant materials. | | “（三）查阅或者复制有关合同、票据、账簿及其他有关资料； |
| “(4) Where it is found that the elderly care institution has any risk that may endanger personal health and life and property safety, it shall be ordered to take corrective action within a prescribed time limit, and if it fails to do so, it shall be ordered to suspend business operation for rectification. | | “（四）发现养老机构存在可能危及人身健康和生命财产安全风险的，责令限期改正，逾期不改正的，责令停业整顿。 |
| “The civil affairs department of the people's government at or above the county level which investigates the suspected violation of law of an elderly care institution shall comply with the provisions of the Administrative Compulsion Law of the People's Republic of China and other relevant laws and administrative regulations.” | | “县级以上人民政府民政部门调查养老机构涉嫌违法的行为，应当遵守《中华人民共和国行政强制法》和其他有关法律、行政法规的规定。” |
| (5) Article 78 is deleted. | | （五）删去第七十八条。 |
| III. The Law of the People's Republic of China on the Prevention and Control of Pollution from Environmental Noise is amended as follows: | | 三、对《中华人民共和国环境噪声污染防治法》作出修改 |
| (1) In Article 6, paragraph 1 of Article 10, Article 11, paragraph 2 of Article 13, Article 15, paragraph 3 of Article 17, Article 20, paragraph 1 of Article 21, paragraph 1 of Article 24, Article 29, Article 42, Article 49, Article 50, Article 51, paragraph 2 of Article 52, Article 55, Article 56, Article 59, paragraph 2 of Article 60, and paragraph 2 of Article 61, “environmental protection administrative department” is replaced with “administrative department of ecology and environment.” | | （一）将第六条、第十条第一款、第十一条、第十三条第二款、第十五条、第十七条第三款、第二十条、第二十一条第一款、第二十四条第一款、第二十九条、第四十二条、第四十九条、第五十条、第五十一条、第五十二条第二款、第五十五条、第五十六条、第五十九条、第六十条第二款、第六十一条第二款中的“环境保护行政主管部门”修改为“生态环境主管部门”。 |
| (2) In paragraph 2 of Article 14, “be subject to final inspection by the environment protection administrative department that originally approved the environmental impact report” is replaced with “conduct final inspection according to the standards and procedures prescribed by the state.” | | （二）将第十四条第二款中的“经原审批环境影响报告书的环境保护行政主管部门验收”修改为“按照国家规定的标准和程序进行验收”。 |
| (3) In paragraph 1 of Article 43, “administrative department for industry and commerce” is replaced with “market regulatory department.” | | （三）将第四十三条第一款中的“工商行政管理部门”修改为“市场监督管理部门”。 |
| (4) In Article 48, “the environmental protection administrative department that approves the environmental impact report of the construction project shall order it to cease production or use, and may concurrently impose a fine on it” is replaced with “the administrative department of ecology and environment at or above the county level shall order it to take corrective action within a prescribed time limit and impose a fine on the entity and individual. If any major environmental pollution or ecological damage is caused, the violator shall be ordered to cease production or use, or shall be ordered to close down with the approval of the people's government with the approval authority.” | | （四）将第四十八条中的“由批准该建设项目的环境影响报告书的环境保护行政主管部门责令停止生产或者使用，可以并处罚款”修改为“由县级以上生态环境主管部门责令限期改正，并对单位和个人处以罚款；造成重大环境污染或者生态破坏的，责令停止生产或者使用，或者报经有批准权的人民政府批准，责令关闭”。 |
