广播电视视频点播业务管理办法

(Order No. 35 of the State Administration of Radio, Film and Television on July 6, 2004, revised in accordance with the Decision on Revising Some Rules and Regulatory Documents on August 28, 2015) (2004年7月6日 国家广播电影电视总局令第35号 根据2015年8月28日《关于修订部分规章和规范性文件的决定》修订)

Chapter I General Provisions 

第一章 总则

Article 1 These Measures are developed for the purposes of promoting the sound development of radio and television (“TV”) video-on-demand services, strengthening supervision and administration, and promoting the construction of socialist spiritual civilization.   第一条 为促进广播电视视频点播业务健康发展,加强监督管理,促进社会主义精神文明建设,制定本办法。
Article 2 For the purpose of these Measures, radio and television video-on-demand (hereinafter referred to as “VOD”) means the business activity of providing users with the radio and TV programs available for users to select by themselves through the radio and TV technical system in the forms of real-time VOD, Near VOD (carousel), playing after downloading and other VOD forms.   第二条 本办法所称的广播电视视频点播(以下简称视频点播),是指通过广播电视技术系统以实时点播、准视频点播(轮播)、下载播放等点播形式供用户自主选择收看广播电视节目的业务活动。
Article 3 The State Administration of Radio, Film and Television (hereinafter referred to as the SARFT) shall be responsible for the administration of VOD services throughout the country, develop the overall planning for VOD services throughout the country, and determine the total quantity and distribution of institutions launching VOD services.   第三条 国家广播电影电视总局(以下简称广电总局)负责全国视频点播业务的管理,制定全国视频点播业务总体规划,确定视频点播开办机构的总量、布局。
The local radio and TV administrative departments at or above the county level shall be responsible for the administration of VOD services within their respective jurisdictions. 县级以上地方广播电视行政部门负责本辖区内视频点播业务的管理。
Article 4 The state shall implement the licensing system for VOD services. Without permission, no institution or individual may launch any VOD service.   第四条 国家对视频点播业务实行许可制度。未经许可,任何机构和个人均不得开办视频点播业务。
Wholly foreign-owned institutions, Chinese-foreign equity joint ventures and Chinese-foreign contractual joint ventures are prohibited from applying for launching VOD services, unless they comply with paragraph 1 of Article 8 of these Measures. 禁止外商独资、中外合资、中外合作机构申请开办视频点播业务,但符合本办法第八条第一款的除外。
Chapter II Business Permit 

第二章 业务许可

Article 5 An institution intending to launch VOD services shall obtain a Permit for Radio and TV Video-on-Demand Services.   第五条 开办视频点播业务须取得《广播电视视频点播业务许可证》。
Article 6 The Permit for Radio and TV Video-on-Demand Services shall be classified into Categories A and B.   第六条 《广播电视视频点播业务许可证》分为甲、乙两种。
An institution that holds a Permit for Radio and TV Video-on-Demand Services (Category A) may engage in video-on-demand services within the administrative region as specified in the Permit. 持有《广播电视视频点播业务许可证(甲种)》的机构,可在许可证载明的行政区域内从事视频点播业务。
An institution that holds a Permit for Radio and TV Video-on-Demand Services (Category B) may engage in video-on-demand services in the hotels as specified in the Permit. 持有《广播电视视频点播业务许可证(乙种)》的机构,可在许可证载明的宾馆饭店内从事视频点播业务。
Article 7 The following institutions may apply for a Permit for Radio and TV Video-on-Demand Services (Category A):   第七条 下列机构可以申请《广播电视视频点播业务许可证(甲种)》:
(1) The radio stations and TV stations at or above the prefecture (city) level established upon approval. (一)经批准设立的地(市)级以上广播电台、电视台;
(2) The radio, film and TV groups (headquarters) established upon approval. (二)经批准设立的广播影视集团(总台)。
Article 8 The following institutions may apply for a Permit for Radio and TV Video-on-Demand Services (Category B):   第八条 下列机构可以申请《广播电视视频点播业务许可证(乙种)》:
(1) Three-star or above hotels, or those equivalent to three-star or above hotels. (一)三星级以上或相当于三星级以上的宾馆饭店;
(2) The institutions that are able to provide ten or more three-star or above hotels or those equivalent to three-star or above hotels with VOD services. (二)具有同时为10家以上三星级或相当于三星级以上的宾馆饭店提供视频点播业务能力的机构。
Article 9 An applicant for a Permit for Radio and TV Video-on-Demand Services shall meet the following conditions:   第九条 申请《广播电视视频点播业务许可证》必须具备以下条件:
(1) Conforming to the overall planning for national VOD services. (一)符合国家视频点播业务总体规划;
(2) Having the program resources that meet the relevant provisions of these Measures. (二)有符合本办法规定的节目资源;
(3) Having the site, technologies, personnel, and other conditions commensurate with the scale of the VOD services launched. (三)具备与视频点播业务开办规模相适应的场所、技术、人员等条件;
(4) Using systems and equipment that conform to the national and industry technical standards. (四)所使用的系统和设备符合国家和行业技术标准;
(5) Having sound program content examination system and broadcasting management system. (五)有健全的节目内容审查制度、播出管理制度;
(6) Having a well-determined scope of transmission. (六)有确定的传播范围;
(7) Having the credit standing and service capacity commensurate with the VOD services launched. (七)具备与开办视频点播业务相适应的信誉和服务能力;
(8) Having a plan for achieving the networking with the monitoring system of the radio and TV administrative department. (八)有与广播电视行政部门监控系统实现联网的方案;
(9) Other conditions as provided by laws and administrative regulations. (九)其它法律、行政法规规定的条件。
Article 10 An applicant for a Permit for Radio and TV Video-on-Demand Services shall submit the following materials:   第十条感觉黑人都特别团结 申请《广播电视视频点播业务许可证》的,须提交以下材料:
(1) An application report covering the category of the Permit (Category A or Category B) applied for, the way of transmission (real-time VOD, Near VOD, or playing after downloading), and scope of broadcasting, among others. (一)申请报告,内容应包括:申请许可证类别(甲种、乙种)、传播方式(实时点播、准视频点播、下载播放)、播放范围等;
(2) An application form for a Permit for Radio and TV Video-on-Demand Services. (二)《广播电视视频点播业务许可证》申请表;
(3) The program launch plan, technical plan, operating plan and management system for engaging in radio and TV video-on-demand services. (三)从事广播电视视频点播业务的节目开办方案、技术方案、运营方案、管理制度;
(4) The monitoring plan on providing the regulatory department of the government with monitoring signals. (四)向政府监管部门提供监控信号的监控方案;
(5) A brief introduction to the persons in charge and certification materials on the equipment and site. (五)主管人员简要情况介绍和设备、场所的证明资料。
An applicant for a Permit for Radio and TV Video-on-Demand Services (Category B) shall also submit the business license and relevant certificates on the star rating of the hotel. If a non-hotel institution applies for a Permit for Radio and TV Video-on-Demand Services (Category B), it shall also submit the articles of association of the company, and the hotel's written document on permitting its engaging in VOD services within the hotel. 申请《广播电视视频点播业务许可证(乙种)》的,还应提交营业执照和宾馆饭店星级评定的相关证明;其中,由宾馆饭店以外的机构申请《广播电视视频点播业务许可证(乙种)》的,还需要提交公司章程以及宾馆饭店同意在其宾馆饭店从事视频点播业务的书面文件。
Article 11 An applicant for a Permit for Radio and TV Video-on-Demand Services (Category A) shall file an application with the local radio and TV administrative department and submit the application materials that conform to the provisions of Article 10. Upon examination level by level, the application materials shall be submitted to the SARFT for approval.   第十一条 申请《广播电视视频点播业务许可证(甲种)》的,应向当地广播电视行政部门提出申请,并提交符合第十条规定的申报材料。经逐级审核后,报广电总局审批。
The SARFT shall examine the application materials. If they pass the examination, the SARFT shall organize the relevant experts to make demonstration for 30 days. The SARFT shall make a decision on the basis of the demonstration conclusion. If the applicant institution meets the relevant requirements, the SARFT shall issue a Permit for Radio and TV Video-on-Demand Services (Category A) to it. If the applicant institution doesn't meet the relevant requirements, the SARFT shall notify it in writing and give the reasons therefor. 广电总局对申报材料进行审核,审核合格的,组织有关专家进行论证,论证期限为三十日。广电总局根据论证结论做出决定,符合条件的,颁发《广播电视视频点播业务许可证(甲种)》;不符合条件的,书面通知申办机构并说明理由。
Article 12 An applicant for a Permit for Radio and TV Video-on-Demand Services (Category B) shall file an application with the local radio and TV administrative department at or above the county level, and submit the application materials that meet the provisions of Article 10. Upon examination level by level, these application materials shall be submitted to the provincial radio and TV administrative department for approval.   第十二条 申请《广播电视视频点播业务许可证(乙种)》,应向当地县级以上广播电视行政部门提出申请,并提交符合第十条规定的申报材料。经逐级审核后,报省级广播电视行政部门审批。
The provincial radio and TV administrative department shall examine the application materials. If they pass the examination, the applicant institution may install the VOD equipment. After the completion of the installation of the equipment, the provincial radio and TV administrative department shall organize an acceptance check, make a decision according to the acceptance check conclusion. If the relevant requirements are satisfied, it shall issue the applicant institution a Permit for Radio and TV Video-on-Demand Services (Category B), and, within 90 days, report to the SARFT for recordation. If the requirements are not satisfied, it shall notify the applicant institution in writing and give the reasons therefor. 省级广播电视行政部门对申报材料进行审核,审核合格的,申办机构可以安装视频点播设备。设备安装完毕,省级广播电视行政部门组织验收,根据验收结论做出决定,符合条件的,颁发《广播电视视频点播业务许可证(乙种)》,并在九十日内报广电总局备案;不符合条件的,书面通知申办机构并说明理由。
Article 13 A radio and TV administrative department which is responsible for acceptance of applications for a Permit shall, according to the time limit and power as prescribed in the Administrative License Law, perform the acceptance and examination functions.   第十三条 负责受理的广播电视行政部门应按照行政许可法规定的期限和权限,履行受理、审核职责。
Article 14 A Permit for Radio and TV Video-on-Demand Services shall be valid for three years, which shall start from the date of issuance. If, upon the expiration of the valid period, the holder of the Permit needs to continue to operate VOD services, it shall, six months prior to the expiration, undergo the renewal formalities under the approval procedures as prescribed by these Measures.   第十四条 《广播电视视频点播业务许可证》有效期为三年,自颁发之日起计算。有效期届满,需继续经营视频点播业务的,应于期满前六个月按本办法规定的审批程序办理续办手续。
Article 15 A business launch institution shall start VOD within 90 days after it obtains a Permit for Radio and TV Video-on-Demand Services. If it is unable to do so on schedule for any special reason, it shall obtain the approval of the permit issuing organ; otherwise it shall be deemed to have terminated the business.   第十五条 开办机构应在领取《广播电视视频点播业务许可证》之后九十日内开播。如因特殊理由不能如期开播,应经发证机关同意,否则按终止业务处理。
Article 16 Where an institution which holds a Permit for Radio and TV Video-on-Demand Services needs to terminate the business, it shall file an application with the original permit issuing organ 60 days in advance. Its Permit for Radio and TV Video-on-Demand Services shall be announced as cancelled by the original permit issuing organ.   第十六条 持有《广播电视视频点播业务许可证》的机构需终止业务的,应提前六十日向原发证机关申报,其《广播电视视频点播业务许可证》由原发证机关予以公告注销。
Article 17 A Permit for Radio and TV Video-on-Demand Services shall state the subject, scope, program category, transmission mode and other items related to the business to be launched.   第十七条 《广播电视视频点播业务许可证》包含开办主体、开办范围、节目类别、传送方式等项目。
A business launch institution shall engage in VOD services according to the items as stated in the Permit. 开办机构必须按照许可证载明的事项从事视频点播业务。
Article 18 Where a business launch institution is to change any of the registered items in the Permit, shareholders or proportions of the shares they hold, it shall report to the original permit issuing organ for approval 60 days in advance.   第十八条 开办机构变更许可证登记项目、股东及持股比例的,应提前六十日报原发证机关批准。
Article 19 Where a business launch institution is to change its place of business, legal representative, chief program editor or any other important matter, it shall notify the original permit issuing organ in writing within 30 days.   第十九条 开办机构的营业场所、法定代表人、节目总编等重要事项发生变更,应在三十日内书面告知原发证机关。
Article 20 No hotel may allow any institution without a Permit for Radio and TV Video-on-Demand Services to engage in VOD services in the hotel.   第二十条 宾馆饭店不得允许未获得《广播电视视频点播业务许可证》的机构在其宾馆饭店内从事视频点播业务。
Where a hotel allows another institution, as a business launch subject, to engage in VOD services in the hotel, it shall conduct necessary supervision over the operations of the latter. If it finds any violation of these Measures, it shall stop it and report to the local radio and TV administrative department without delay. 宾馆饭店同意其它机构作为开办主体在本宾馆饭店内从事视频点播业务的,应对其经营活动进行必要的监督。如发现有违反本办法规定行为的,应予以制止并立即报告当地广播电视行政部门。
Chapter III Program Management 

第三章 节目管理

Article 21 A VOD program is prohibited from containing any of the following contents:   第二十一条不能给市场做人工呼吸 视频点播节目禁止载有下列内容:
(1) Those violating the basic principles determined by the Constitution

 (一)反对宪法确定的基本原则的;
(2) Those endangering the unity, sovereignty and territorial integrity of the state. (二)危害国家统一、主权和领土完整的;
(3) Those divulging state secrets, endangering national security, or jeopardizing the honor and interests of the state. (三)泄露国家秘密、危害国家安全或者损害国家荣誉和利益的;
(4) Those instigating ethnic hatred or ethnic discrimination, undermining national solidarity, or infringing upon ethnic customs and habits. (四)煽动民族仇恨、民族歧视,破坏民族团结,或者侵害民族风俗、习惯的;
(5) Those propagating cults or superstition. (五)宣扬邪教、迷信的;
(6) Those disrupting the public order or undermining social stability. (六)扰乱社会秩序,破坏社会稳定的;
(7) Those advocating obscenity, gambling or violence, or instigating crimes. (七)宣扬淫秽、赌博、暴力或者教唆犯罪的;
(8) Those insulting or defaming others, or infringing upon the lawful rights and interests of others. (八)侮辱或者诽谤他人,侵害他人合法权益的;
(9) Those endangering the social morality or the excellent national culture and tradition. (九)危害社会公德或者民族优秀文化传统的;
(10) Any other contents prohibited by the laws, administrative regulations or the provisions of the state. (十)有法律、行政法规和国家规定禁止的其它内容的。
Article 22 The programs prepared for VOD services shall conform to the provisions of the Copyright Law北大法宝,版权所有.   第二十二条 用于视频点播业务的节目,应符合《著作权法》的规定。
Article 23 The programs prepared for VOD services shall be primarily home-made ones.   第二十三条 用于视频点播业务的节目,应以国产节目为主。
Article 24 The import of any foreign film or TV play for VOD shall be reported to the SARFT for review in accordance with the relevant provisions.   第二十四条 引进用于视频点播的境外影视剧,应按有关规定报广电总局审查。
Article 25 The programs prepared for VOD are limited to the following five categories:   第二十五条 用于视频点播的节目限于以下五类:
(1) The films and TV plays that have obtained a TV Play Distribution License and a Permit for Public Projection of Films. (一)取得《电视剧发行许可证》、《电影片公映许可证》的影视剧;
(2) The programs produced or broadcasted by the radio & TV broadcasting institutions legally formed. (二)依法设立的广播电视播出机构制作、播出的节目;
(3) The programs produced by the radio & TV production and operating institutions legally formed. (三)依法设立的广播电视节目制作经营机构制作的节目;
(4) The foreign radio and TV programs examined and approved by the radio and TV administrative department at or above the provincial level. (四)经省级以上广播电视行政部门审查批准的境外广播电视节目;
(5) Weather forecast, stock market quotation and other information programs obtained by legal means. (五)从合法途径取得的天气预报、股票行情等信息类节目。
Article 26 The news or information programs prepared for VOD shall be true and impartial.   第二十六条 用于视频点播的新闻类或信息类节目应真实、公正。
Article 27 A business launch institution shall be equipped with program censors, have a sound program examination system, implement the chief program editor responsibility system, and examine the program contents broadcasted by it. The chief program editor shall possess the necessary business quality and relevant working experience.   第二十七条 开办机构应配备节目审查员,健全节目审查制度,实行节目总编负责制,对其播放的节目内容进行审查。节目总编应具备必要的业务素质和相关的从业经验。
Article 28 The broadcasting front-end of the business launch institution holding a Permit for Radio and TV Video-on-Demand Services (Category A) shall be networked with the monitoring system for VOD services of the SARFT. The broadcasting front-end of the business launch institution holding a Permit for Radio and TV Video-on-Demand Services (Category B) shall be networked with the monitoring system for VOD services of the local radio and TV administrative department.   第二十八条 持有《广播电视视频点播业务许可证(甲种)》开办机构的播出前端应与广电总局视频点播业务监控系统实现联网;持有《广播电视视频点播业务许可证(乙种)》开办机构的播出前端应与所在地广播电视行政部门视频点播业务监控系统实现联网。
Chapter IV Penalty Provisions 

第四章 罚则

Article 29 Where any VOD service is launched without approval in violation of these Measures, the radio and TV administrative department at or above the county level shall ban such service, and impose a fine of not less than CNY10, 000 nor more than CNY30, 000 on the violator; and if it is criminally punishable, the violator shall be held criminally liable in accordance with the law.   第二十九条 违反本办法规定,未经批准,擅自开办视频点播业务的,由县级以上广播电视行政部门予以取缔,可以并处一万元以上三万元以下的罚款;构成犯罪的,依法追究刑事责任。
Article 30 Where any institution commits any of the following acts in violation of these Measures, the radio and TV administrative department at or above the county level shall order it to stop the illegal act, give it a warning, and order it to make rectifications within a prescribed time limit, and may concurrently impose a fine of not more than CNY30, 000 thereon:   第三十条 违反本办法规定,有下列行为之一的,由县级以上广播电视行政部门责令停止违法活动、给予警告、限期整改,可以并处三万元以下的罚款:
(1) Failing to engage in VOD services as stated in the Permit for Radio and TV Video-on-Demand Services. (一)未按《广播电视视频点播业务许可证》载明的事项从事视频点播业务的;
(2) Changing any licensed item, shareholder or proportion of shares it holds, or terminating VOD services without approval. (二)未经批准,擅自变更许可证事项、股东及持股比例或者需终止开办视频点播业务的;
(3) Broadcasting any radio or TV program which doesn't meet the provisions of these Measures. (三)播放不符合本办法规定的广播电视节目的;
(4) Failing to broadcast VOD programs in accordance with the provisions of Articles 21, 24 and 25 of these Measures. (四)未按本办法第二十一条、第二十四条、第二十五条规定播放视频点播节目的;
(5) Failing to notify, within the prescribed time limit, the original permit issuing organ of the important matter that has changed in violation of the provisions of Articles 18 and 19 of these Measures. (五)违反本办法第十八条,第十九条规定,有重要事项发生变更未在规定期限内通知原发证机关的;
(6) Failing to achieve the networking of its broadcasting front-end with the monitoring system of the radio and TV administrative department as required in violation of the provisions of Article 28 of these Measures. (六)违反本办法第二十八条规定,播出前端未按规定与广播电视行政部门监控系统进行联网的。
Article 31 Where a chief program editor or program censor, in violation of these Measures, fails to perform his or her duties, resulting in the appearance of illegal contents for three or more times, the SARFT may give warnings to the relevant responsible persons. A relevant responsible person shall not assume the position of chief program editor or program censor in any institution launching VOD services within three years.   第三十一条 违反本办法规定,节目总编或节目审查员未履行应尽职责,出现三次以上违规内容的,广电总局可以对相关责任人予以警告;相关责任人三年内不得担任视频点播开办机构的节目总编或节目审查员。
Article 32 Where a hotel, in violation of the provisions of Article 20 of these Measures, allows an institution which has not obtained a Permit or Radio and TV Video-on-Demand Services to engage in VOD services within the hotel, the radio and TV administrative department at the county level or above shall give it a warning, and may concurrently impose a fine of not more than CNY30, 000 thereon.   第三十二条 违反本办法第二十条规定,宾馆饭店允许未获得《广播电视视频点播业务许可证》的机构在其宾馆饭店内经营视频点播业务的,由县级以上广播电视行政部门予以警告,可以并处三万元以下罚款。
Chapter V Supplementary Provisions 

第五章 附则

Article 33 An institution that has been granted an approval to engage in VOD services by the radio and TV administrative department prior to the implementation of these Measures shall, within 6 months from the date of implementation of these Measures, apply for replacing its Permit with a new one in accordance with the provisions of these Measures.   第三十三条 本办法施行前经广播电视行政部门批准开办视频点播业务的机构,应自本办法实施之日起六个月内,按照本办法规定申换许可证。
Article 34 These Measures shall come into force on August 10, 2004. The Interim Measures for the Administration of Video on Demand on Cable TV (Order No. 4, SARFT) and the Interim Measures for the Administration of Hotels' Video on Demand (Order No 6, SARFT) issued by the State Administration of Radio, Film and TelevisionV shall be repealed concurrently.   第三十四条 本办法自2004年8月10日起施行。广电总局《有线电视视频点播管理暂行办法》(广电总局令第4号)和《宾馆饭店视频点播管理暂行办法》(广电总局令第6号)同时废止。
