Measures for the Administration of the Examination and Approval of the Use of Woodlands by Construction Projects 

建设项目使用林地审核审批管理办法

(Order No. 35 of the State Forestry Administration on March 30, 2015, and amended by Order No. 42 of the State Forestry Administration on September 22, 2016) (2015年3月30日国家林业局令第35号,2016年9月22日国家林业局令第42号修改)

Article 1 For the purposes of regulating the examination and approval of the use of woodlands by construction projects, strictly protecting and reasonably utilizing woodlands, and promoting the development of the ecological forestry and the livelihood forestry, these Measures are developed in accordance with the Forest Law of the People's Republic of China, the Administrative Licensing Law of the People's Republic of China, and the Regulation on the Implementation of the Forestry Law of the People's Republic of China.   第一条 为了规范建设项目使用林地审核和审批,严格保护和合理利用林地,促进生态林业和民生林业发展,根据《中华人民共和国森林法》、《中华人民共和国行政许可法》、《中华人民共和国森林法实施条例》,制定本办法。
Article 2 For the purpose of these Measures, “use of woodlands by construction projects” means the construction of permanent and temporary buildings and structures on woodlands, and other construction activities that modify the purpose of woodlands, including:   第二条 本办法所称建设项目使用林地,是指在林地上建造永久性、临时性的建筑物、构筑物,以及其他改变林地用途的建设行为。包括:
(1) occupation of woodlands for prospecting, exploiting mineral resources, and various construction projects; (一)进行勘查、开采矿藏和各项建设工程占用林地。
(2) Temporary occupation of woodlands for construction projects; and (二)建设项目临时占用林地。
(3) Occupation of woodlands by forest management entities for the construction of engineering facilities which directly serve the forestry production within the scope of woodlands they manage. (三)森林经营单位在所经营的林地范围内修筑直接为林业生产服务的工程设施占用林地。
Article 3 A construction project shall occupy no or less woodlands. Where it is necessary to use woodlands, woodlands shall be used in a reasonable, economical, and intensive manner in accordance with the woodlands protection and use plan.   第三条 建设项目应当不占或者少占林地,必须使用林地的,应当符合林地保护利用规划,合理和节约集约利用林地。
The use of woodlands by construction projects shall be subject to total amount control and quota management. 建设项目使用林地实行总量控制和定额管理。
The use of woodlands in important ecological zones or fragile ecological regions for construction projects shall be restricted, the use of natural forests and woodlands with high stock volume per unit area shall be restricted, and the use of woodlands for profit-oriented construction projects shall be restricted. 建设项目限制使用生态区位重要和生态脆弱地区的林地,限制使用天然林和单位面积蓄积量高的林地,限制经营性建设项目使用林地。
Article 4 Construction projects that occupy and temporarily occupy woodlands shall comply with the provisions on hierarchical administration of woodlands:   第四条 占用和临时占用林地的建设项目应当遵守林地分级管理的规定:
(1) No level I protected woodland shall be used for various construction projects. (一)各类建设项目不得使用Ⅰ级保护林地。
(2) Protected woodlands of and lower than level II may be used for construction projects approved and agreed by the State Council, as well as the infrastructure, public utilities, and people's livelihood construction projects approved by relevant departments of the State Council, and the people's governments at the provincial level and their relevant departments. (二)国务院批准、同意的建设项目,国务院有关部门和省级人民政府及其有关部门批准的基础设施、公共事业、民生建设项目,可以使用Ⅱ级及其以下保护林地。
(3) Protected woodlands of and lower than level II may be used for national defense and diplomatic construction projects. (三)国防、外交建设项目,可以使用Ⅱ级及其以下保护林地。
(4) Protected woodlands of and lower than level II may be used for infrastructure, public utilities, and people's livelihood construction projects approved by the people's governments of counties (cities or prefectures), districted cities, and autonomous prefectures and their relevant departments. (四)县(市、区)和设区的市、自治州人民政府及其有关部门批准的基础设施、公共事业、民生建设项目,可以使用Ⅱ级及其以下保护林地。
(5) Protected woodlands of and lower than level II may be used for strategic emerging industrial projects, exploration projects, medium- and large-scale mines, and ecotourism development projects in line with the relevant tourism plans. Protected woodlands of and lower than level III may be used for other industrial and mining, storage construction projects, and profit-oriented projects in line with the plans. (五)战略性新兴产业项目、勘查项目、大中型矿山、符合相关旅游规划的生态旅游开发项目,可以使用Ⅱ级及其以下保护林地。其他工矿、仓储建设项目和符合规划的经营性项目,可以使用Ⅲ级及其以下保护林地。
(6) Protected woodlands of and lower than level II may be used for construction projects in line with urban planning and construction projects in line with rural planning. (六)符合城镇规划的建设项目和符合乡村规划的建设项目,可以使用Ⅱ级及其以下保护林地。
(7) Protected woodlands of and lower than level II in natural reserves, forest parks, wetland parks, and scenic spots may be used for the construction projects in line with the planning of natural reserves, forest parks, wetland parks, and scenic spots, among others. (七)符合自然保护区、森林公园、湿地公园、风景名胜区等规划的建设项目,可以使用自然保护区、森林公园、湿地公园、风景名胜区范围内Ⅱ级及其以下保护林地。
(8) The woodlands used for supporting quarries (sand fields) and borrow pits of highway, railway, communication, electric power, oil and gas pipelines and other linear projects, water conservancy and hydropower projects, navigation projects, and other construction projects shall be governed by the scope of woodlands used for primary construction projects. However, forest land in protected woodlands of level II shall not be used. In major state-owned forest areas determined by the State Council (hereinafter referred to as the “major state-owned forest areas”), forest land in protected woodlands of level III or above shall not be used. (八)公路、铁路、通讯、电力、油气管线等线性工程和水利水电、航道工程等建设项目配套的采石(沙)场、取土场使用林地按照主体建设项目使用林地范围执行,但不得使用Ⅱ级保护林地中的有林地。其中,在国务院确定的国家所有的重点林区(以下简称重点国有林区)内,不得使用Ⅲ级以上保护林地中的有林地。
(9) Protected woodlands of level IV may be used for construction projects other than the aforesaid construction projects. (九)上述建设项目以外的其他建设项目可以使用Ⅳ级保护林地。
Level-I national public welfare woodlands shall not be used for the construction projects other than those as prescribed in items (2), (3), and (7), paragraph 1 of this article. 本条第一款第二项、第三项、第七项以外的建设项目使用林地,不得使用一级国家级公益林地。
Where it is otherwise prescribed by the State Forestry Administration for the use of woodlands by specific construction projects according to the special circumstances, these provisions shall be applicable. 国家林业局根据特殊情况对具体建设项目使用林地另有规定的,从其规定。
Article 5 The approval authority for woodlands occupied by construction projects shall be governed by relevant provisions of the Regulation on the Implementation of the Forestry Law of the People's Republic of China.   第五条 建设项目占用林地的审核权限,按照《中华人民共和国森林法实施条例》的有关规定执行。
For woodlands occupied by construction projects, with approval and consent of the competent forestry department, the project owners and individuals shall, under the provisions of the laws and regulations, undergo the formalities of approval for construction land. 建设项目占用林地,经林业主管部门审核同意后,建设单位和个人应当依照法律法规的规定办理建设用地审批手续。
Article 6 The approval authority for woodlands temporarily occupied by construction projects and woodlands occupied by forest management entities for constructing engineering facilities directly serving the forestry production within the scope of woodlands they manage shall be handled by the competent forestry departments of the local people's governments at or above the county level under the relevant provisions of the provinces, autonomous regions, or municipalities directly under the Central Government. Construction projects in major state-owned forest areas shall be approved by competent forestry departments at the provincial level.   第六条 建设项目临时占用林地和森林经营单位在所经营的林地范围内修筑直接为林业生产服务的工程设施占用林地的审批权限,由县级以上地方人民政府林业主管部门按照省、自治区、直辖市有关规定办理。其中,重点国有林区内的建设项目,由省级林业主管部门审批。
Article 7 To file an application for using woodlands, an entity or individual occupying woodlands or temporarily occupying woodlands shall complete an Application Form for the Use of Woodlands and provide the following materials:   第七条 占用林地和临时占用林地的用地单位或者个人提出使用林地申请,应当填写《使用林地申请表》,同时提供下列材料:
(1) The qualification certificate of the entity using land or the identification certificate of the individual using land. (一)用地单位的资质证明或者个人的身份证明。
(2) The relevant approval documents of the construction project. Including: the official reply for the feasibility study report, the official reply on examination and approval, confirmation document for recordation, prospecting license, mining license, preliminary design of the project, and other approval documents. For a project using land in batches, the instructions for the use of land in batches with the consent of relevant people's government shall be provided, together with the planning drawing.

 (二)建设项目有关批准文件。包括:可行性研究报告批复、核准批复、备案确认文件、勘查许可证、采矿许可证、项目初步设计等批准文件;属于批次用地项目,提供经有关人民政府同意的批次用地说明书并附规划图。
