The Measures for the Administration of Examination of Construction Drawing Design Documents for House Building and Municipal Infrastructure Projects, which were discussed and adopted at the 37th executive meeting of the Ministry of Construction on June 29, 2004, are hereby promulgated, and shall come into force on the date of promulgation. | |
《房屋建筑和市政基础设施工程施工图设计文件审查管理办法》已于2004年6月29日经第37次部常务会议讨论通过，现予发布，自公布之日起施行。 |

| Article 1 These Measures are formulated in accordance with the “Regulation on the Administration of the Quality of Construction Projects” and the “Regulation on the Administration of the Survey and Design of Construction Projects” so as to strengthen the administration of examination of the construction drawing design documents of house building projects and municipal infrastructure projects. | |

| | 第一条 为了加强对房屋建筑工程、市政基础设施工程施工图设计文件审查的管理，根据《建设工程质量管理条例》、《建设工程勘察设计管理条例》，制定本办法。 |
| Article 2 Those who engage in examination of construction drawing design documents of house building projects or municipal infrastructure projects or who conduct supervision and administration within the territory of the People's Republic of China must abide by these Measures. | |

| | 第二条 在中华人民共和国境内从事房屋建筑工程、市政基础设施工程施工图设计文件审查和实施监督管理的，必须遵守本办法。 |
| Article 3 The State adopts a system of examination of construction drawing design documents (including survey documents, hereinafter referred to as construction drawings). | |
|
“Examination of construction drawings” as mentioned in these Measures shall mean the examination conducted by a construction drawing examination institution (which is accredited by the construction administrative department, hereinafter referred to as examination institution) on the construction drawings' contents involved in public interests, public security or compulsory standards for project construction in accordance with the relevant laws and regulations. | | 第三条 国家实施施工图设计文件（含勘察文件，以下简称施工图）审查制度。 |
No construction drawing shall be put into use before it is examined to be qualified. | |
本办法所称施工图审查，是指建设主管部门认定的施工图审查机构（以下简称审查机构）按照有关法律、法规，对施工图涉及公共利益、公众安全和工程建设强制性标准的内容进行的审查。 |

施工图未经审查合格的，不得使用。 |
| Article 4 The construction administrative department of the State Council shall take charge of the prescription of the conditions for examination institutions, and the formulation of the measures for the administration of examination of construction drawings, and shall guide and supervise the examination of construction drawings throughout China. | |
|
The construction administrative department of a province, autonomous region, or municipality directly under the Central Government shall take charge of the accreditation of the examination institutions within its own jurisdiction, the supervision and administration of the examination of construction drawings, and shall accept the guidance and supervision of the construction administrative institution of the State Council. | | 第四条 国务院建设主管部门负责规定审查机构的条件、施工图审查工作的管理办法，并对全国的施工图审查工作实施指导、监督。 |
The construction administrative department of a municipal or county people's government shall take charge of the daily supervision and administration of the examination of construction drawings within its own jurisdiction, and shall accept the guidance and supervision of the construction administrative department of the province, autonomous region, or municipality directly under the Central Government. | |
省、自治区、直辖市人民政府建设主管部门负责认定本行政区域内的审查机构，对施工图审查工作实施监督管理，并接受国务院建设主管部门的指导和监督。 |

市、县人民政府建设主管部门负责对本行政区域内的施工图审查工作实施日常监督管理，并接受省、自治区、直辖市人民政府建设主管部门的指导和监督。 |
| Article 5 The construction administrative department of a province, autonomous region, or municipality directly under the Central Government shall, according to the conditions set down by the State for the examination institutions, and in light of the construction scale of its own jurisdiction, accredit a corresponding number of examination institutions. | |
|
An examination institution shall be a non-profit independent legal person. | | 第五条 省、自治区、直辖市人民政府建设主管部门应当按照国家确定的审查机构条件，并结合本行政区域内的建设规模，认定相应数量的审查机构。 |
| |
审查机构是不以营利为目的的独立法人。 |
| Article 6 The examination institutions may be divided into two classes by the business they undertake. The institutions of Class 1 may undertake the examination of construction drawings of house building or municipal infrastructure projects without being limited to the scope of examination; the institutions of Class 2 may only undertake examination of construction drawings of house building or municipal infrastructure projects of Grade 2 or below. | |

| | 第六条 审查机构按承接业务范围分两类，一类机构承接房屋建筑、市政基础设施工程施工图审查业务范围不受限制；二类机构可以承接二级及以下房屋建筑、市政基础设施工程的施工图审查。 |
| Article 7 An examination institution of Class 1 shall meet the following conditions: | |
|
| | 第七条 一类审查机构应当具备下列条件： |
| (1) Its registered capital shall be no less than 1 million Yuan. | |
|
| | （一）注册资金不少于100万元。 |
| (2) It has well-developed technical management and quality guaranty systems. | |
|
| | （二）有健全的技术管理和质量保证体系。 |
| (3) Each examiner shall have good professional ethics, and have 15 years or more of survey and design work experience in the involved field; and shall have been in charge of the survey and design in the corresponding field for 5 or more construction projects of Grade 1, large projects of public utilities, or engineering survey projects of Grade A. In the fields to which the practicing registration system applies, each examiner shall have the qualification as a registered architect of Grade 1, registered structure engineer of Grade 1, or registered survey and design engineer; while in the fields to which no practicing registration system applies, each examiner shall have the technical title of senior engineer or above. | |

| | （三）审查人员应当有良好的职业道德，具有15年以上所需专业勘察、设计工作经历；主持过不少于5项一级以上建筑工程或者大型市政公用工程或者甲级工程勘察项目相应专业的勘察设计；已实行执业注册制度的专业，审查人员应当具有一级注册建筑师、一级注册结构工程师或者勘察设计注册工程师资格，未实行执业注册制度的，审查人员应当有高级工程师以上职称。 |
| (4) For the examination of construction drawings of house building projects, there shall be no less than 6 professional structure examiners, and no less than 2 professional examiners for each of the following fields they specialize in: architecture, electric engineering, heat supply, water supply and discharge, survey, etc. For the examination of construction drawings of municipal infrastructure projects, there shall be no less than 6 examiners for the fields involved, and no less than 2 professional examiners for each of other auxiliary fields they specialize in. For the special examination of survey documents, there shall be no less than 6 professional survey examiners. | |

| | （四）从事房屋建筑工程施工图审查的，结构专业审查人员不少于6人，建筑、电气、暖通、给排水、勘察等专业审查人员各不少于2人；从事市政基础设施工程施工图审查的，所需专业的审查人员不少于6人，其他必须配套的专业审查人员各不少于2人；专门从事勘察文件审查的，勘察专业审查人员不少于6人。 |
| (5) An examiner shall generally not be over 65, and moreover, the number of examiners over 60 shall not exceed 1/2 of the prescribed total number of examiners specializing in this field. | |
|
An examination institution that undertakes the examination of construction drawings of over-limited high-rise construction projects shall, in addition to meeting the abovementioned conditions, have no less than 3 examiners who have been in charge of the professional structural design of over-limited high-rise construction projects or of construction projects of 100 meters high or higher. | | （五）审查人员原则上不得超过65岁，60岁以上审查人员不超过该专业审查人员规定数的1/2。 |

承担超限高层建筑工程施工图审查的，除具备上述条件外，还应当具有主持过超限高层建筑工程或者100米以上建筑工程结构专业设计的审查人员不少于3人。
