| 1.1 These Guidelines have been developed in accordance with relevant laws and regulations in order to implement the holistic approach to national security, promote the sound development of foreign trade and economic cooperation and strengthen the work on customs technical trade measures. | | 1.1 为贯彻落实总体国家安全观，促进对外经济贸易健康发展，加强海关技术性贸易措施工作，根据有关法律和规定，制定本指南。 |
| 1.2 Customs technical trade measures include the technical regulations, standards, conformity assessment procedures and animal and plant quarantine and food safety measures implemented by the Customs. | | 1.2 海关技术性贸易措施包括海关实施的技术法规、标准、合格评定程序，以及动植物检疫和食品安全措施等。 |
| 1.3 The work on customs technical trade measures aims to protect human health and safety, the life and health of animals or plants and the environment, prevent frauds and safeguard national security and complies with the relevant rules of the World Trade Organization (WTO), the Agreement on Technical Barriers to Trade (TBT Agreement) and the Agreement on the Application of Sanitary and Phytosanitary Measures (SPS Agreement). | | 1.3 海关技术性贸易措施工作以保护人类健康和安全、保护动物或者植物的生命和健康、保护环境、防止欺诈行为、维护国家安全为目标，遵循世界贸易组织（WTO）《技术性贸易壁垒协定》（TBT协定）和《实施卫生与植物卫生措施协定》（SPS协定）的相关规则。 |
| 1.4 These guidelines shall apply to the administration of customs technical trade measures (hereinafter referred to as the “technical trade measures”), including information collection, analysis and judgment, decision and disposal, and notification, review, consultation and coordination as well as trade impact investigation, among others. | | 1.4 本指南适用于海关技术性贸易措施（以下简称技贸措施）工作的管理，包括信息收集、分析研判、决策处置、通报评议及磋商协调、贸易影响调查等。 |
| 1.5 The Department of General Business of the General Administration of Customs shall be responsible for coordinating the work on technical trade measures, drafting the management system for the administration of technical trade measures, organizing the research into and development of technical trade measures and the investigation of trade impact, and leading the contact, communication and coordination with related departments. | | 1.5 海关总署综合业务司负责协调开展技贸措施工作，拟订技贸措施管理制度，组织开展技贸措施的研究与制定，组织开展贸易影响调查；牵头与相关部门的联系、沟通与协调。 |
| The Department of International Cooperation of the General Administration of Customs shall be responsible for the national notification, evaluation and consultation of technical trade measures, and organizes and carries out international consultation and collaboration on technical trade measures. | | 海关总署国际合作司负责技贸措施的国家通报、评议和咨询工作，组织开展技贸措施国际磋商与协作。 |
| The Department of Statistics and Analysis of the General Administration of Customs shall be responsible for organizing the monitoring and evaluation of the dynamic changes of foreign technical trade measures and advancing the building of a public information service platform for import and export enterprises. | | 海关总署统计分析司负责组织开展国外技贸措施动态变化的监测评估，推动服务进出口企业的信息公共服务平台建设。 |
| The relevant functional departments of the General Administration of Customs shall be responsible for the information collection, analysis and judgment, decision-making and disposal, and organization and implementation of technical trade measures within the scope of their responsibilities. | | 海关总署各相关业务职能部门负责职责范围内技贸措施的信息收集、分析研判、决策处置和组织实施等工作。 |
| 1.6 Each customs office directly under the General Administration of Customs shall be responsible for the work on technical trade measures within its own customs jurisdictions, and shall collect, analyze and submit information on technical trade measures as well as the implementation thereof. | | 1.6 各直属海关负责本关区技贸措施工作，开展技贸措施信息的收集、分析、报送和技贸措施的具体实施等工作。 |
| 1.7 The General Administration of Customs may, as required by technical trade measures, authorize the relevant department to undertake the affairs related to technical trade measures. | | 1.7 根据技贸措施工作需要，海关总署可授权有关部门承办技贸措施的相关事务性工作。 |
| 1.8 The General Administration of Customs shall establish a unified information system to meet the needs of administration of technical trade measures. | | 1.8 海关总署建立统一的信息化系统，满足技贸措施工作管理需要。 |

| 2.1 Customs offices shall collect information about the imports and exports in relation to human health and property safety, animal and plant health, food safety, product quality safety, environmental safety and national security, including but not limited to the following: | | 2.1 海关收集进出口货物涉及人体健康和财产安全、动植物健康、食品安全、商品质量安全、环境安全、国家安全等相关信息，包括但不限于以下方面： |
| 2.1.1 Regulatory information about the examination, inspection and quarantine of imports and exports conducted by Customs offices; | | 2.1.1 海关实施进出口查验、检验、检疫等监管信息； |
| 2.1.2 Information reported by inspection and testing institutions; | | 2.1.2 检验检测机构报告信息； |
| 2.1.3 Information about overseas notifications, recalls and export returns; | | 2.1.3 境外通报召回信息、出口退运信息； |
| 2.1.4 Information notified by government agencies at all levels and trade associations; | | 2.1.4 各级政府部门及行业协会通报信息； |
| 2.1.5 Information notified by overseas government agencies; | | 2.1.5 境外政府部门通报信息； |
| 2.1.6 Information reported by producers and distributors; | | 2.1.6 生产经营者报告信息； |
| 2.1.7 Information about media and public opinions; and | | 2.1.7 媒体舆情信息； |
| 2.1.8 Information about complaints from consumers. | | 2.1.8 消费者投诉信息。 |
2.2 Each customs office directly under the General Administration of Customs shall, through extensive visits, questionnaires and other forms, collect all the information as set forth in 2.1, establish information delivery points in industrial agglomeration areas, key enterprises and key testing institutions to collect relevant information in a timely manner.
