The Provisions on the Protection of Geographical Indication Products have been deliberated and adopted at the executive meeting of the State Administration of Quality Supervision, Inspection and Quarantine on May 16, 2005. They are hereby promulgated and shall come into force as of July 15, 2005. | |

| Article 1 For the purpose of effectively protecting the products of geographical indications in our country, regulating the use of names and special signs of geographical indication products and ensuring the quality and characteristics of geographical indication products, these Provisions are formulated in accordance with the Product Quality Law of the People's Republic of China, Standardization Law of the People's Republic of China and Law of the People's Republic of China on the Inspection of Import and Export Commodities. | | 第一条 为了有效保护我国的地理标志产品，规范地理标志产品名称和专用标志的使用，保证地理标志产品的质量和特色，根据《中华人民共和国产品质量法》、《中华人民共和国标准化法》、《中华人民共和国进出口商品检验法》等有关规定，制定本规定。 |

| Article 2 The “geographical indication products” as mentioned in these Provisions refer to those products which are named after geographical name after being examined and approved, which originate from a specific region, and whose quality, reputation or other characteristics depend on the natural factors and humane factors of the area of production. The geographical indication products include: | | 第二条 本规定所称地理标志产品，是指产自特定地域，所具有的质量、声誉或其他特性本质上取决于该产地的自然因素和人文因素，经审核批准以地理名称进行命名的产品。地理标志产品包括： |

| (1) the products originating from the plantation and breeding of this region; | | （一）来自本地区的种植、养殖产品。 |
| |
|
| (2) the products produced and processed from raw materials coming entirely from a region or partly from elsewhere according to the specific techniques of this region. | | （二）原材料全部来自本地区或部分来自其他地区，并在本地区按照特定工艺生产和加工的产品。 |

| Article 3 These Provisions shall apply to the acceptance, examination and approval of the applications for products of geographical indication, registration, supervision and management of geographical signs. | | 第三条 本规定适用于对地理标志产品的申请受理、审核批准、地理标志专用标志注册登记和监督管理工作。 |

|
| Article 4 The State Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as the SAQSIQ) shall be responsible for the protection of geographical indication products throughout the country. The entry-exit inspection and quarantine bureaus and quality technical supervision bureaus of all places (hereinafter referred to the quality inspection institutions) shall, according to their respective functions, carry out the protection of geographical indication products. | | 第四条 国家质量监督检验检疫总局（以下简称“国家质检总局”）统一管理全国的地理标志产品保护工作。各地出入境检验检疫局和质量技术监督局（以下简称各地质检机构）依照职能开展地理标志产品保护工作。 |

| Article 5 The applications for the protection of of geographical indication products shall be subject to the examination and approval under these Provisions. The use of special signs of geographical indication products shall be registered and shall be subject to supervision and management in accordance with these Provisions. | | 第五条 申请地理标志产品保护，应依照本规定经审核批准。使用地理标志产品专用标志，必须依照本规定经注册登记，并接受监督管理。 |

| Article 6 The protection of geographical indication products shall be in line with the principle of free will, acceptance and openness of approval. | | 第六条 地理标志产品保护遵循申请自愿，受理及批准公开的原则。 |
| |
|
| Article 7 A geographical indication product for which one applies for protection shall meet the requirements for safety, sanitation and environmental protection. If it may injure the environment, ecology or resources, it shall not be accepted or protected. | | 第七条 申请地理标志保护的产品应当符合安全、卫生、环保的要求，对环境、生态、资源可能产生危害的产品，不予受理和保护。 |

| Chapter II Application and Acceptance | | 第二章 申请及受理 |

| Article 8 An application for the protection of a geographical indication product shall be filed by the applicant institution for the protection of geographical indication products as designated by the people's government at or above the county level, or shall be made by the association or enterprise accredited by the people's government, and the opinions of the relevant departments on the application shall be solicited. | | |

| Article 9 If a product for which one requests for protection is within the administrative area of a county, the people's government at the county level shall put forward a proposal on the range of production place; if it is beyond the administrative area of county, the municipal people's government at the prefecture level shall put forward a proposal on the range of production place; if it is beyond the administrative area of a municipality or prefecture level, the provincial people's government shall put forward a proposal on the range of production place. | | 第九条 申请保护的产品在县域范围内的，由县级人民政府提出产地范围的建议；跨县域范围的，由地市级人民政府提出产地范围的建议；跨地市范围的，由省级人民政府提出产地范围的建议。 |

| Article 10 An applicant shall submit the following materials: | | 第十条 申请人应提交以下资料： |

| (1)The proposal of the local government about the range of production place for the geographical indication product. | | （一）有关地方政府关于划定地理标志产品产地范围的建议。 |

(2)The documents of the local government about establishing an applicant institution or determining the association or an enterprise as the applicant.
