AGREEMENT ON SOCIAL SECURITY BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE PEOPLE'S REPUBLIC OF CHINA | | 中华人民共和国政府和日本国政府社会保障协定 |

| The Government of Japan and the Government of the People's Republic of China, aiming to further develop the friendly relations between Japan and the People's Republic of China (hereinafter referred to as “the Contracting Parties”) and, being desirous of advancing their mutual cooperation in the field of social security, have agreed as follows: | | 中华人民共和国政府和日本国政府，本着加强中华人民共和国和日本国（以下称缔约双方）友好关系之目的，愿促进在社会保障领域的互利合作，达成协议如下： |
| PART I GENERAL PROVISIONS | | 第一部分 总则 |
| Article 1 Definitions | | 第一条 定义 |
| 1. For the purpose of this Agreement: | | 一、为本协定之目的： |
| (a) “national” means, | | （一）“国民” |
| as regards the People's Republic of China, any individual possessing the nationality of the People's Republic of China; | | 在中华人民共和国，系指具有中华人民共和国国籍的个人； |
| as regards Japan, a Japanese national within the meaning of the law on nationality of Japan. | | 在日本国，系指日本国有关国籍的法律定义的日本国民。 |
| (b) “legislation” means, | | （二）“法律规定” |
| as regards the People's Republic of China, the laws, the administrative, ministerial and local rules and regulations and other legal provisions concerning the social insurance system specified in paragraph 1(a) of Article 2. | | 在中华人民共和国，系指本协定第二条第一款第一项所包括的社会保险制度相关的法律、行政法规、部门规章、地方性法规和其他法律文件； |
| as regards Japan, the laws and regulations of Japan concerning the Japanese pension systems specified in paragraph 1(b) of Article 2. | | 在日本国，系指本协定第二条第一款第二项所包括的日本年金制度相关的法律和规定。 |
| (c) “competent authority” means, | | （三）“主管机关” |
| as regards the People's Republic of China, the Ministry of Human Resources and Social Security; | | 在中华人民共和国，系指人力资源和社会保障部； |
| as regards Japan, any of the Governmental organizations competent for the Japanese pension systems specified in paragraph 1(b) of Article 2. | | 在日本国，系指主管本协定第二条第一款第二项中日本年金制度的任何政府机关。 |
| (d) “competent institution” means, | | （四）“经办机构” |
| as regards the People's Republic of China, the Social Insurance Administration of the Ministry of Human Resources and Social Security or other bodies designated by the said Ministry; | | 在中华人民共和国，系指人力资源和社会保障部社会保险事业管理中心或该部指定的其他机构； |
| as regards Japan, any of the insurance institutions, or any association thereof, responsible for the implementation of the Japanese pension systems specified in paragraph 1(b) of Article 2. | | 在日本国，系指负责实施第二条第一款第二项中日本年金制度的保险机构或其协会。 |
| 2. For the purpose of this Agreement, any term not defined in this Agreement shall have the meaning assigned to it in the applicable legislation of the respective Contracting Parties. | | 二、为本协定之目的，协定中未定义的词语应具有缔约双方各自适用法律规定赋予的含义。 |
| Article 2 Scope of Legislation | | 第二条 法律适用范围 |
| 1. This Agreement shall apply: | | 一、本协定适用于： |
| (a) as regards the People's Republic of China, to the legislation concerning the Basic Old-Age Insurance for Employees; | | （一）在中华人民共和国，职工基本养老保险相关的法律规定。 |
| (b) as regards Japan, to the legislation concerning the following Japanese pension systems: | | （二）在日本国，下列日本年金制度相关的法律规定： |
| (i) the National Pension (except the National Pension Fund); and | | 1.国民年金（国民年金基金除外）； |
| (ii)( the Employees' Pension Insurance (except the Employees' Pension Fund); | | 2.厚生年金（厚生年金基金除外）。 |
| however, for the purpose of this Agreement, the National Pension shall not include the Old Age Welfare Pension or any other pensions which are granted on a transitional or complementary basis for the purpose of welfare and which are payable wholly or mainly out of national budgetary resources. | | 为本协定之目的，国民年金不包括全部或主要由国家财政支出的以提供过渡性或补充性福利为目的之老年福利年金或其他年金。 |
| 2. The legislation referred to in paragraph 1 of this Article shall not include any treaty or other international agreement on social security concluded between a Contracting Party and a third State, or legislation promulgated exclusively for the specific implementation of that treaty or agreement. | | 二、本条第一款所指法律规定不包括缔约一方与第三国在社会保障方面缔结的条约或国际协定，以及仅为具体实施这些条约或协定之目的颁布的法律规定。 |
| Article 3 Personal Scope | | 第三条 人员适用范围 |
| This Agreement shall apply to all persons who are or have been subject to the legislation of a Contracting Party, as well as to the family members or survivors who derive rights from such persons. | | 本协定适用于正在或曾经受缔约一方法律规定管辖的所有人员，以及因这些人员而获得权益的家庭成员或遗属。 |
| Article 4 Equality of Treatment | | 第四条 平等待遇 |
| Unless otherwise provided in this Agreement, the persons specified in Article 3, who ordinarily reside in the territory of a Contracting Party, shall receive equal treatment with nationals of that Contracting Party in the application of the legislation of that Contracting Party. | | 除非本协定另有规定，通常居住在缔约一方领土上的第三条所提及人员，在适用该缔约方法律规定时，应享有与该缔约方国民平等的待遇。 |
| However, the foregoing shall not affect the provisions under the legislation of Japan on complementary periods for Japanese nationals on the basis of ordinary residence outside the territory of Japan. | | 但是，前述条款不影响日本法律规定关于通常居住在日本国境外的日本国民补充期限的规定。 |
| PART II PROVISIONS CONCERNING THE APPLICABLE LEGISLATION | | 第二部分 关于适用法律的规定 |

| Unless otherwise provided in this Agreement, a person who works as an employee in the territory of a Contracting Party shall, with respect to that work, be subject only to the legislation of that Contracting Party. | | 除非本协定另有规定，在缔约一方领土上工作的雇员，就此项工作而言，仅受该缔约方法律规定管辖。 |
