| For the purposes of regulating technical investigators' participation in legal proceedings of intellectual property cases, these Provisions are developed in accordance with the Organic Law of the People's Courts of the People's Republic of China, the Criminal Procedure Law of the People's Republic of China, the Civil Procedure Law of the People's Republic of China and the Administrative Procedure Law of the People's Republic of China, and in light of the trial practice. | | 为规范技术调查官参与知识产权案件诉讼活动，根据《中华人民共和国人民法院组织法》《中华人民共和国刑事诉讼法》《中华人民共和国民事诉讼法》《中华人民共和国行政诉讼法》的规定，结合审判实际，制定本规定。 |
| Article 1 When the people's court tries intellectual property cases with strong technical expertise, such as those on patents, new plant varieties, integrated circuit layout design, technical secrets, computer software and monopoly, technical investigators may be designated to participate in legal proceedings. | | 第一条 人民法院审理专利、植物新品种、集成电路布图设计、技术秘密、计算机软件、垄断等专业技术性较强的知识产权案件时，可以指派技术调查官参与诉讼活动。 |
| Article 2 Technical investigators are trial supporting personnel. | | 第二条 技术调查官属于审判辅助人员。 |
| The people's court may set up a technical investigation office to be responsible for the daily management of technical investigators, designate technical investigators to participate in the legal proceedings of intellectual property cases, and provide technical advice. | | 人民法院可以设置技术调查室，负责技术调查官的日常管理，指派技术调查官参与知识产权案件诉讼活动、提供技术咨询。 |
Article 3 After the technical investigator participating in legal proceedings of intellectual property cases is determined or changes, the parties shall be informed within three days and the parties shall be legally informed that they have the right to apply for the withdrawal of the technical investigator.
