| For purposes of thoroughly implementing the spirit of the 18th CPC National Congress and the Fourth, Fifth, and Sixth Plenary Sessions of the 18th CPC Central Committee, actively carrying out the requirements of the Several Opinions of the State Council on Accelerating the Building of an Intellectual Property Power under New Conditions, executing the National Plan for Protection and Application of Intellectual Property Right during the “13th Five-year Plan Period,” maximizing the important role of arbitration and mediation in the coordinated resolution of disputes over intellectual property rights, exploring the shaping of a diversified resolution mechanism for disputes over intellectual property rights, and providing right holders with more routes to dispute resolution and options for enforcement of rights, the State Intellectual Property Office (“SIPO”) hereby decides on the basis of preliminary work to launch a pilot program of arbitration and mediation in disputes over intellectual property rights. | | 为深入贯彻党的十八大和十八届四中、五中、六中全会精神，积极落实《国务院关于新形势下加快知识产权强国建设的若干意见》要求，深入实施《“十三五”国家知识产权保护和运用规划》，充分发挥仲裁与调解在协调解决知识产权纠纷中的重要作用，探索形成知识产权纠纷多元化解决机制，为权利人提供更多的争议解决途径和维权选择，我局在前期工作基础上，决定开展知识产权纠纷仲裁调解试点工作。 |

| The Several Opinions of the State Council on Accelerating the Building of an Intellectual Property Power shall be implemented, the promotion of industry development and improvement of the innovation environment shall be the starting point, regions, institutions, social organizations or associations with strong needs and good foundations shall be selected as entities under the pilot program, and the inclusion of arbitration and mediation in disputes over intellectual property rights in the pilot program shall be explored. The advantages of intellectual property arbitration such as high efficiency and convenience, professionalism, strict confidentiality, and non-restrictions on territorial jurisdiction shall be maximized to serve the country's Belt and Road Initiative and enterprises' "heading overseas." | The business of arbitration and mediation in disputes over intellectual property rights shall continue to be regulated, the cultivation of industry mediation organizations for disputes over intellectual property rights and professional intellectual property arbitration institutions shall be strengthened, the establishment of a talent training and selection system for arbitration and mediation in disputes over intellectual property rights shall be accelerated, and the establishment of a pool of experts in arbitration and mediation in disputes over intellectual property rights shall be explored, so as to improve professionalism. The construction of intellectual property information exchange and case acceptance platforms shall be promoted, and a working mechanism for arbitration and mediation in disputes over intellectual property rights shall be established and improved, so as to achieve an efficient connection among intellectual property arbitration, mediation, administrative law enforcement, and judicial protection and actively promote arbitration and mediation in disputes over intellectual property rights such as patents, trademarks, copyrights, and trade secrets.
