The Interim Regulation on Major Administrative Decision-Making Procedures is hereby issued, and shall come into force on September 1, 2019. 现公布《重大行政决策程序暂行条例》,自2019年9月1日起施行。

Chapter I General Provisions 

第一章 总  则

Article 1 For the purposes of improving the scientific, democratic and legal decision-making mechanisms, standardizing major administrative decision-making procedures, enhancing decision-making quality and efficiency, and specifying decision-making responsibilities, this Regulation is developed in accordance with the Constitution and organization laws of local people's congresses at all levels and local people's governments at all levels and other provisions.   第一条 为了健全科学、民主、依法决策机制,规范重大行政决策程序,提高决策质量和效率,明确决策责任,根据宪法地方各级人民代表大会和地方各级人民政府组织法等规定,制定本条例。
Article 2 This Regulation shall apply to the procedures for making and adjusting major administrative decisions of local people's governments at or above the county level (hereinafter referred to as “decision-making organs”).   第二条 县级以上地方人民政府(以下称决策机关)重大行政决策的作出和调整程序,适用本条例。
Article 3 For the purposes of this Regulation, “major administrative decision-making matters” (hereinafter referred to as “decision-making matters”) include:   第三条 本条例所称重大行政决策事项(以下简称决策事项)包括:
(1) developing major public policies and measures relating to public services, market regulation, social management, environmental protection and other aspects; (一)制定有关公共服务、市场监管、社会管理、环境保护等方面的重大公共政策和措施;
(2) developing important plans for economic and social development and other aspects; (二)制定经济和社会发展等方面的重要规划;
(3) developing major public policies and measures to develop, utilize and protect important natural and cultural resources; (三)制定开发利用、保护重要自然资源和文化资源的重大公共政策和措施;
(4) deciding on major public construction projects to be implemented in the administrative region; and (四)决定在本行政区域实施的重大公共建设项目;
(5) deciding on other major matters that have a significant impact on economic and social development, involve material public interest, or the vital interests of the public. (五)决定对经济社会发展有重大影响、涉及重大公共利益或者社会公众切身利益的其他重大事项。
Where decision-making procedures for the matters prescribed in paragraph 1 of this Article are otherwise prescribed in any law or administrative regulation, such law or administrative regulation shall prevail. This Regulation shall not apply to macro-control decisions such as fiscal policies and monetary policies, government legislative decisions, and emergency response decisions. 法律、行政法规对本条第一款规定事项的决策程序另有规定的,依照其规定。财政政策、货币政策等宏观调控决策,政府立法决策以及突发事件应急处置决策不适用本条例。
The decision-making organ may, in accordance with the provisions of paragraph 1 of this Article, and in light of their functions and powers and local actual circumstances, determine the catalogue and standards of decision-making matters, announce them to the public with the consent of the Party committee at the same level, and make adjustments according to actual circumstances. 决策机关可以根据本条第一款的规定,结合职责权限和本地实际,确定决策事项目录、标准,经同级党委同意后向社会公布,并根据实际情况调整。
Article 4 The Party's overall leadership must be adhered to and strengthened in major administrative decision-making, the Party's lines, principles, policies, decisions and arrangements shall be comprehensively implemented, the core role of the Party's leadership shall be maximized, and the Party's leadership shall be implemented throughout the entire major administrative decision-making process.   第四条 重大行政决策必须坚持和加强党的全面领导,全面贯彻党的路线方针政策和决策部署,发挥党的领导核心作用,把党的领导贯彻到重大行政决策全过程。
Article 5 Major administrative decisions shall be made under the principle of scientific decision-making, the development concepts of innovation, coordination, green, openness and sharing shall be implemented, proceeding from actual circumstances shall be adhered to, scientific technologies and methods shall be applied, and objective law shall be respected, so as to adapt to the requirements for economic and social development and comprehensively deepening the reform.   第五条 作出重大行政决策应当遵循科学决策原则,贯彻创新、协调、绿色、开放、共享的发展理念,坚持从实际出发,运用科学技术和方法,尊重客观规律,适应经济社会发展和全面深化改革要求。
Article 6 Major administrative decisions shall be made under the principle of democratic decision-making, opinions shall be fully solicited from all parties, and it shall be guaranteed that the people participate in decision-making through various channels and forms.   第六条 作出重大行政决策应当遵循民主决策原则,充分听取各方面意见,保障人民群众通过多种途径和形式参与决策。
Article 7 Major administrative decisions shall be made under the principle of decision-making in accordance with the law, statutory authority shall be strictly observed, statutory procedures shall be performed in accordance with the law, and it shall be ensured that the content of the decision complies with laws, regulations, rules and other provisions.   第七条 作出重大行政决策应当遵循依法决策原则,严格遵守法定权限,依法履行法定程序,保证决策内容符合法律、法规和规章等规定。
Article 8 Major administrative decisions shall be subject to the supervision of the people's congress at the same level and its standing committee in accordance with the law, and if they fall within the scope of major matters that shall be deliberated and decided by the people's congress at the same level and its standing committee or they shall be reported to the standing committee of the people's congress at the same level before issuance in accordance with laws and regulations, relevant provisions shall be followed.   第八条 重大行政决策依法接受本级人民代表大会及其常务委员会的监督,根据法律、法规规定属于本级人民代表大会及其常务委员会讨论决定的重大事项范围或者应当在出台前向本级人民代表大会常务委员会报告的,按照有关规定办理。
The administrative organ at a higher level shall strengthen the supervision of major administrative decisions of administrative organs at lower levels. The audit organ shall supervise major administrative decisions as required. 上级行政机关应当加强对下级行政机关重大行政决策的监督。审计机关按照规定对重大行政决策进行监督。
Article 9 Major administrative decision-making shall be an important part of the assessment and evaluation of decision-making organs and their leaders.   第九条 重大行政决策情况应当作为考核评价决策机关及其领导人员的重要内容。
Chapter II Formation of the Draft Decision 

第二章 决策草案的形成

Section 1 Initiation of Decision-Making 

第一节 决策启动

Article 10 After suggestions on decision-making matters offered by all parties are subject to research and demonstration in accordance with the following provisions, a report shall be made to the decision-making organ to decide whether to initiate the decision-making procedures:   第十条 对各方面提出的决策事项建议,按照下列规定进行研究论证后,报请决策机关决定是否启动决策程序:
(1) Where leaders of the decision-making organ offer suggestions on decision-making matters, they shall forward them to the relevant entities for research and demonstration. (一)决策机关领导人员提出决策事项建议的,交有关单位研究论证;
(2) Where a department subordinate to the decision-making organ or the people's government at the next lower level offers suggestions on decision-making matters, it shall demonstrate the major problems to be resolved, the reasons and basis for the suggestions, the preliminary plan for resolving problems, and the necessity and feasibility thereof, among others. (二)决策机关所属部门或者下一级人民政府提出决策事项建议的,应当论证拟解决的主要问题、建议理由和依据、解决问题的初步方案及其必要性、可行性等;
(3) Where NPC deputies and CPPCC members, among others, offer suggestions on decision-making matters in such forms as suggestions and proposals, and citizens, legal persons or other organizations offer written suggestions on decision-making matters, they shall submit the suggestions to the relevant entities for research and demonstration. (三)人大代表、政协委员等通过建议、提案等方式提出决策事项建议,以及公民、法人或者其他组织提出书面决策事项建议的,交有关单位研究论证。
Article 11 Where the decision-making organ decides to initiate decision-making procedures, it shall specify the entity undertaking the decision-making matters (hereinafter referred to as the “decision-making entity”), and the decision-making entity shall be responsible for drafting major administrative decisions and other work. If decision-making matters need to be undertaken by two or more entities, the leading decision-making entity shall be specified.   第十一条 决策机关决定启动决策程序的,应当明确决策事项的承办单位(以下简称决策承办单位),由决策承办单位负责重大行政决策草案的拟订等工作。决策事项需要两个以上单位承办的,应当明确牵头的决策承办单位。
Article 12 The decision-making entity shall prepare draft decisions on the basis of extensive and in-depth investigation and research, obtainment of relevant information in a comprehensive and accurate manner, and full consultation and coordination.   第十二条 决策承办单位应当在广泛深入开展调查研究、全面准确掌握有关信息、充分协商协调的基础上,拟订决策草案。
The decision-making entity shall comprehensively review the laws, regulations, rules and policies relating to the decision-making matters, so as to ensure that the draft decision complies with laws and regulations, and is consistent with relevant policies. 决策承办单位应当全面梳理与决策事项有关的法律、法规、规章和政策,使决策草案合法合规、与有关政策相衔接。
The decision-making entity shall analyze and predict cost, economic and social and environmental benefits such as the input of human, property and material resources, resource consumption, and environmental impact involved in decision-making matters as required. 决策承办单位根据需要对决策事项涉及的人财物投入、资源消耗、环境影响等成本和经济、社会、环境效益进行分析预测。
Where there are major differences between the relevant parties on decision-making matters, the decision-making entity may offer two or more plans. 有关方面对决策事项存在较大分歧的,决策承办单位可以提出两个以上方案。
Article 13 Where the decision-making matters involve the duties of a department subordinate to the decision-making organ or the people's government at the next lower level or any other entity, or are closely related to such entity, the decision-making entity shall fully consult with the relevant entity; in the case of failure to reach a consensus, it shall explain the main issues in dispute to the decision-making organ, the opinions of the relevant entity, and the opinions of the decision-making entity and relevant reasons and grounds.   第十三条 决策事项涉及决策机关所属部门、下一级人民政府等单位的职责,或者与其关系紧密的,决策承办单位应当与其充分协商;不能取得一致意见的,应当向决策机关说明争议的主要问题,有关单位的意见,决策承办单位的意见、理由和依据。
Section 2 Public Participation 

第二节 公众参与

Article 14 The decision-making entity shall fully solicit opinions in the form widely available for public participation, except decision-making matters that shall not be disclosed in accordance with the law.   第十四条 决策承办单位应当采取便于社会公众参与的方式充分听取意见,依法不予公开的决策事项除外。
Opinions may be solicited in such forms as symposiums, hearings, field visits, written solicitation of opinions from the public, questionnaires, and opinion polls. 听取意见可以采取座谈会、听证会、实地走访、书面征求意见、向社会公开征求意见、问卷调查、民意调查等多种方式。
Where the decision-making matters involve the interests of a particular group, the decision-making entity shall communicate and negotiate with relevant people's groups, social organizations, and representatives of the people, and fully solicit the opinions and suggestions of relevant groups.
