| Chapter I General Provisions | | 第一章 总则 |
| Article 1 To strengthen the supervision and administration of construction activities, protect the public interests, regulate the order of the construction market, guarantee the quality and safety of construction projects, and enhance the sound development of the construction industry, these Provisions are developed in accordance with the Construction Law of the People's Republic of China, the Administrative Licensing Law of the People's Republic of China, the Regulation on the Quality Control of Construction Projects, the Regulation on the Safety Management of Construction Projects, and other relevant laws and administrative regulations. | | 第一条 为了加强对建筑活动的监督管理，维护公共利益和规范建筑市场秩序，保证建设工程质量安全，促进建筑业的健康发展，根据《中华人民共和国建筑法》、《中华人民共和国行政许可法》、《建设工程质量管理条例》、《建设工程安全生产管理条例》等法律、行政法规，制定本规定。 |
| Article 2 These Provisions shall apply to the application for qualifications as construction enterprises and the supervision and administration of such qualifications within the territory of the People's Republic of China. | | 第二条 在中华人民共和国境内申请建筑业企业资质，实施对建筑业企业资质监督管理，适用本规定。 |
| For the purpose of these Provisions, the term “construction enterprises” means enterprises engaged in the construction, expansion and reconstruction of civil engineering projects, construction projects, and circuit and pipeline equipment installation projects. | | 本规定所称建筑业企业，是指从事土木工程、建筑工程、线路管道设备安装工程的新建、扩建、改建等施工活动的企业。 |
| Article 3 An enterprise shall apply for the qualification as a construction enterprise on the basis of its assets, major personnel, the construction projects completed, technical equipment, and other conditions, and may engage in construction activities within the licensed scope only after obtaining a qualification certificate upon examination. | | 第三条 企业应当按照其拥有的资产、主要人员、已完成的工程业绩和技术装备等条件申请建筑业企业资质，经审查合格，取得建筑业企业资质证书后，方可在资质许可的范围内从事建筑施工活动。 |
| Article 4 The competent department of housing and urban-rural development under the State Council shall be responsible for the uniform supervision and administration of the qualifications of construction enterprises across the country. The departments of transport, water conservancy, industry and information technology, and other relevant departments under the State Council shall cooperate with the competent department of housing and urban-rural development under the State Council in carrying out administration of construction enterprises with qualifications of relevant types. | | 第四条 国务院住房城乡建设主管部门负责全国建筑业企业资质的统一监督管理。国务院交通运输、水利、工业信息化等有关部门配合国务院住房城乡建设主管部门实施相关资质类别建筑业企业资质的管理工作。 |
| The competent department of housing and urban-rural development of a province, autonomous region or municipality directly under the Central Government shall be responsible for the uniform supervision and administration of qualifications of construction enterprises in the administrative region. The departments of transport, water conservancy, industry and information technology, and other relevant departments of a province, autonomous region or municipality directly under the Central Government shall cooperate with the competent department of housing and urban-rural development at the same level in carrying out administration of construction enterprises with qualifications of relevant types in the administrative region. | | 省、自治区、直辖市人民政府住房城乡建设主管部门负责本行政区域内建筑业企业资质的统一监督管理。省、自治区、直辖市人民政府交通运输、水利、通信等有关部门配合同级住房城乡建设主管部门实施本行政区域内相关资质类别建筑业企业资质的管理工作。 |
| Article 5 The qualifications of construction enterprises include the general contractor qualification, specialized contractor qualification, and construction labor service qualification. | | 第五条 建筑业企业资质分为施工总承包资质、专业承包资质、施工劳务资质三个序列。 |
| The general contractor qualification and specialized contractor qualification are further classified into several types according to the nature of projects and the technical features. Each qualification type is divided into several grades according to the prescribed requirements. The construction labor service qualification does not divide types or grades. | | 施工总承包资质、专业承包资质按照工程性质和技术特点分别划分为若干资质类别，各资质类别按照规定的条件划分为若干资质等级。施工劳务资质不分类别与等级。 |
| Article 6 The qualification standards for construction enterprises, and the scope of projects which enterprises with corresponding qualifications are permitted to undertake shall be determined by the competent department of housing and urban-rural development under the State Council together with other relevant departments under the State Council. | | 第六条 建筑业企业资质标准和取得相应资质的企业可以承担工程的具体范围，由国务院住房城乡建设主管部门会同国务院有关部门制定。 |
| Article 7 The state encourages enterprises with the general contractor qualification to own labor service enterprises or hold controlling shares therein. | | 第七条 国家鼓励取得施工总承包资质的企业拥有独资或者控股的劳务企业。 |
| Construction enterprises shall strengthen technical innovation and personnel training, use advanced construction technologies and materials, and carry out green construction. | | 建筑业企业应当加强技术创新和人员培训，使用先进的建造技术、建筑材料，开展绿色施工。 |
| Chapter II Application and Licensing | | 第二章 申请与许可 |
| Article 8 An enterprise may apply for one or several qualifications for construction enterprises. | | 第八条 企业可以申请一项或多项建筑业企业资质。 |
| When an enterprise applies for a qualification for the first time or applies for an additional qualification, it shall apply for the qualification of the lowest grade. | | 企业首次申请或增项申请资质，应当申请最低等级资质。 |
| Article 9 The following qualifications shall be subject to licensing by the competent department of housing and urban-rural development under the State Council: | | 第九条 下列建筑业企业资质，由国务院住房城乡建设主管部门许可： |
| (1) Regarding the general contractor qualification, the special grade and first grade of the general contractor qualification, and the second grade of the general contractor qualification for railway projects. | | （一）施工总承包资质序列特级资质、一级资质及铁路工程施工总承包二级资质； |
| (2) Regarding the specialized contractor qualification, the first grade of the qualification for highway, water transport , water conservancy, railway and civil aviation projects, the second grade of the qualification for railway and civil aviation projects, and the first grade of the qualification involving multiple specialized fields. | | （二）专业承包资质序列公路、水运、水利、铁路、民航方面的专业承包一级资质及铁路、民航方面的专业承包二级资质；涉及多个专业的专业承包一级资质。 |
| Article 10 The following qualifications for construction enterprises shall be subject to licensing by the competent departments of housing and urban-rural development of the people's governments of the provinces, autonomous regions or municipalities at places where they are located: | | 第十条 下列建筑业企业资质，由企业工商注册所在地省、自治区、直辖市人民政府住房城乡建设主管部门许可： |
| (1) The second grade of the general contractor qualification, and the third grade of the qualification for railway and communication engineering projects. | | （一）施工总承包资质序列二级资质及铁路、通信工程施工总承包三级资质； |
| (2) The first grade of the specialized contractor qualification (excluding the first grade of the qualification for highway, water transport, water conservancy, railway and civil aviation projects, and the first grade of the qualification involving multiple specialized fields). | | （二）专业承包资质序列一级资质（不含公路、水运、水利、铁路、民航方面的专业承包一级资质及涉及多个专业的专业承包一级资质）； |
| (3) The second grade of the specialized contractor qualification (excluding the second grade of the qualification for railway and civil aviation projects), the third grade of the specialized contractor qualification for railway projects, and the specialized contractor qualification for special projects. | | （三）专业承包资质序列二级资质（不含铁路、民航方面的专业承包二级资质）；铁路方面专业承包三级资质；特种工程专业承包资质。 |
| Article 11 The following qualifications for construction enterprises shall be subject to licensing by the competent departments of housing and urban-rural development of the people's governments of the districted cities at the place of industrial and commercial registration of the enterprise concerned: | | 第十一条 下列建筑业企业资质，由企业工商注册所在地设区的市人民政府住房城乡建设主管部门许可： |
| (1) The third grade of the general contractor qualification (excluding the third grade of the general contractor qualification for railway and communication engineering projects. | | （一）施工总承包资质序列三级资质（不含铁路、通信工程施工总承包三级资质）； |
| (2) The third grade of the specialized contractor qualification (excluding the specialized contractor qualification for railway projects), and the specialized contractor qualification for ready mixed concrete and formwork and scaffold projects. | | （二）专业承包资质序列三级资质（不含铁路方面专业承包资质）及预拌混凝土、模板脚手架专业承包资质； |
| (3) The construction labor service qualification. | | （三）施工劳务资质； |
| (4) The qualifications for enterprises installing or maintaining gas-burning appliances. | | （四）燃气燃烧器具安装、维修企业资质。 |
| Article 12 An enterprise applying for a qualification listed in Article 9 herein shall file an application with the competent department of housing and urban-rural development of the people's government of the province, autonomous region or municipality directly under the Central Government at the place of industrial and commercial registration of the enterprise. In particular, for construction enterprises directly under the department of supervision of the state-owned asset management of the State Council, and enterprises at the next subordinate level, applications may be filed by the construction enterprises directly under the department of supervision of the state-owned asset management department of the State Council with the competent department of housing and urban-rural development under the State council. | | 第十二条 申请本规定第九条所列资质的，应当向企业工商注册所在地省、自治区、直辖市人民政府住房城乡建设主管部门提出申请。其中，国务院国有资产管理部门直接监管的建筑企业及其下属一层级的企业，可以由国务院国有资产管理部门直接监管的建筑企业向国务院住房城乡建设主管部门提出申请。 |
| The competent department of housing and urban-rural development of the people's government of a province, autonomous region or municipality directly under the Central Government shall complete the preliminary examination within 20 working days after accepting an application, and shall submit the preliminary examination opinion together with the application materials to the competent department of housing and urban-rural development under the State Council. | | 省、自治区、直辖市人民政府住房城乡建设主管部门应当自受理申请之日起20个工作日内初审完毕，并将初审意见和申请材料报国务院住房城乡建设主管部门。 |
| The competent department of housing and urban-rural development under the State Council shall, within 60 working days as of the day when the competent department of housing and urban-rural development of the people's government of the province, autonomous region or municipality directly under the Central Government, complete examination, publicize the examination opinion for 10 working days. In particular, qualifications concerning highway, water transport, water conservancy, communication, railway and civil aviation projects shall be subject to examination by the competent department of housing and urban-rural development under the State Council together with the relevant competent department under the State Council. | | 国务院住房城乡建设主管部门应当自省、自治区、直辖市人民政府住房城乡建设主管部门受理申请材料之日起60个工作日内完成审查，公示审查意见，公示时间为10个工作日。其中，涉及公路、水运、水利、通信、铁路、民航等方面资质的，由国务院住房城乡建设主管部门会同国务院有关部门审查。 |
| Article 13 The licensing procedure for qualifications listed in Article 10 of these Provisions shall be determined by the competent department of housing and urban-rural development of each province, autonomous region or municipality directly under the Central Government according to the law, and shall be disclosed to the public. | | 第十三条 本规定第十条规定的资质许可程序由省、自治区、直辖市人民政府住房城乡建设主管部门依法确定，并向社会公布。 |
| The licensing procedure for qualifications listed in Article 10 of these Provisions shall be determined by the competent department of housing and urban-rural development of each districted city according to the law, and shall be disclosed to the public. | | 本规定第十一条规定的资质许可程序由设区的市级人民政府住房城乡建设主管部门依法确定，并向社会公布。 |
| Article 14 To apply for a construction enterprise qualification, an enterprise shall submit the following materials: | | 第十四条 企业申请建筑业企业资质，应当提交以下材料： |
| (1) An application form for construction enterprise qualification, and the corresponding electronic file; | | （一）建筑业企业资质申请表及相应的电子文档； |
| (2) Photocopies of both the original and the duplicate of the business license; | | （二）企业营业执照正副本复印件； |
| (3) A photocopy of its bylaws; | | （三）企业章程复印件； |
| (4) A photocopy of its asset certificate; | | （四）企业资产证明文件复印件； |
| (5) A photocopy of the relevant certificates of its main staff; | | （五）企业主要人员证明文件复印件； |
(6) Photocopies of its certificates on the technical equipment required for the relevant qualification standards;
