| These Measures are developed to strengthen intellectual property law enforcement in online shopping and import and export, seriously investigate and punish the criminal acts of infringement upon intellectual property rights, intensify the inter-ministerial collaboration and cooperation, further improve the ability to enforce the law in intellectual property and safeguard the lawful rights and interests of the right holders and the market environment of fair competition. | | 为加强网购和进出口领域知识产权执法，严厉查处侵犯知识产权违法犯罪行为，密切部门间协作配合，进一步提高知识产权执法能力，维护权利人合法权益和公平竞争的市场环境，制定本实施办法。 |
| I. Strengthening law enforcement and supervision in accordance with law | | 一、依法加强执法监管 |
| Article 1 The administrative law enforcement department and the public security organ shall conscientiously perform their duties of law enforcement, strengthen the day-to-day supervision over online shopping and import and export, and strictly investigate and punish in accordance with law the criminal acts such as infringement of trademark rights, patent rights, copyrights, new plant variety rights, rights in relation to geographical indications and trade secrets. | | 第一条 有关行政执法部门和公安机关要认真履行执法职责，强化对网络购物和进出口领域的日常监管，依法严厉查处侵犯商标权、专利权、著作权、植物新品种权、地理标志、商业秘密等违法犯罪行为。 |
| Article 2 The relevant departments shall pay close attention to new business forms in the development of Internet economy, discover new situations and problems in respect of infringement on intellectual property rights in a timely manner, improve law enforcement and supervision measures, and investigate and handle criminal cases of intellectual property rights infringement according to law, so as to maintain a sound online trading environment. | | 第二条 密切关注互联网经济发展的新业态，及时发现侵犯知识产权违法的新情况、新问题，完善执法监管措施，依法查处侵犯知识产权违法犯罪案件，维护健康发展的网络交易环境。 |
| Article 3 The fundamental role of the oversight model drawing on random inspections by randomly selected law enforcement officers or inspectors and requiring the prompt release of results shall be maximized. The relevant departments shall smooth the transition between random inspections and other special inspections and impose tougher punishments in accordance with law on intellectual property rights violations discovered during the inspection to enhance the deterrent power of law enforcement and supervision. | | 第三条 充分发挥“双随机、一公开”监管的基础性作用，做好“双随机”检查与其他专项检查的衔接，对于检查中发现的知识产权违法问题，依法加大惩处力度，增强执法监管的威慑力。 |
